Notice is hereby given that sealed bids will be received by the Franklin County Controller’s Office,

PRINTING, FURNISHING & DELIVERING OF PRIMARY AND ELECTIONS BALLOTS until 4:00 P.M.
prevailing time on TUESDAY, FEBRUARY 10, 2026. All bids so received will be publicly opened and read
on Wednesday, February 11, 2026 at 10:00 AM prevailing time at the Franklin County Commissioners’
Office, 272 North Second Street, Chambersburg, PA 17201.
Specifications, instructions and bid forms will be furnished by the Franklin County Procurement Office
upon request at 272 North Second Street, Chambersburg, PA 17201, or by calling (717) 261-3890.
The Franklin County Commissioners reserve the right to reject any or all bids and to waive any or all
defects, errors, omissions, irregularities or informalities in any bid.
Awards shall be made only to responsible bidders that possess the potential to perform successfully
under the terms and conditions of this procurement. Consideration shall be given to such matters as
bidder integrity, compliance with public policy, record of past performance and financial and technical
resources when determining responsibility.

INTRODUCTION
1. GENERAL INFORMATION. The County of Franklin, PA (“County”) is requesting bids from qualified
vendors to provide Printing, Furnishing and Delivery of Primary and November Election Ballots
for 2026.
2. DESCRIPTION OF THE GOVERNMENT. The County of Franklin, PA was incorporated on
September 9, 1784. The County is a fourth-class county with a population of 155,932 (2022
Census). It operates under a three-member elected Board of Commissioners. The County
provides services to its citizens such as elections and voter registration, judicial administration,
human services, public safety, public works, economic development and general administration.
The Franklin County Board of Elections is charged with the oversight and regulation of all
elections, complying with state and federal laws. From the list furnished by the Secretary of the
Commonwealth under the provisions of Sections 915 and 984 of the Pennsylvania Election Code,
as amended, 25 P.S. 2875 and 2944, and from the petitions and papers filed in their office, the
County Board is required to have printed the ballots in accordance with provisions of said
Election Code.
3. TIME REQUIREMENTS

INSTRUCTIONS TO BIDDERS
1. PREPARATION OF BID
1.1 Bids shall be addressed to and will be received by the Franklin County Controller’s Office,
Franklin County Administration Building, 272 North Second Street, Chambersburg, PA 17201
until 4:00 PM prevailing time on Tuesday, February 10, 2026. All bids so received will be
publicly opened and read by the Franklin County Commissioners on Wednesday February
11, 2026 at 10:00 AM at their offices at 272 North Second Street, Chambersburg, PA 17201.
1.2 Bids shall be enclosed in sealed opaque envelopes. Bids shall be identified by disclosing on
the face of the envelope the name of the project, “PRINTING, FURNISHING AND
DELIVERING OF PRIMARY AND NOVEMBER ELECTION BALLOTS” and the name of the
bidder.
1.3 Attention is directed to the Bid Form in the Bidding Documents. This form must be used to
submit a bid. Failure to fill out, execute and submit this form as specified is sufficient reason
for rejection.
1.4 Pricing shall be provided on the Bid Form by Precinct using the information provided in the
Specifications Section of this document.
1.5 A minimum of 3 references shall be provided on the Bid Form in the space provided. These
references shall be Pennsylvania counties and include the number of years the bidder has
worked with said county. Additional references may be provided on an additional sheet of
paper if desired.
1.6 Bids must be signed by an owner, partner, member or in the case of a corporation, by the
President or Vice President.
1.7 All applicable blank spaces in the bid shall be filled in clearly where indicated, either typed or
written in ink. Altering and/or changing any part of this bid will be sufficient reason for
rejection.
1.8 Where so indicated by the makeup of the Bid Form, sums shall be expressed in both words
and figures, and in the case of discrepancy between the two, the written amount shall
govern.
1.9 The owner reserves the rights to award the contracts to the other than lowest bidder if, in
its opinion, the products included within such bids are not equal to the standard established
for such projects in the specifications.
