The Franklin County Commissioners met Thursday, April 14, 2016, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. The Board Chairman Keller presided and after calling the meeting to order,
a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the
day.
John Hart, County Administrator, requested to amend the agenda to include a
form from PEMA that must be approved in order to receive reimbursement for Winter
Storm Jonas. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the amended agenda.
There was no public comment.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the April 5, 2016 and April 7, 2016 meetings.
President Judge Carol Van Horn and Mark Singer, Court Administrator, were
present to discuss facilities. President Judge Van Horn said they are here today to
renew the conversation concerning court facilities. She mentioned the two studies
completed that had the same conclusion on the need for additional space and in 2008
the National Standards for Court Operations recommended the need for an additional
40,000 square feet in space. Since that time, the County added an additional courtroom
on the second floor of the courthouse and the Juvenile Hearing Annex was added but
with these projects, it only added 4,000 square feet. She said all identified needs remain
for the effective administration of justice. As President Judge and on behalf of her
colleagues and all who work for the judicial branch of the government, the goal is to
ensure a safe and secure access for the administration of justice. She said they need
additional space for all operations and the citizens of this community, not only for
criminal matters but family matters as well. She is asking that this discussion be
renewed. Commissioner Thomas said since it's been some years since the studies
have been completed, the one that sticks with him is the flow of traffic and conflicts at
times, and he presumes nothing they have done has changed that. President Judge
Van Horn responded that they tried to adjust those challenges whether by adjusting
personnel, moving hearing rooms, moving victims to the Commissioners Complex but
thankfully nothing has happened to date since they are still allowing people to be in the
wrong areas at the wrong times. They have tried to operate within these challenges but
they are at the end of their rope and they need to discuss solutions. She said
efficiencies would develop if they could get everyone needed for Court operations under
the same roof. Commissioner Ziobrowski said in 2008 was when they began this
process, and in 2010 there was no doubt in his mind that space was needed and there
was data to support that. But then with the bad economy and 10% unemployment rate,
it was not the time to add a construction project so they did what they could by putting a
bandaid on it. The question to him is not whether we need additional space but how
much space we need so he looks forward to learning more about what we need to
provide safe and effective justice to our people. Chairman Keller thanked President
Judge Van Horn and Mr. Singer for coming to the Board with their concerns. He said
this is not coming out of the blue since he has been in various venues where these
concerns have been brought up and even her predecessor had spoken of these

concerns. The Board takes her concerns seriously so they need to stay focused on
them and to that point to provide adequate facilities is one of the commissioners' core
responsibilities. He recommends looking to staff and/or other experts to provide
guidance and referring this matter to Mr. Hart with the idea that Mr. Hart will recommend
a response to the President Judge's request in the near future, meaning within a matter
of days. President Judge Van Horn responded that the Courts updated their data from
the 2008 report to 2014 data. She welcomes county administration to work with Mr.
Singer on this newer data. Commissioner Thomas asked that Mr. Hart also look at what
possible efficiencies could be gained by addressing Judge Van Horn's concerns.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the Designation of Agent Resolution to authorize John A. Hart,
County Administrator, to be the authorized person to execute on behalf of the County for
all required forms and documents for the purpose of obtaining financial assistance under
the Robert T. Stafford Disaster Relief and Emergency Assistance Act for Winter Storm
Jonas.
The Board reviewed Aging Office matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Food and Beverage License to the Pennsylvania Department of
Agriculture for the Ft. Loudon, Greencastle and Upper Strasburg Senior Centers at a
cost of$82.00 each. It is a state regulation to have a food and beverage license
renewed annually. There is no increase from last year and it is funded by the
Pennsylvania Department of Aging Block Grant.
The Board reviewed Children and Youth matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the List of
Subsidized Adoption Assistance agreements on behalf of the Franklin County Children
and Youth Department to provide a subsidy to adoptive parents to be used for adoptive
children, for the period of January 1, 2016 through March 31, 2016. Contract listing is
maintained for proper accounting of all contracts.
The Board reviewed Commissioners/Elections matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman
of the Board to execute the agreement between the County of Franklin and Zody's
Moving & Storage, Inc. for the delivery and pickup of election equipment and supplies in
the amount of$136.50 per hour for two men and a truck, $136.50 for one hour of travel
time to the actual start/stop time per unit per day and $54.80 for fuel surcharge, for the
years 2016, 2017 and 2018. Bid was awarded by the Board of Commissioners on
March 29, 2016.
The Board reviewed Grants/Veterans Affairs matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the grant
agreement between the County of Franklin and Pennsylvania Department of Military and
Veterans Affairs to provide outreach services to Veterans with Operation Save-A-Vet,
Save-A -Pet, in the amount of$15,500.00, for the period of June 1, 2016 through
December 31, 2017.

