TUESDAY, NOVEMBER 9, 2010
The Franklin County Commissioners met Tuesday, November 9, 2010, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the
Pledge of Allegiance proceeded with the business of the day.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to adopt the agenda and amend to include approval of minutes
from October 28, 2010.
Tony Ciarlante, President of SCPA Tea Party provided public comment and
asked the Board if they are setting up a special area for expansion of the courthouse?
Commissioner Keller responded that looking at two specific areas Jennings property and
here. Mr. Ciarlante rephrased the question and asked if they have set aside an office or
area for dedicating a room for that purpose in the AMS Building? Commissioner Keller
responded no.
The minutes of November 4, 2010 and October 28, 2010 meetings were read.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously
approved these minutes.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to amend the agenda to include approval of the vouchers.
The Board reviewed Aging matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved for the Chairman of the Board to
execute the Food & Beverage License to the PA Department of Agriculture/
Commonwealth of PA for the Waynesboro Senior Activity Center to serve beverages
and food at a cost of $82.00 for the period of November 16, 2010 through November 15,
2011.
The Board reviewed Commissioners’ Office matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved for the Chairman of
the Board to execute the Contract between the County of Franklin and Maximus, Inc. to
develop annual cost allocation plans for the years 2010, 2011 and 2012 that identify the
various costs incurred by the County to support and administer federal programs for a
total cost of $24,500.00.
The Board reviewed Community Services matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Human Services
Development Fund Assurance of Compliance to PA Department of Public Welfare for
fiscal year 2010-2011 for an allocation amount of $170,836.00.
The Board reviewed Drug & Alcohol matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Annual Report
to Department of Health, Bureau of Drug & Alcohol Programs for the Bureau of Drug &
Alcohol Program (BDAP) and Office of Mental Health and Substance Abuse Services
(OMHSAS) grants for fiscal years 2009/2010.
The Board reviewed Fiscal matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the 2010 Budget Adjustment in
the amount of $14,280.00 to amend budget for new award for Department of Justice
Bullet Proof Vest Grant for 21 vests for Adult Probation, Juvenile Probation, and Sheriff.

The Board reviewed Information Services matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Proposal from
SyncSort to provide backup software to backup all the county’s servers at a cost of
$5,895.00. This is a sole source provider.
The Board reviewed Jail matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the Agreement between the
County of Franklin and Love Health Service, LLC to support the Jail as a community
CPR and AED Training site at a cost of $1,985.70 for the period of November 1, 2010
through October 31, 2011.
The Board reviewed Jail matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the Proposal from
QuarterMaster to purchase officer uniforms – pants & shirts for new recruits and
replacement uniforms which is a contractual obligation at a cost of $5,450.75. This
company is on the State Contract listing.
The Board reviewed MH/MR matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved for the Chairman of the Board to
execute the 2012 Supportive Housing Program Renewal Grant Agreement between the
County of Franklin and Housing and Urban Development for the 2012 Homeless
Assistance Grant Program Project 2 to receive a grant in the amount of $94,588.00.
County match is $9,256.00 which is acquired from the Housing Trust Fund.
The Board reviewed Planning matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the Contract (#C000049971)
between the County of Franklin and Pennsylvania Department of Community and
Economic Development for the Community Development Block Grant (CDBG) for a
grant amount of $465,822.00 for the period of October 5, 2010 through October 4, 2015.
The Board reviewed Property Management matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Service
Agreement between the County of Franklin and NAC Divisions to provide service on the
fire alarm system at the Administrative Annex Building, Courthouse, Courthouse Annex,
Nursing Home and Building 426 for an annual cost of $7,320.00 for the period of
January 1, 2011 through December 31, 2012. Quotes were requested and two
responded out of three companies. This was the lowest responsible quote.
The Board Property Management matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved for the Chairman of
the Board to execute the Agreement between the County of Franklin and Susquehanna
Doors to provide preventative maintenance for the automatic doors at the Nursing Home
at a cost of $1,230.00 for the period of January 1, 2011 through December 31, 2011.
In accordance with PA Act 14 notification, Pennsylvania Department of
Conservation and Natural Resources notified the County of a Pennsylvania Department
of Environmental Protection Water Obstruction and Encroachment Permit for work being
done at Caledonia State Park.
In accordance with PA Act 14 notification, St. Thomas Development, Inc. notified
the County of a Pennsylvania Department of Environmental Protection GP13 General
Operating Permit for its asphalt plant in St. Thomas Township.

On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved all bills presented and ordered paid.
Commissioner Keller asked the Board to approve a special check run for the
Controller to process a check for the County purchase of the AMS building. On a motion
by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved this
special check run to include this check.
The Board met with the County Solicitor to review related matters. The Solicitor
recommended going into executive session on a matter of pending litigation on the
Weller vs. County Board of Assessment & Revision of Taxes and also Jerrold Sulcove
will be present to discuss the Chambersburg Area Development Corporation appeal
during executive session.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
to enter an executive session at 9:22 a.m. this date for the

purpose to review pending litigation matters. The Board reconvened into regular
session at 9:45 a.m.
Attorney Sulcove asked for approval to authorize him to sign the Chambersburg
Area Development Corporation settlement tax parcel number 06-1E00-024 regarding the
property on Sheffler Drive. On a motion by Robert G. Ziobrowski; seconded by Robert
L. Thomas; unanimously approved to authorize Mr. Sulcove to sign this settlement
agreement.
The Board reviewed information regarding Veteran’s Day 2010.

Franklin County Proclamation #2010-11 honoring all who have served and that the
attached proclamation be made a part of these minutes.
The Division Leaders/County Managers conducted their 2011 Budget Hearings.
The meeting was adjourned at 11:33 a.m. with a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas.