2. GENERAL REQUIREMENTS
2.1 The Contractor shall pay for and provide all materials, labor and transportation and other
services necessary for the proper completion of the work.
2.2 The Contractor shall comply with all rules, regulations, laws, etc. of any public or private
authority bearing on the performance of their work.
2.3 Unless otherwise provided, the Contractor shall secure and pay for all permits and
governmental fees, licenses and inspections necessary for the proper completion of the
work.
3. QUESTION AND ANSWER PERIOD
3.1 Questions will be accepted until Wednesday February 4, 2026 at 4:00 PM via email to
procurement@franklincountypa.gov. Answers will be posted in a timely fashion at
https://www.franklincountypa.gov/current-solicitation-opportunities/.
4. AWARD AND EXECUTION OF THE CONTRACT
4.1 The County reserves the right to correct minor math errors. The County shall be the sole
judge as to what constitutes a minor math error.
4.2 When the bid has been accepted by the Owner, notification of such acceptance will be
mailed to the successful bidder, at the address designated by the bidder on the BID FORM.
4.3 The agreement will begin upon execution and end February 28, 2027.
5. WITHDRAWAL OF BIDS
5.1 Bids may not be modified, withdrawn or cancelled by the bidder for thirty (30) days after the
time designated for the receipt of bids.
6. RIGHT TO REJECT BIDS
6.1 The owner reserves the right in its discretion to reject any or all bids and to waive
irregularities or information in any bid and to award contracts on an item by item basis.
Awards shall be made only to responsible bidders that possess the potential ability to
perform successfully under the terms and conditions of this procurement. Consideration
shall be given to such matters as bidder integrity, compliance with public policy, record of
past performance, and financial and technical resources when determining responsibility.
7. TIME OF COMPLETION
7.1 Official ballots and supplies shall be delivered to the office of the County Commissioners at
272 North Second Street, Chambersburg, PA 17201 no later than May 1, 2026 for the
General Primary and October 13, 2026 for the November Election, unless otherwise
approved in writing by the County.
7.2 The contracted printer shall be liable for charges or costs incurred by the County for said
bidder’s failure to deliver the ballots on the specified days, and any expenses arising in
conducting said Election caused by the delay in delivery by said contracted printer. Should
the awarded printer find discrepancies or omissions in the specifications or should the
awarded printer have doubt as to the meaning of said specifications, said printer shall
immediately notify the County Administrator.
8. EXEMPTION FROM FEDERAL EXCISE AND PENNSYLVANIA SALES TAX
8.1 The County of Franklin, PA is exempt from Federal Excise Taxes and Pennsylvania Sales Taxes
as a political subdivision of the Commonwealth of Pennsylvania. Prices as shown in the bid
shall exclude such Federal and State Taxes.
9. PROTECTION BY VENDOR
9.1 The vendor agrees to indemnify and hold harmless the County Releasees from and against,
and to reimburse the County Releasees with respect to, any and all claims, demands, causes
of action, losses, damages, liabilities, penalties, assessments, costs, and expenses (including
reasonable attorneys’ fees and other costs and expenses incident to any claim, suit, action
or proceeding) arising out of or resulting from the contract between the parties and/or the
fault or negligence of vendor, including, without limitation, any and all known or unknown,
foreseen or unforeseen, matured or unmatured claims and the consequences thereof.
9.2 The vendor shall not assign or otherwise transfer any of its responsibilities or obligations
under the contract to any other person or entity.
10. NONDISCRIMATION CLAUSE
10.1 Franklin County assures that no person shall be excluded from participating in, be denied
the benefits of, or be otherwise subjected to discrimination on the grounds of race, gender,
creed, color, sexual orientation, gender identity or expression, or in violation of the
Pennsylvania Human Relations Act, which prohibits discrimination on the basis of race,
color, religious creed, ancestry, age, sex, national origin, handicap or disability, or in
violation of any applicable local, state, or federal laws. With advance notification,
accommodations may be provided for those with special needs to language, speech, sight or

11. CONTRACT PROVISIONS
11.1 After Franklin County makes its selection, it shall proceed to negotiate a contract based on
the bid and scope of work for the project. If the County is unable to negotiate a satisfactory
contract with the most highly qualified bidder, the County shall formally end negotiations
with that bidder and begin to negotiate with the second most highly qualified bidder.