The Board reviewed Risk Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement and
Business Associate Agreement between the County of Franklin and Occupational
Medicine of York to provide voluntary hearing screenings for employees at the Franklin
County Jail, for approximately 112 screenings at a cost of$1,475.00. This will be paid
through the Workers' Compensation Trust. The Business Associate agreement is
required due to the medical nature of the screenings.
The Board reviewed Tuscarora Managed Care matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Staffing
Agreement between the County of Franklin and Tuscarora Managed Care Alliance
(TMCA) for the period of January 1, 2016 through December 31, 2016, to pay for
personnel with payroll and benefits, at a cost not to exceed $416,528.00. Funds will be
reimbursed to the County by TMCA.
In accordance with PA Acts 14, 67, 68 and 127 notifications, GHD notified the
County of a Pennsylvania Department of Environmental Protection NPDES Renewal
Permit application being applied for by the Washington Township Municipal Authority for
discharge of effluent from its wastewater treatment facility, located in Washington
Township.
In accordance with PA Acts 14, 67, 68 and 127 notifications, Rettew notified the
County of a Pennsylvania Department of Environmental Protection Floodplain Permit
application being applied for by Shippensburg Borough Authority for improvements to an
existing well source facility including: a building addition with booster pumps, fluoride
equipment and a hypochlorite generation system, located in Southampton Township.
The Board reviewed information regarding National Crime Victims' Rights Week.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously
approved to sign Franklin County Proclamation #2016-06 proclaiming the week of April
10-16, 2016 as National Crime Victims' Rights Week and that the attached proclamation
be made a part of these minutes.
The Board held a discussion on the LERTA request for Wharf Road in
Washington Township. Chairman Keller said that a presentation was made on March
31, 2016 requesting Franklin County's participation in a LERTA abatement for lot#5 in
Washington Township industrial park on Wharf Rd. The Board took this request under
advisement. He continued that the parcel is not a textbook example of blight but that he
thinks this is a good fit for LERTA when the points were made on the topographical
challenges of the lot, the history of the lot and the missed opportunities that have come
and gone due to the nature of the parcel. He said the prospective employer is also a
relevant factor in his evaluation of this request, and thinks Hadley Farms is a good
prospect and seems to be the right kind of business for Franklin County with family
sustaining jobs. His preference is that they recommend to the county solicitor to
coordinate with the Waynesboro Area School District to develop a resolution in support
of this request. Commissioner Ziobrowski said he is supportive of this request.
Commissioner Thomas said that he concurs with Chairman Keller's comments, he is fine
with this approach and he is willing to proceed to authorize a LERTA zone for lot 5 in
Washington Township. Mike Ross, President of Franklin County Area Development
Corporation (FCADC), said Hadley Farms continues to work on the land development
plans and with the contractor on the building plans. He thanked the Board on behalf of
FCADC and Waynesboro Industrial Development Corporation for moving forward with
approval of the LERTA.

Commissioner Thomas asked the Board to include a presentation on the agenda
in the near future from Penn State Extension on the Zika Virus to bring awareness on
how this virus is spread. Chairman Keller referred the matter to Mr. Hart to have staff
set a date for the presentation.
The meeting was adjourned at 10:11 a.m. with a motion by Robert L. Thomas;
seconded by Robert G. Ziobrowski.

National Crime Victims' Rights Week,April 10-16,2016
Whereas,Americans are the victims of more than 20 million crimes each year,*and crime can touch the lives of
anyone regardless of age,national origin,race,creed,religion,gender,sexual orientation,
immigration,or economic status;
Whereas,Many victims face challenges in finding appropriate services,including victims with disabilities,
young victims of color,Deaf and hard of hearing victims,LGBTQ victims,tribal victims,elder
victims,victims with mental illness,immigrant victims,teen victims,victims with limited English
proficiency,and others;
Whereas,Too many communities feel disconnected from the justice and social response systems,and have lost
trust in the ability of those systems to recognize them and respond to their needs;
Whereas,Victims of repeat victimization who fail to receive supportive services are at greater risk for long-term
consequences of crime;
Whereas,The victim services community has worked for decades to create an environment for victims that is
safe,supportive,and effective;
Whereas,Intervening early with services that support and empower victims provides a pathway to recovery
from crime and abuse;
Whereas,Honoring the rights of victims,including the right to be heard and to be treated with fairness,dignity,
and respect,and working to meet their needs rebuilds their trust in the criminal justice and social
service systems;
Whereas, Serving victims and rebuilding their trust restores hope to victims and survivors,as well as their
communities;
Whereas,National Crime Victims'Rights Week,April 10-16,2016,is an opportune time to commit to ensuring
that all victims of crime—even those who are challenging to reach or serve—are offered culturally
and linguistically accessible and appropriate services in the aftermath of crime;and
Whereas,Women in Need is hereby dedicated to serving victims,building trust,and restoring hope for justice
and healing;
Now,therefore,We,the Board of Commissioners of Franklin County,do hereby proclaim the week of April 10-
16,2016,as Crime Victims'Rights Week
And reaffirm this county's commitment to creating a victim service and criminal justice response
that assists all victims of crime during Crime Victims' Rights Week and throughout the year;and to
Express our sincere gratitude and appreciation for those community members,victim service providers,and
criminal justice professionals who are committed to improving our response to all victims of crime so that they
may find relevant assistance,support,justice,and peace.
