The Franklin County Commissioners met Thursday, September 17, 2009, with
the following members present: Robert L. Thomas, David S. Keller and Robert G.
Ziobrowski. Chairman Thomas presided and after calling the meeting to order, and the
Pledge of Allegiance proceeded with the business of the day.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously
approved to adopt the agenda.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously
approved all bills presented and ordered paid.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously
approved the minutes of September 8, 2009 and September 10, 2009 meetings.
The Board reviewed information regarding Constitution Week and Daughters of
the American Revolution 90th Anniversary. On a motion by David S. Keller, seconded by
Robert G. Ziobrowski; unanimously approved to sign Franklin County Proclamation
#2009-08 proclaiming the week of September 17 - 23, 2009 as Constitution Week and
congratulating Daughters of the American Revolution on their 90th Anniversary and that
the attached proclamation be made a part of these minutes.
The Board reviewed Assessment matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Agreement between the County of Franklin and Chambersburg
Area School District to retain Egbert J.A. Langendijk, MAI and to pay a proportionate
share of the cost of the appraisals and litigation services for the Washco Highlands of
Greenvillage I, LLC and Highlands Townhouses II, LLC tax assessment appeal. The
District will pay sixty-four (64%) percent of the cost and the County will pay thirty-six
(36%) percent of the costs of the appraisal and litigation services.
The Board reviewed additional Assessment matters. On a motion by David S.
Keller, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the Voluntary Agreement between the Taxing Authorities and LIFE
Lutheran Services for LIFE to make an annual payment in lieu of taxes equal to forty-two
and one-half percent (42.5%) of the annual assessed tax liability of the property to
resolve the taxable status of the property.
The Board reviewed Grants Management matters. On a motion by David S.
Keller, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the Acceptance Process to Office Justice Programs of the ARRA
Justice Assistance Grant for a grant amount of $104,360.00 for the grant period of
March 1, 2009 through February 28, 2013.

The Board reviewed additional Grants Management matters. On a motion by
David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute the Subgrant Award Notice from Pennsylvania
Commission on Crime and Delinquency for the CJAB Pre-Trial and Corrections Services
Project to receive the grant amount of $31,713.00 for the project period of October 1,
2009 through September 30, 2010.
The Board reviewed Jail matters. On a motion by David S. Keller, seconded by
Robert G. Ziobrowski; unanimously approved the 2009 Budget Adjustment in the amount
of $4,000.00 to increase budget of jail miscellaneous revenue and increase budget for
jail trash removal. Proceeds from sale of scrap will offset cost of trash removal.
The Board reviewed Risk Management matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved the 2009 Budget Adjustment
in the amount of $425.00 to cover the annual shared costs of a photo copier not
previously requested or budgeted.
In accordance with PA Acts 67, 68 and 127 notifications, Buchart Horn, Inc.
notified the County of a Pennsylvania Department of Environmental Protection NPDES
Permit Application being applied by The Franklin County Regional Airport to modify the
post construction plan to include two additional bioretention basins located in Greene
Township.
In accordance with PA Acts 67, 68 and 127 notifications, Red Barn Consulting,
Inc. notified the County of a Pennsylvania Department of Environmental Protection
Water Quality Management Permit being applied by Hissong Farmstead, Inc. for a
manure storage re-lining project located in Peters and Montgomery Townships.
In accordance with PA Acts 67, 68 and 127 notifications, R. Lee Royer &
Associates notified the County of a Pennsylvania Department of Environmental
Protection General NPDES Permit Application being applied by Eugene Horst for a
commercial development located in Washington Township.
Richard Wynn, Human Services Administrator, met with the Board to provide an
update on an Early Intervention provider. Childhood Early Intervention has had
expenses that are in violation of their contract. The parents have been notified and were
given a choice to transfer to another provider. Bureau of Financial Operations have sent
a draft report that outlines the disallowed costs which include salaries, automobile
charges, rent and personal expenses. Mr. Wynn will provide a contract for another
provider to the Board for approval.
The Board reviewed Commissioners Office matters and conducted a bid
opening for Security Equipment Installation for the Greencastle Magisterial District
Judge. On a motion by David S. Keller, seconded by Robert G. Ziobrowski;
unanimously approved to forward the bids received to the Security Officer, Project
Engineer, the Assistant County Solicitor and the Purchasing Agent for their review
The Board will award or reject the bids on September 24, 2009 at 9:20 a.m.
The Board met with the Information Services Director to review related
matters.

On a motion by David S. Keller, seconded by Robert G. Ziobrowski;
unanimously approved to enter an executive session at 9:37 a.m. this date for the
purpose to review identified claims by a vendor and assessment appeal matters.
The Board reconvened into regular session at 10:17 a.m.
The Board of Assessment and Revision of Taxes met to hear tax assessment
appeals.
The meeting was adjourned at 12:02 pm. with a motion by David S. Keller;
seconded by Robert G. Ziobrowski.