Negotiations shall continue in this sequence until a contract is agreed upon.
11.2 The performance of this contract shall be in accordance with all Federal, State and local
laws as may be applicable. Any contract between Franklin County and the awarded bidder
shall be subject to the rules and regulations of any agencies where funding is being
requested. Franklin County reserves the right to reject any and all proposals, and to waive
irregularities. Additionally, in the event that Franklin County procures grant funding
assistance, the contract shall contain all necessary provisions of that grant award contract.
11.3 The contract between the County and the selected bidder will include the following non-
negotiable contact provisions
11.3.1 Indemnification of the County.
11.3.2 Non-Indemnification of the contractor.
11.3.3 Forum Selection (Franklin County, PA Court of Common Pleas).
11.3.4 Choice of law (Commonwealth of Pennsylvania).
11.3.5 Termination for convenience/termination for cause by the County.
11.3.6 Work-for-Hire Transfer of Copyrights/Intellectual Property.
11.3.7 County ownership of the instruments of service/deliverables.
11.3.8 Prevailing party attorneys’ fees.
11.3.9 Nondiscrimination.
11.3.10 Suspension and debarment.
11.3.11 Release of liability in favor of the County.
11.3.12 Non-release of liability of the contractor.
11.3.13 Insurance Coverage and County status as an additional insured.
11.3.14 Terms of payment and invoicing, including 45-day payment period.
11.3.15 Data security, confidentiality, and use of County data and information.
11.3.16 Any and all federal and state provisions required as a result of grant funding.
11.4 The County reserves the right to request additional contract provisions it deems necessary
as needed to protect the best interest of the County.
11.5 The form of contract shall be the Agreement in Attachment A.
12. SUBCONTRACTORS
12.1 Subcontractors are not permitted.
BID SPECIFICATIONS
GENERAL
There are several ballot types used for elections. Some of these are always printed and used, some are
only used in certain circumstances. They are:
1) Primary – Democratic Ballots: These ballots are used in the Spring Primary for registered
Democrats to elect persons to represent their party on the ballot in the November general
election. (See Attachment B)
2) Primary – Republican Ballots: These ballots are used in the Spring Primary for registered
Republicans to elect persons to represent their party on the ballot in the November general
election. (See Attachment C)
3) November Election: These ballots are used in the November Election for all registered voters to
elect persons for offices included in that election.
4) Primary – Nonpartisan: These ballots are used in the Spring Primary for persons who are not a
member of either the Democratic or Republican party to vote on a constitutional amendment
question(s), a ballot question(s) and/or vote in a special election(s) for their district.
5) Special Election: The County could hold a special election at anytime throughout the year to fill
an elected position that is vacant due to resignation, death or removal from office.
6) Specimen Ballots: Specimen Ballots are copies of actual ballots used at each precinct to allow
voters to view the ballots before voting.
7) Reserve Ballots – These ballots are held in reserve for each election.
8) Testing Ballots – These ballots are used to test the machines as required.
Numbers 1, 2, 3, 6, 7 & 8 (Primary – Democratic Ballots, Primary – Republican Ballots, General Election
Ballots, Specimen Ballots, Reserve Ballots & Testing Ballots) always need printed. Number 4 (Primary –
Nonpartisan Ballots) – occasionally are printed. Number 5 (Special Election Ballots) are seldom required.
However, the awarded printer shall be responsible for providing any and all of these ballots as
requested by the County following the requirements of this document during the term of the
Agreement.
