The Franklin County Commissioners met Tuesday, June 16, 2015, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to adopt the agenda.
There was no public comment.
The minutes of the June 9, 2015 and June 11, 2015 meetings were reviewed.
These will be approved Thursday, June 16, 2015.
The Board reviewed Agreements, Contracts and Reports. Chairman Keller said
Ms. Wertz, who is present today, requested more information on the Title IV®
agreement. Teresa Anthony, Domestic Relations Section (DRS) Director, and Mark
Singer, Court Administrator, were present to explain the agreement. Mr. Singer said this
is a cooperative agreement that needs approved every five years by the Commissioners
and the President Judge and it is the same agreement across the State. Ms. Anthony
explained further that there are no major changes other than for retention of court orders
due to the State moving to a new State Laserfiche system. John Hart, County
Administrator, explained further the IV®D program is to secure financial and medical
support for minor children and explained how DRS has to locate parents, establish
paternity, require parents to pay support, establish enforcement and support orders and
help to supply staff in DRS. Ms. Anthony said DRS has performance measures they
must meet to get the incentive funding that is handed down from the Federal
Government to the State Government. Mary Beth Shank, County Solicitor, and Bill
Bechtold, Warden, were present to provide more information on the Immigration and
Customs Enforcement (ICE) Detainer policy. Ms. Shank explained the ICE detainer is a
notice that Homeland Security issues to inform the Jail that ICE intends to detain an
individual in custody at the Jail. Due to a court case in Lehigh County where an
individual sued the county and state for false accusations, the Third Circuit Court has
determined that ICE detainers are not legal and cannot be used as a defense. This new
policy describes how the Franklin County Jail will process ICE detainers and how the Jail
will communicate with ICE. Ms. Shank said the Jail will abide by court orders if one is
ordered to detain an individual. Mr. Bechtold said the Jail will provide ICE a daily report
of inmates and will also notify ICE before an individual is released. The items will be
approved Thursday, June 16, 2015.
The meeting was adjourned at 9:59 a.m. with a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas.
