THURSDAY, NOVEMBER 18, 2010
The Franklin County Commissioners met Thursday, November 18, 2010, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the
Pledge of Allegiance proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by David S. Keller; unanimously
approved to adopt the agenda.
On a motion by Robert L. Thomas, seconded by David S. Keller; unanimously
approved all bills presented and ordered paid.
Commissioner Ziobrowski entered the meeting room at 9:26 a.m.
Mary Beth Shank, County Solicitor asked the Board to approve a special warrant
to cut checks for purchase of properties at 31 North Second Street and 26-28 North
Main Street. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to authorize the Chairman to approve this special warrant.
James Wyrick provided public comment and read a prepared statement and said
that he sees a beacon of light emanating from Franklin County, Pa. Only time and the
future will prove the ramifications of this elected body of officials’ decision. Mr. Wyrick
said that sound leadership, dedicated departmental officials, and a motivated and
engaged workforce are not a natural immunity to current actions and has every
confidence that this county will emerge from the current fiscal uncertainties – intact-
cohesive- and strengthened by the prudent and insightful decisions on this and future
issues by this group of commissioners.
Ken Jones also provided public comment and referred to a Public Opinion article
about the yard sale ordinance being proposed in Washington Township. He is against
this that limits what people do on their own property unless it’s a safety issue.
Commissioner Thomas responded that the County has no jurisdiction over yard sale
ordinances.
Allen Piper provided public comment and is glad that the County does not get
involved with yard sales. He asked Mr. Ziobrowski who is chairman of the Council of
Governments if they have taken any position to this ordinance in Washington Township.
Commissioner Ziobrowski responded that met yesterday and that issue was not brought
up. Mr. Piper said that need to hold Elected Officials as our representatives accountable
and concurs with Dr. Wyrick’s remarks and credit is given to the Commissioners on
position taken in past couple days. His organization will be watching very closely what
takes place here on out and offers his support to sit on a committee as renovations
move forward.
Mr. Jones said that it was his understanding that the County is involved in
municipal ordinances. Commissioner Keller responded that he will check into it but is
not his understanding.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of November 9, 2010 meeting.

The Board reviewed Community Services matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Sub-recipient
Agreement between the County of Franklin and South Central Community Action
Programs, Inc. for the Emergency Shelter Grant Program to be used for the operations
of the Homeless Shelter for a grant amount of $73,190.00 for the years 2010 to 2012.
The Board reviewed Liquid Fuels matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Request Letter to The PA
Department of Transportation to include additional hours to the Reimbursement
Agreement #089483 for an additional amount of $25,650.23. The County is requesting
that a supplement be made to this agreement and that the revised Federal Share be
$518,717.22 and the revised local share be $129,679.31.
The Board reviewed Tax Claim matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Exonerations listing for
parcels exonerated for the 2010 County and Library taxes for Fannett Township.
The Board reviewed Property Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the Agreement between the County of Franklin and ThyssenKrupp
Elevator Service to provide monthly inspection and preventative maintenance for all
County owned elevators and related equipment at a total cost of $9,600.00 for the period
of January 1, 2011 through December 31, 2012. Three bidders were requested and this
was the lowest bid received.
The Board reviewed Visitors Bureau matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Contract between the
County of Franklin and Blue Hawk Productions for post production video phases of Road
Freedom: the Underground Railroad of South Mountain at a cost of $3,800.00 for the
period of November 11, 2010 through December 3, 2010 unless mutually extended in
writing by both parties. This will be paid for from the South Mountain Partnership Grant
through the Appalachian Trail Conservancy.
In accordance with PA Act 14 notification, Pennsylvania Department of
Transportation notified the County of Pennsylvania Department of Environmental
Protection Erosion & Sediment Pollution Control Plan and a joint U.S. Army Corps of
Engineers State Chapter 105 Water Obstruction and Encroachment permit being applied
for construction on Morristown Road to replace a bridge located in Southampton
Township.
In accordance with PA Act 67 & 68 notifications, Skelly & Loy notified the County
of a Pennsylvania Department of Environmental Protection General Permit 11
registration application being applied by Pennsylvania Department of Transportation for
a bridge replacement in Quincy Township.
In accordance with PA Act 67 & 68 notifications, Michael Baker, Jr., Inc. notified
the County of a Pennsylvania Department of Environmental Protection Natural Minor Air
Quality Operating Permit Application being applied by Texas Eastern Transmission, L.P.
for the Chambersburg Compressor Station located in the Borough of Chambersburg.
In accordance with PA Act 67, 68, & 127 notifications, Curfman & Zullinger
notified the County of a Pennsylvania Department of Environmental Protection General
NPDES Permit being applied by Capehat, LLC for site improvements consisting of
creating an equipment staging area on a parcel of land located along Sunset Pike in
Greene Township.

In accordance with PA Act 14 notification, Richard and Barbara McCracken
notified the County of a Pennsylvania Department of Environmental Protection Water
Obstruction and Encroachment permit being applied to install stream bank protection on
property located in Washington Township.
In accordance with PA Act 14 notification, New Enterprise Stone & Lime Co., Inc.
notified the County of a Pennsylvania Department of Environmental Protection State
Only Operating Permit being applied for the Dry Run Plant located in Fannett Township.
Teresa Beckner, Fiscal Director, and Erin Witmer, Assistant Fiscal Director, met
with the Board to review the 2011 proposed budget. Ms. Beckner advised those in
attendance that this budget calls for the general fund millage to remain the same as
2010. Budget total is 109 Million with no tax increase. Ms. Beckner advised those in
attendance that the allocation of a tax dollar for Franklin County’s 2011 Budget is as
follows: $0.76 Courts, Crime and Corrections; $0.04 Human Services; $0.02
Administration; $0.09 Others; $0.04 Financial Services; $0.01 Customer Services; and
$0.04 Public Safety.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously
approved the 2011 Preliminary Budget and to place the counter copy on the counter for
public view. This will also be available on the County’s website. This motion is to certify
that the foregoing schedules of the 2011 Franklin County proposed budget were
prepared according to law and presented to the County Commissioners on November
18, 2010; that said schedules were published or otherwise made available on November
18, 2010; and that all financial debt and other information set forth herein reflect as
nearly as possible the estimated revenues and expenditures for the year 2011. The
Board will adopt the final budget on December 9, 2010.
The meeting was adjourned at 10:12 a.m. with a motion by Robert L. Thomas;
seconded by Robert G. Ziobrowski.
FRANKLIN COUNTY COMMISSIONERS