The contracted printer bidder will receive from the County the ballot information in an electronic
format. For each ballot type, the file(s) will contain all ballot information including:
• The Instructions to Voter
• Office Headings
• Candidate Information
The electronic files are normally sent to the contracted printer 10-15 calendar days before the ballots
are due to the County. However, at times circumstances beyond the control of the County may reduce
that timeframe. The County will make every effort to give the printer as much time as possible, but no
matter how much or little notice is provided, the contracted printer MUST deliver all ballots by the
deadlines listed below. Additionally, the contractor shall not receive any additional compensation in the
event of a shorter timeframe.
Once the file is received by the contracted printer, the vendor shall then print, furnish and deliver all
paper ballots for the General Primary to be held on Tuesday, May 19, 2026 and the November Election
to be held on Tuesday, November 3, 2026, for all election districts as specified in the bid and the
agreement.
In addition to the printing, furnishing and delivery of ballots by dates specified in this document, the
contracted printer shall also provide for emergency printing and immediate delivery of ballots up to
and including the day of the primary, general election and/or special election.
The contracted printer agrees to be available when called upon to act at the direction of, and to
cooperate at all times with the Board of Elections of the County and the County Administrator so that all
supplies and materials required are properly and promptly furnished for said ballots, and so that said
ballots are in use and operation for said election in order that voting on said election day on said paper
ballots shall take place and the results delivered as contemplated and required by law in all respects.
The contracted printer agrees to be available when called upon to cooperate at all times with Election
Systems and Software, Inc. and their authorized representatives for all election purposes as aforesaid.
QUALIFICATIONS
The contracted printer shall have at least five (5) years’ experience in printing Pennsylvania optical scan
or digital ballots.
The physical location of the printing shall be located within thirty (30) miles of Chambersburg so that
ballots can be reviewed and tested prior to printing and to allow for emergency printing and delivery
of ballots for same day delivery.
PRINTING AND PREPARATION OF BALLOTS
Ballots for each type shall be printed on blank stock supplied by the printer. For these all ballot types
except Specimen Ballots, the printer shall order the CountRight Ballot Stock color white for our DS200’s either from Veritiv or ES&S per the Ballot Production Guide for EVA. Each ballot type will have
a shaded line near the top of the ballot. The designated colors are:
• The Republican Primary ballot = white, see Attachment C,
• The Democratic Primary ballot = grey, see Attachment B (which will appear on the electronic
files provided by the County),
• Primary-Nonpartisan and/or Special Election = buff, if applicable (this will also be designated on
the electronic files), and
• November Election Ballots = white.
All ballots shall be printed in black ink. Ballots shall be printed on machines capable of running an 8 ½" x
15" document.
Ballots shall be printed without any impression or mark to distinguish one from another. Each ballot
shall be attached to a one-inch stub, and all the ballots from the same election precinct shall be bound
together in books of fifty (50). Ballots shall be perforated at the top of the stub for detachment and
stubbed with consecutive numbers (see below). The perforation shall be in such manner that each ballot
may be detached from its stub and removed separately. Each bound book shall have a backer sheet
which is a piece of card stock at the back of the book to attach the stubs to for retention and to provide
for rigidity of the book.
The stubs of the ballots shall be consecutively numbered starting with the number one (1) for each
ballot type as such:
• In the Primary the number shall be preceded by an initial or abbreviation which appears upon
the stub designating political party (R-Republican, D-Democratic, N-Nonpartisan)
• In the November Election no additional letters are required.
• In the event of Special Election, directions will be provided for stub numbering upon issuing of
the precinct identification sheet.
• Reserve Ballots shall be numbered consecutively beginning where the regular primary or
general elections ballots left off and in the same format. For example, if for precinct A
1,200 ballots are printed and numbered 1 through 1,200, the reserve ballots would be
numbered 1,201 through 1,250.
• Testing Ballots – Testing ballots are not numbered nor bound.
The bound books of fifty (50) ballots shall be sealed in stretch wrap. Bound books of ballots may be
wrapped in packets of up to 6 bound books (or 300 ballots). The weight of the stretch wrap shall be
sufficient that the wrap does not break with handling. Wrapped ballots shall be placed in sealed boxes
for ease of transportation.
