THURSDAY, JANUARY 13, 2011
The Franklin County Commissioners met Thursday, January 13, 2011, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the
Pledge of Allegiance proceeded with the business of the day.
The Board attended a Franklin County Prison Board meeting.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
Allen Piper, President of CRG provided public comment and asked if the Public
Records Access Policy that is dated 2002 hanging on the bulletin board in the
Commissioners Office is the most current policy. Also Mr. Piper asked to have a copy or
access to the Public Participation Policy where it relates to questions during meetings.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of January 3, 2011, January 4, 2011 and January 6,
2011 meetings.
The Board reviewed Aging Office matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Contract listing for Fiscal
Year 2010/011.
The Board reviewed Agriculture Extension matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Grant
Agreement between the County of Franklin and The Pennsylvania Department of
Environmental Protection for the West Nile Virus Control Program for a grant amount of
$79,708.16 for the period of January 1, 2011 through December 31, 2011.
The Board reviewed Children & Youth matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Contract listing
for Fiscal Year 2010/2011.
The Board reviewed additional Children & Youth matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Revised
Contract listing for Fiscal Year 2009/2010.
The Board reviewed Commissioners’ Office matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement
between the County of Franklin and maid2clean4u to provide cleaning services at the
Courtside Professional Building at a cost of $500.00 per month for the period of
November 10, 2010 through December 31, 2010.
The Board reviewed Grants Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the Subgrant Award Notice (#2009-JG-04-18962-3) from
Pennsylvania Commission on Crime and Delinquency for the CJAB Jail Diversion
Project for a grant amount of $46,885.00 for the period of January 1, 2011 through
December 31, 2011.

The Board reviewed additional Grants Management matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute the Subgrant Award Notice (#2009-JG-04-21776)
from Pennsylvania Commission on Crime and Delinquency for the Franklin County
CJAB Initiatives Grant for a grant amount of $150,000.00 for the period of January 1,
2011 through December 31, 2011.
The Board reviewed Department of Emergency Services matters. On a motion
by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute the Emergency Operations Plan Annex E for
radiological emergency support procedures for incidents at the Three Mile Island nuclear
power plant.
The Board reviewed additional Department of Emergency Services matters. On
a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously
approved for the Chairman of the Board to execute the Certification to PA Emergency
Management Agency for authorized use of 9-1-1 funds under the Public Safety
Emergency Telephone Act. The County has not and will not divert any portion of the
designated 9-1-1 contribution rate, surcharges and fees (including interest earned) for
any purpose other than designated by 9-1-1 requirements.
The Board reviewed FSNRC matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the 2011 Budget Transfer for
FSNRC capital improvements to capital projects funds – Series A, Recovery Zone
Economic Development Bond Note obtained in 2010 – 2011. Expense offset by Fund
40 fund balance.
The Board reviewed additional FSNRC matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Proposal from
Universal Door and Specialties to replace doors & hardware in the E-wing hopper room
at a cost of $1,270.66.
The Board reviewed Mental Health/Mental Retardation Department matters. On
a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously
approved the Contract listing for Fiscal Year 2010-2011.
The Board reviewed Tax Services matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Quote from
Chambersburg School District to print Tax Bills at a cost of $5,172.05. Quotes were
requested and three companies responded. This is the lowest qualified quote.
The Board reviewed Visitors Bureau matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Agreement between the
County of Franklin and Pennsylvania Humanities Council for a grant to facilitate and
promote three Live & Learn weekends for a grant amount of $12,000.00 for the period of
January 13, 2011 through December 31, 2011.
The Board reviewed additional Visitors Bureau matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement
between the County of Franklin and 2011 PA Travel Guide and Pennsylvania Pursuits
Magazine/Miles Media Group, LLP for printing of the Winter Issue of Pursuits magazine
at a cost of $6,625.00 for the period of January 1, 2011 through December 31, 2011.

The Board reviewed additional Visitors Bureau matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement
between the County of Franklin and Hagerstown Broadcasting/WJEJ for the Visitors
Bureau to sponsor news on Tuesdays, Thursdays, and Saturdays at a cost of $1,560.00
for the period of January 1, 2011 through June 30, 2011.
The Board reviewed additional Visitors Bureau matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement
between the County of Franklin and Hagerstown Broadcasting/WJEJ for the Visitors
Bureau to sponsor a custom outdoor and recreation show called Outdoors in Franklin
County at a cost of $1,200.00 for the period of January 13, 2011 through December 31,
2011.
The Board reviewed additional Visitors Bureau matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Professional
Services Agreement between the County of Franklin and Celebrate Gettysburg, Inc. to
provide a 2/3 page ad in the January/February, March/April, and September/October
issues of Celebrate Gettysburg magazine at a cost of $2,655.00 for the period of
January 13, 2011 through December 31, 2011.
In accordance with PA Act 14 notification, Triad Engineering, Inc. notified the
County of a Pennsylvania Department of Environmental Protection Renewal Application
being applied by Valley Creek Estates Wastewater Treatment Facility on property
located in Montgomery Township.
In accordance with PA Act 14, 67, 68 and 127 notifications, H.F. Lenz Company
notified the County of a Pennsylvania Department of Environmental Protection Permit
Application being applied by Letterkenny Army Depot – MILVAN Container Storage Area
located in Letterkenny Township.
In accordance with PA Act 14, 67, 68 and 127 notifications, R. Lee Royer and
Associates notified the County of a Pennsylvania Department of Environmental
Protection NPDES Application being applied by James and Heidi Zaiger for a residential
subdivision located in Quincy Township.
The Board met with the County Solicitor to review related matters.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
to enter an executive session at 9:38 a.m. this date for the
unanimously approved
purpose to review Tax Assessment Appeal of Chambersburg Business Park matters.
The Board reconvened into regular session at 9:47 a.m.
Mary Beth Shank, Solicitor asked approval to settle Assessment Appeal with
Chambersburg Business Park Docket #2009-5794. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved to authorize Mary Beth
Shank to enter into an agreement with Chambersburg Business Park, Chambersburg
School District and Borough of Chambersburg. The County will refund Chambersburg
Business Park in the amount of $4,190.00.
