WEDNESDAY, JANUARY 5, 2022
The Franklin County Commissioners met Wednesday, January 5, 2022, with the
following members present: David S. Keller, John T. Flannery and Robert G. Ziobrowski.
Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the
Pledge of Allegiance, proceeded with the business of the day.
The meeting was live streamed.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously
approved to adopt the agenda.
Chairman Keller asked it to be noted in the minutes that the Board attended a reverent
and respectful memorial service for Corrections Officer Sterling Heinbaugh today and they were
honored by the presence of the Correctional Peace Officers Association and Honor Guard from
Berks, York, Allegheny and Franklin County Jails. The Board wanted to compliment the
Warden and his staff for organizing a meaningful ceremony to honor Mr. Heinbaugh. Chairman
Keller asked everyone to remember the family and coworkers of Mr. Heinbaugh at this difficult
time.
There was no public comment.
Chairman Keller asked Carrie Gray, County Administrator, to provide more information
on the ratification of a payroll voucher approval. Ms. Gray explained that we had to correct a
payroll record for an employee from whom we erroneously did not make paycheck deductions.
The Controller asked to correct the voucher so the employee could be paid last week. On a
motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved all bills
presented and ordered paid including the special payroll voucher from December 29, 2021.
The minutes of the December 29, 2021 meeting were reviewed. These will be decided
upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. The items will be decided
upon in the afternoon session.
The Board recessed and will reconvene at 2:00 p.m. for final approval of the items that
were reviewed.
The Board reconvened at 2:00 p.m.
There was no public comment.
On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously
approved the minutes of the December 29, 2021 meeting.
The Board reviewed Commissioners Office matters. On a motion by Robert G.
Ziobrowski, seconded by John T. Flannery; unanimously approved the extension of the Solicitor
Engagement Agreement dated January 28, 2020 between the County of Franklin and Black and
Davison, P.C. to provide legal services for the County. This extends the term of the agreement
by one year to December 31, 2022. All other terms of the agreement are hereby ratified and
confirmed, and shall remain in full force and effect.

The Board reviewed additional Commissioners Office matters. On a motion by Robert
G. Ziobrowski, seconded by John T. Flannery; unanimously approved the Franklin County
Elected Officials Solicitor Agreements as listed below for the period of January 1, 2022 through
December 31, 2022.
a. Clerk of Courts David Wertime for an amount of $5,325.00 for the contract period
b. Coroner - Jerrold Sulcove for an amount of $130.30 per hour for no more than 100
hours within the contract period without consent and approval by the Coroner and
Board of Commissioners.
c. Controller David C. Cleaver for an amount of $13,996.71 for the contract period.
d. Prothonotary Elizabeth A. Clark for an amount of $3,605.00 for the contract period.
e. Sheriff Clinton T. Barkdoll for an amount of $16,878.94 for the contract period.
The Board reviewed additional Commissioners Office matters. On a motion by Robert
G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute Change Order #EC-031 from Lobar, Inc. to install two additional lighting
control switches as requested by Owner for corridors at the Judicial Center at a cost of
$1,346.02.
The Board reviewed additional Commissioners Office matters. On a motion by Robert
G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute Change Order #EC-038 from Lobar, Inc. to revise electrical service to
refurbished elevator 4 (previously known as elevator 7) in the Historic Courthouse at a cost of
$8,439.30.
The Board reviewed Tuscarora Managed Care Alliance (TMCA) matters. On a motion
by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the
Administrative Agreement between the County of Franklin and the Tuscarora Managed Care
Alliance (TMCA) for provision of network, hardware/software, telephone and mail service, HR,
Risk Management, and payroll functions, etc. so that TMCA can perform duties as assigned by
DHS for achieving the objectives of the HealthChoices contract at a cost of $122,932.00 for the
contract period of January 1, 2021 through December 30, 2022. Funds will be reimbursed to
the County by TMCA.
On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously
approved to enter an executive session at 2:07 p.m. this date for the purpose of reviewing
contract negotiations matters. Ms. Gray stated that there will be a recommendation after the
executive session. The Board reconvened into regular session at 2:17 p.m.
Ms. Gray is requesting the Board enter into two contracts both for Criminal Conflict
Counsel Services. The first contract is with the Law Offices of Kevin Taccino for an amount of
$65,854.39 for the year 2022 and 2% increase for years 2023 and 2024. The second contract
is with Kulla, Barkdoll & Stewart for an amount of $65,854.39 for the year 2022 but this contract
will be for a 1 year term. Chairman Keller responded that this was consistent with what they
discussed during the executive session and gave staff guidance to proceed with finalizing the
Commissioner Ziobrowski wanted to mention the passing of Lebanon County
Commissioner Bill Ames who died of COVID last week. He and Bill served on the Workforce
Investment Board together. He stated that Bill was a friend, a good commissioner, a solid guy