BALLOTS FOR THE PRIMARY AND NOVEMBER ELECTIONS
The printer shall supply all materials required for printing, wrapping, and delivery of ballots and will
print the required number of ballots as outlined in this bid and detailed on the precinct identification
sheets, which will be supplied by the County Election Board prior to printing. (The precinct identification
sheets are an electronic file(s) with the detailed lists of exactly what is required for each precinct.)
The contracted printer shall examine and be familiar with all samples, information and instructions on
file with the County Administrator including any training supplied by Election Systems & Software.
The contracted printer further agrees to print such ballots using the layout information supplied in the
electronic file(s). When multiple ballot types are involved (i.e. Republican, Democratic, Nonpartisan,
etc.) the contracted printer shall imprint the ballot style encoding (12 through 15 and 61 dots) at the
Municipal/General Election. This encoding will be done as directed by the County Administrator.
The printer may contact ES&S Print Services to obtain the registration overlay and correct Go/No-Go
Gauge.
PRIMARY – NONPARTISAN & SPECIAL ELECTION BALLOTS
The County will provide direction for these ballots should they occur. Printing of these ballots will be
similar to the corresponding Primary or November Election Ballots.
SPECIMEN BALLOTS
Specimen ballots (facsimile copies of the official ballot) shall be provided. Specimen ballots may be
printed on two sides. Specimen ballots shall not be printed with the facsimile signatures of the County
Board of Elections. Specimen ballots shall be printed on poster paper having a sixteen (16) pound basis
quality or better. The color shall be pink for the Republican primary and November election specimen
ballots and light blue for the Democratic primary ballots. The color for Special Elections Ballots or
Primary – Nonpartisan ballots will be selected by the County at the time of such occurrence. Specimen
ballots are not bound or numbered.
RESERVE BALLOTS
Reserve ballots are an extra bound book of fifty (50) ballots for each precinct for each ballot
type for each election.
TESTING BALLOTS
For each ballot type except Specimen Ballots, sixty (60) test ballots shall be pulled at the end of
the print but before numbering and binding. The test ballots shall be pulled from different
random parts of the batch. They shall not be bound nor numbered.
ESTIMATED QUANTITIES
Note that these are approximate quantities and no minimum or maximum is guaranteed.

PRIMARY – NONPARTISAN & SPECIAL ELECTION BALLOTS
None are anticipated at this time. However, if it were to happen the contracted printer shall be
responsible for providing them as required by this document. Estimated Quantities would depend on
the office and be up to approximately:
Primary – Nonpartisan Ballots 16,547
Special Election Ballots 104,117
RESERVE BALLOTS
One book of fifty (50) ballots for each ballot type and each precinct for each election are required.
TESTING BALLOTS
Sixty (60) testing ballots for each ballot type and each precinct for each election are required.
BLANK BALLOT STOCK
The County is also soliciting bids for blank CountRight ballot stock to be delivered as needed throughout
the term of the contract. This stock shall be CountRight ballot stock color white to be used to print 14-
inch absentee and mail-in ballots by the County. CountRight ballot stock shall be delivered in bundles of
250 pages and each bundle shall be shrink wrapped.
The County estimates purchasing approximately 20,000 pieces of blank CountRight ballot stock in 2026,
however, no minimum or maximum is guaranteed. If ordered, the County will purchase blank stock in
quantities of 250 pieces. Delivery of blank stock shall be within 5 business days of request by the County.
DELIVERY
Delivery shall be completed by an employee of the contacted bidder. Under no circumstances shall the
contracted bidder use any third party to deliver the printed ballots.
Deliveries shall be between 7:30 AM and 3:00 PM, Monday through Friday, excluding County Holidays.
