HomeMy WebLinkAbout2022-12-14 Commissioner Minutes WEDNESDAY, DECEMBER 14, 2022 The Franklin County Commissioners met Wednesday, December 14, 2022, with the following members present: David S. Keller, John T. Flannery and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. The meeting was live streamed. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. There was no public comment. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. The minutes of the December 7, 2022 meeting were reviewed. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the minutes. The Board reviewed Agreements, Contracts and Reports. The items will be decided upon in the afternoon session. The Board reviewed appointments to the Franklin County Housing Authority Board. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the following individuals to fill unexpired terms: Kevin Myers for a term through May 31, 2024; Dave Jordan for a term through May 31, 2025; and John Flannery for a term through May 31, 2026. Their service is appreciated. This is the date for the Board to approve the 2023 Budget. Teresa Beckner, Fiscal rd Director, said that the proposed budget was presented to the Commissioners on November 23 and it was available for public inspection for the required 20 days by County code. There have been a few minor changes to the budget but the adjustments made are allowed within the variances for adopting the budget, per county code. The requirements of the County Code are that the budget cannot increase by 10% in the aggregate or more than 25% in any function over the proposed budget. Ms. Beckner reported that the adjustment to expenses was around $200 which is well within compliance. The final expenses of the General Fund to be adopted are $60.3 million which is up by $2.9 million from last year and revenues are $56.2 million an increase of $3.1 million for a net use of reserves of $4.1 million. She continued that the total expenses for all funds and operations are $170 million with total revenues of $158.8 million. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the following resolution adopting the 2023 budget: RESOLUTION #2022-30 WHEREAS, the 2023 Franklin County Budget has been prepared in accordance with the County Code Act of August 9, 1955 (P.L. 323, No. 130) as amended. WHEREAS, the 2023 Franklin County Proposed Budget was approved on Wednesday, November 23, 2022 and was made available for public inspection for at least 20 days. WHEREAS, the Proposed Budget and date set for the final action on the budget has been made a matter of public notice. Continued on page 2 WHEREAS, the Adopted Budget does not have increased expenditures of more than ten (10) per centum in the aggregate or more than twenty-five (25) per centum in any function over the proposed budget as made available for public inspection. WHEREAS, the Adopted Budget reflects as nearly as possible the estimated revenues and expenditures for the year 2023. BE IT RESOLVED AND ENACTED, and is hereby resolved and enacted by the Board of Commissioners of the County of Franklin, PA, to adopt the 2023 Budget as presented this date. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved that the following Resolution be adopted fixing the millage rate for real estate taxes for the year 2023 and the specific sums established to be required for the specific purposes of County Government; hereinafter, set forth during the current fiscal year: RESOLUTION #2022-31 BE IT RESOLVED AND ENACTED, and is hereby resolved and enacted by the Board of Commissioners of the County of Franklin, PA. SECTION 1 - That a tax be set and the same is hereby levied on all real property within Franklin County subject to taxation for the County purposes for the fiscal year 2023 as follows: Tax rate for general purposes, the sum of twenty-five (25) mills of each dollar assessed valuation with an additional four and one tenth (4.1) mills for the purposes of retirement of County debt services. SECTION 2 - That for the expenses of the County for the fiscal year 2023 the following amounts are hereby appropriated from the revenue available for the fiscal year for the specific purposes, which amount are fully itemized in the County budget. SECTION 3 - That any Resolution, or part of a Resolution, conflicting with this Resolution be and the same is hereby repealed in so far as the same affects this Resolution. On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the following Resolution imposing a total of one and three tenths (1.3) mills of real estate taxes for the purpose of the County Library in voting districts that have approved imposition of such tax by referendum and as authorized under the laws of the Commonwealth of PA in those voting districts. RESOLUTION #2022-32 BE IT RESOLVED, that a tax at the total rate of one and three tenths (1.3) mills on each dollar of assessed valuation for the fiscal year 2023 for the County Library purposes, shall be and the same is hereby imposed upon all taxable real estate in Franklin County as heretofore authorized by the voters of the various voting districts and as authorized under the laws of the Commonwealth of PA. The Board recessed and will reconvene at 2:00 p.m. for final approval of the items that were reviewed. The Board reconvened at 2:00 p.m. There was no public comment. Commissioner Flannery announced that Chairman Keller will not be attending the meeting this afternoon. Continued on page 3 The Board reviewed Commissioners matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved Resolution #2022-34 providing for the adoption of regulations as imposed by Act 57, which amends section 7 of the Act of May 25, 1945, known as the local Tax Collection Law and confers powers and imposes duties on Tax Collectors, Courts and various officers of certain political subdivisions, and prescribes penalties and the effect of failure to receive tax notice. The Board reviewed Department of Emergency Services matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the Customer Premises Equipment (CPE) Maintenance Quote from Lumen to provide maintenance coverage for the Cisco phones used at Emergency Services in the amount of $12,922.73, for the period of December 21, 2022 through December 20, 2023. The Board reviewed Domestic Relations matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the agreement between the County of Franklin and Contact Wireless to provide text messaging services at a monthly cost of $279.11 and a one-time fee of $80.00. The costs are 66% reimbursable from the State. This is a program that allows Domestic Relations to send text messages to clientele from computers about upcoming appointments, reminders to make payment, and any other short message that is appropriate. Clients are more likely to respond to text messages than reminder phone calls or email messages. The Board reviewed Fiscal matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the supplemental appropriation needed to increase the budget for additional Emergency Rental Assistance Program (ERAP) funding received during calendar year 2022 and to increase the corresponding expenses at a total of $3,055,000.00. The ERAP was outsourced to the South Central Community Action Program (SCCAP). Additional funding was requested by SCCAP due to the need in our community. Funding was awarded at the end of fiscal year 2021-2022. The Board reviewed additional Fiscal matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the supplemental appropriation needed to transfer unspent calendar year 2021 funds to fiscal year 2021-2022 for expenditures in the amount of $185,000.00. The Board reviewed additional Fiscal matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the supplemental appropriation needed for the Intellectual Developmental Disabilities program to transfer unspent calendar year 2021 funds to fiscal year 2021-2022 for expenditures in the amount of $151,677.00. Supplemental appropriation also needed to record fiscal year 2021-2022 American Rescue Plan Act (ARPA) Administration Entity Staffing, Respite, and Rate Increase supplemental payment funding for expenditures. The Board reviewed Human Resources matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the Service Agreement for Administration of Self-Insurance Program between the County of Franklin and Inservco Insurance Services, Inc. for Third party administrative claims for the County's workers compensation self-insurance program as required to maintain self-insurance status. Cost of services per contract for Year 1 (2023) - $15,300.00; Year 2 (2024) - $15,800.00; Year 3 (2025) - $16,274.00. The Board reviewed Property Management matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the Notice to Award, Agreement and Notice to Proceed, and Waiver to Liens to ARK Contracting, LLC for the roof replacement at the Human Services Building bid for a bid amount of $153,900.00 and $90 per sheet of plywood for deck repairs if needed. The bid was awarded to ARK Contracting on December 7, 2022. Continued on page 4 The Board reviewed additional Property Management matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the agreement between the County of Franklin and Hagerstown Paint & Glass Co., Inc. for purchasing and installation of 3 hollow metal doors for Department of Emergency Services - Building 426 at 390 New York Avenue, Chambersburg at a cost of $15,612.00. This cost includes a discount applied for the purchase of 3 doors (note top of page 2 of the proposal). The Board reviewed additional Property Management matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the agreement between the County of Franklin and Johnson Controls Fire Protection, LP for testing and inspections of the fire alarm system located at the Franklin County Administration Building, 272 North 2nd Street, Chambersburg PA at an annual cost of $1,735.57 for the period of January 1, 2023 through December 31, 2027. There is no increase per year. The Board reviewed Reentry Services Center matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the renewal of the agreement between the County of Franklin and Peerstar, LLC for peer mentoring services for Case Assisted Reentry program participants and jail inmates in the amount of $14,000.00 for the period of January 1, 2023 through December 31, 2023. In accordance with PA Act notifications, Glace Associates, Inc. notified the County of a Pennsylvania Department of Environmental Protection Part 2 Water Quality Management Construction Permit Application being applied by Shippensburg Borough replacement of biosolids pumps, controls and belt filter press and related work at the wastewater treatment plant on property located in Southampton Township. Oncology Bridge Fund and asked Keri Kenney, Human Resources Coordinator, to describe more about the fund and all the great ways that employees are supporting that effort. Ms. Kenney said that every year the County has a No Shave November Contest and a dress down fundraiser for the Oncology Bridge Fund. The fund helps struggling cancer patients to make ends meet with gas cards, groceries, pharmacy vouchers and other types of emergency assistance. One hundred percent of the donations are used to help cancer patients in our local area. She continued that cancer hits home for far too many people so we could eager to donate to this cause. A total of $610 was raised through the dress down portion and the No Shave Contest brought in $1,345 totaling $1,955, which is $335 more than what was raised last year. She thanked Trenton Morgan from Archives, Chuck Martin from Human participating in the No Shave Contest. Ms. Kenney congratulated Trenton and David for winning their category for growing the most facial hair and Chuck for raising the most money. The fundraisers would not be possible without them and everyone who participated. Jillian Simonson from WellSpan thanked everyone for donating to the Oncology Bridge Fund. Without these funds they would not be able to help local community members or their family members. These funds help with the financial burdens and allow the patients to focus on their treatments. Ms. Simonso thanked everyone again. Commissioner Flannery thanked her and thanked Keri, his question was how many people does the Bridge Fund support? Ms. Simonson responded that people do have to qualify and they work with a case manager to determine if they are qualified to get help with rent, utilities and groceries. Jillian said that on average they can support at least 80 people a year with these funds. Commissioner Flannery thanked her and her work on this; he thanked all county employees for the support they give to things like this. Many know that his wife passed away of breast cancer this past spring after an eight year fight with He can only imagine how difficult it is for someone that has financial challenges, which makes this bridge fund all the more important.
