THURSDAY, JULY 21, 2011
The Franklin County Commissioners met Thursday, July 21, 2011, with the
following members present: Robert L. Thomas and Robert G. Ziobrowski. Vice
Chairman Thomas presided and after calling the meeting to order, and the Pledge of
Allegiance proceeded with the business of the day.
On a motion by Robert G. Ziobrowski, seconded by Robert L. Thomas;
unanimously approved to adopt the agenda.
There was no public comment.
On a motion by Robert G. Ziobrowski, seconded by Robert L. Thomas;
unanimously approved all bills presented and ordered paid.
On a motion by Robert G. Ziobrowski, seconded by Robert L. Thomas;
unanimously approved the minutes of July 12, 2011 and July 14, 2011 meetings.
The Board reviewed Aging Office matters. On a motion by Robert G. Ziobrowski,
seconded by Robert L. Thomas; unanimously approved for the Vice Chairman of the
Board to execute the Service Agreement between the County of Franklin and NAC
Alarm Communication Telephone to check the fire alarm system at the Greencastle
Senior Center, including a semi-annual inspection and an annual preventative
maintenance for the period of July 1, 2011 through December 31, 2011. The amount of
the contract is $300.00 and is covered by grant funds.
The Board reviewed Children & Youth matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Subsidized
Adoption Assistance Agreement on behalf of the Franklin County Children and Youth
Department to provide a subsidy to adoptive parents to be used for adoptive children
with special needs for payment in the amount of $16.50/day for the period of June 30,
2011 through June 29, 2016, in addition a one-time payment not to exceed $ -0- to cover
non-recurring adoption expenses. The different needs of the child determine the cost
per month. The County is reimbursed through the Federal Financial Participation
program.
The Board reviewed additional Children & Youth matters. On a motion by Robert
G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Subsidized

with special needs for payment in the amount of $29.00/day for the period of July 23,
2011 through July 22, 2016, in addition a one-time payment not to exceed $231.00 to
cover non-recurring adoption expenses. The different needs of the child determine the
cost per month. The County is reimbursed through the Federal Financial Participation
program.
The Board reviewed additional Children & Youth matters. On a motion by Robert
G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Subsidized

The Board reviewed Drug & Alcohol matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved for the Vice
Chairman of the Board to execute the Subgrant Award Notice (2011-DA-ST-22491) from
Pennsylvania Commission on Crime and Delinquency for Franklin County Drug and
Alcohol Restrictive Intermediate Punishment (RIP) for a grant award of $213,490.00 for
2011. The Commissioners signed and approved the application on May 5, 2011.
The Board reviewed Election matters. On a motion by Robert G. Ziobrowski,
seconded by Robert L. Thomas; unanimously approved the Certification of County
Maintenance of Effort for the HAVA II Financial Assistance for the reporting period of
January 1, 2011 through June 30, 2011. To qualify for HAVA grant funds, we must
certify twice a year, maintaining an expenditure level not less than the level maintained
by the County for the 2000 fiscal year. For the first six months of 2011, we have
expended $189,935.75 while we spent $218,984.00 for the entire 2000 fiscal year. The
state is willing to help fund various new purchases required under the Help America Vote
Act, but they believe the County also has a responsibility to fund elections.
The Board reviewed Fiscal matters. On a motion by Robert G. Ziobrowski,
seconded by Robert L. Thomas; unanimously approved the Renewal Contract between
the County of Franklin and Zelenkofske Axelrod LLC to extend the annual audit of the
Visitors Bureau for three years, at a total of $4,000 per year, covering 2011, 2012, and
2013. This annual audit is required and conducted efficiently by a firm familiar with the
process and the County.
The Board reviewed additional Fiscal matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Budget transfer
for 2009 JAG Grant in the amount of $36,895.00. This grant is shared with
Chambersburg Borough and Waynesboro Borough and is 100% reimbursed with no
county funds. There is a negative cash flow because we received more than spent in
2009.
The Board reviewed Human Services Administration matters. On a motion by
Robert G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved the
Contract between the County of Franklin and Contact Helpline to provide after-hours
phone coverage for the County’s Information and Referral phone line as the County
office is open just 8:30 AM till 4:30 PM, Monday through Friday. All Franklin County
residents and anyone calling ‘211’ in the Franklin County region benefit from this service.
The cost is $2,500.00, covered by Human Services Development Fund, and is for the
period of July 1, 2011 through June 30, 2012.
The Board reviewed Property Management matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Proposal
between the County of Franklin and Trane to furnish two replacement Singer air
conditioning units in the Courthouse Annex. Old units need replaced due to age,
insufficient cooling of areas, and inefficient energy cost. The cost of the contract is
$2,910.00 per unit.
The Board reviewed Prothonotary matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Contract
between the County of Franklin and Barbara B. Townsend, Esquire, to provide
contracted attorney services for advice on legal matters pertaining to the Prothonotary
Office at a cost of $888.00 for the remainder of the year, payable in equal amounts
during the third and fourth quarter of the year for the period of June 24, 2011 through
December 31, 2011.

The Board reviewed Risk Management matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Contract
between the County of Franklin and Lavery, Faherty, Young and Patterson, P.C. to
provide special counsel to handle Ronald D. Weaver versus Douglas W. Herman, et al
pending in the United States District Court for the Middle District of Pennsylvania.
Ronald D. Weaver has filed suit against Franklin County and because the damages
requested are not monetary in nature, the County’s liability insurance does not respond.
Counsel is providing the services at their agreed upon rate with PCoRP in the amount of
$145.00 per hour for attorney fees and $75.00 per hour for paralegal fees.
The Board reviewed Sheriff matters. On a motion by Robert G. Ziobrowski,
seconded by Robert L. Thomas; unanimously approved the Agreement between the
County of Franklin and Com Pros to purchase three portable radios for the deputies
hired in January 2011 due to the new Juvenile ruling passed and added duties obtained
by the Sheriff’s Office. The radios are necessary equipment for the deputies to perform
their duties. The cost is for a total of $10,552.70 and are being purchased from state
contract.
The Board reviewed Visitors Bureau matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved the Contract
between the County of Franklin and WJAL Family TV to provide website promotion as
well as promotion of events in Franklin County, targeting the family market within a two
to three hour drive of Franklin County. This advertising accesses key markets and
supports the mission of the Visitors Bureau. The room tax revenues support the cost of
$2,750.00 for the period of six months ending December 31, 2011.
In accordance with PA Acts 14 notifications, Gannett Fleming, Inc. notified the
County of a Pennsylvania Department of Environmental Protection application for a
PADEP Water Quality Management Part II permit for construction of chemical addition
facilities needed to comply with Greencastle Borough’s current NPDES permit for the
wastewater treatment plant upgrade.
In accordance with PA Acts 14, 67, and 68 notifications, Edge Rubber notified
the County of a Pennsylvania Department of Environmental Protection application for
renewal of a NPDES Industrial Wastewater Discharge Permit.
Teresa Beckner, Fiscal Director met with the Board to discuss the following
items: Review of 2011 expense and revenue budget performance through May. She
said the expense side is 41% which is 5/12 of the year. Ms. Beckner said that general
fund expenses are under budget and as a whole has collected 71.7% of budgeted
revenues through May. She said Fiscal has started budget planning for 2012 and has
begun preparing the preliminary schedule and updating the budget packets to be sent to
the departments.

seconded by Robert L. Thomas.
