The Franklin County Commissioners met Tuesday, November 15, 2016, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to adopt the agenda.
There was no public comment.
The minutes of the November 10, 2016 meetings were reviewed. These will be
approved on Thursday, November 17, 2016.
The Board reviewed Agreements, Contracts and Reports. Chairman Keller
asked Mr. Hart to explain further board action item #4, proposal from Noelker and Hull
Associates. John Hart, County Administrator, explained that staff has been working with
Noelker and Hull in order to provide information to the Board to consider whether to
move forward with a judicial facility and colocation of court operations. He said staff is
of the opinion that there is justification to continue gathering information for the board to
consider related to the needs of the courts and safety concerns.. Mr. Hart explained
that Noelker and Hull have interviewed and gathered information from a number of
offices, including the completion of office profiles. He is asking the Board to enter into a
contract with Noelker and Hull who will develop a an architectural program. This
information will be presented to the Board in a public meeting for them to consider,
deliberate and then decide whether the Board will proceed with this project. The
following items were approved today while the remaining items will be approved
Thursday, November 17, 2016.
The Board reviewed Children & Youth matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the quote from Dell
to replace 22 monitors and 6 desktops at a cost of$9,599.94. Replacements are per
County and State life cycle policy.
The Board reviewed additional Children &Youth matters. On a motion by Robert
G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the report to
Pennsylvania Department of Human Services showing expenses and revenues of Act
148 funding for July 1, 2016 through September 30, 2016 in the amount of
$2,610,704.00.
The Board reviewed additional Children &Youth matters. On a motion by Robert
G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the quote from
Southern Computer Warehouse to purchase 16 Surface Pros to be used for caseworker
mobility at a cost of$20,417.00.
Phil Tarquino, Planning Director, was present to provide the Franklin County
Tourism and Quality of Life Enhancement Grant Committee recommendations. Mr.
Tarquino explained the committee received applications for this funding round and the
committee has reviewed them. He said the committee consists of John Hart, Carrie
Gray, Teresa Beckner, Patti Nitterhouse and himself. The following is the committee's
recommendations: Borough of Waynesboro to be used towards paving and finishing the
East 4th Street to Renfrew Park walking path receiving an amount of$41,300.00;
Conocheague Institute to be used towards walking paths and a bridge at the institute
receiving an amount of$72,700.00; Franklin County Veterans'/911 Memorial to be used
towards two short walking path connectors between the flag court and the interpretive

trail in the nearby woods receiving an amount of$6,000.00; Coyle Free Library to be
used towards fagade improvements receiving an amount of$83,500.00; Peters
Township/Fort Loudon to be used towards the rehabilitation of the fort receiving an
amount of$83,500.00; and Totem Pole Playhouse to be used towards lighting
improvements at the playhouse receiving an amount of$33,000.00. Mr. Tarquino
explained there was a total of$320,000.00 from Hotel Tax and Marcellus Shale funds.
He said the Borough of Waynesboro, Conocheague Institute and the Veterans/911
memorial funds will be provided from Marcellus Shale and the remainder projects will be
funded from the Hotel Tax fund. Chairman Keller said he is aware of all the projects and
he is supportive of them. The Board will provide final approval at Thursday's Board
meeting.
Mary Beth Shank, County Solicitor, met with the Board to seek approval to enter
into a professional services agreement with Eckert Seamans to assist the County with
Health Insurance Portability and Accountability Act (HIPAA) audit, training and
compliance needs. Ms. Shank informed the Board that HIPAA is a complex law and it's
always evolving. She explained further that HIPAA extends into county operations at the
Jail, Human Services, Human Resources, Solicitors office and many other departments
and areas throughout the county. She said this agreement is to engage Eckert
Seamans who will interview all departments to get a better view of our operations and
reviewing policies and procedures. They will also conduct staff training, review privacy
notices and make sure that as the complex law changes, that we change as well. Ms.
Shank explained the scope of the agreement is 50-55 hours with onsite audit and
drafting of proper procedures at an estimated cost of$15,000 to $16,500; staff training
will take 15-20 hours with an estimated cost of$6,000; and follow up advice will be an
hourly rate, which they discounted by 40% at $300 per hour and paralegals at$140 to
$205 range. Chairman Keller responded that Ms. Shank touched on all of his concerns
and this is a reputable firm so they are experienced and at the top of the field, so he is
comfortable with her recommendation. Commissioner Thomas said the sad part is the
average person doesn't even know what HIPAA is but in our business the penalties are
severe if we violate them. On a motion by Robert G. Ziobrowski; seconded by Robert L.
Thomas; unanimously approved the Letter of Agreement between the County of Franklin
and Eckert Seamans to assist the County with its HIPAA compliance needs.
The meeting was adjourned at 10:23 a.m. with a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas.