Delivery shall be scheduled with the County Board of Elections representative. A list of the County
holidays can be found at https://www.franklincountypa.gov/departments/commissioners-office/. The

BID PRICING CALCULATIONS
Bid pricing shall be made based on precinct prices. There are 73 precincts. Bidders shall use the
following to compute precinct prices:
• Official DEM Ballots – 23,200 ballots divided by 73 precincts equals an average of 318 ballots per
precinct + 50 Reserve Ballots = 368 ballots per precinct.
• Official REP Ballots – 64,370 ballots divided by 73 precincts equals an average of 882 ballots per
precinct + 50 Reserve Ballots = 932 ballots per precinct.
• Official NONP Ballots – 16,547 ballots divided by 73 precincts equals an average of 227 ballots
per precinct + 50 Reserve Ballots = 277 ballots per precinct.
• Official NOV Ballots – 104,117 ballots divided by 73 precincts equals an average 1426 ballots per
precinct + 50 Reserve Ballots = 1476 ballots per precinct.
The price for each of the above ballot styles shall include cost of the ballot stock, make-ready and
printing of the average of a one-sided Official General Primary ballot and a one-sided Official November
Election ballot with perforation, numbering, binding with a backer sheet and packaging as specified in
this document.
• Specimen Ballots for Primary (DEM & REP) - 20 ballots for each (DEM & REP) for each precinct.
• Specimen Ballots for General Election – 20 ballots for each precinct.
The price for each Specimen ballot shall include cost of the paper stock, make-ready and printing of the
average one sided specimen ballot as specified in this document.
*In the event of a special election, the price of the corresponding primary or general election printing
shall be applied. For example, if a special election were to arise that was only for voters registered as
Republican, then the price to be applied shall be the same as the Primary – Republican Ballots. If the
special election would be open to all voters, then the price for the November Election ballots shall apply.
ATTACHMENT A
THIS AGREEMENT
MADE this __________ day of ________________, in the year two thousand and twenty-six (2026).
BETWEEN:
“CONTRACTOR”:
AND: The County of Franklin, a municipal corporation organized
and existing under the laws of the Commonwealth of PA, hereinafter called,
“COUNTY”
WITNESSETH, that Contractor and County, for the consideration named and
indicated herein, agree as follows:
ARTICLE 1. SCOPE OF WORK: County shall furnish the ballots in an electronic format which will be
used to print the ballots onto blank stock. The Contractor is instructed to contact Election Systems and
Software concerning proper layout techniques that might assist them in this process.
Contractor shall furnish all the materials and perform all the necessary work incident to printing,
binding and delivery to the County at the Franklin County Commissioners’ Office, 272 North Second Street,
Chambersburg, Pennsylvania, the ballots to be used at the General Primary in Franklin County,
Pennsylvania, to be held on Tuesday, May 19, 2026 as well as the General Election to be held on Tuesday,
November 3, 2026, using as copy materials to be furnished by County to Contractor. In addition, the
Contractor shall supply all ballots and material as specified in the Specifications attached thereto, and
made a part of this agreement.
ARTICLE 2. THE CONTRACT SUM: County shall pay to Contractor for
performance of the contract, in current funds, the sum of $____________ for 73 Official and Specimen
ballots per party printed and delivered for the May 19, 2026 General Primary. The County will also be
paying the sum of $___________ for ballots for the November 3, 2026 November Election. In addition,
the County will be purchasing blank 8 ½ x 14 Count Right ballot stock at a cost of $_________ per thousand
sheets. The contract sum shall be paid to Contractor upon completion and acceptance of the work.
ARTICLE 3. CONTRACT DOCUMENTS shall consist of the following:

ARTICLE 4. REPRESENTATIONS OF CONTRACTOR: Contractor represents and warrants:
a. That it is financially solvent and that it is experienced and competent to perform the types of
work and to furnish the plan, materials, supplies, or equipment to be so performed or furnished by it and,
b. That it is familiar with all Federal, State, Municipal, and Departmental
Regulations, law and ordinances, which in any way affect the work or persons employed
therein, including, but not limited to, any special acts relating to the work or the project of which it is a
part, and,
c. That it has carefully examined specimens of prior work of the same kind and that from its own
