HomeMy WebLinkAbout2018-06-12 Commissioner Minutes TUESDAY, JUNE 12, 2018 The Franklin County Commissioners met Tuesday, June 12, 2018, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. The Board attended the Prison Board meeting. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved to adopt the agenda. There was no public comment. The minutes of the June 5, 2018 and June 7, 2018 meetings were reviewed. These will be decided upon on Thursday, June 14, 2018. The Board reviewed Agreements, Contracts and Reports. The items will be approved Thursday, June 14, 2018. Carrie Gray, County Administrator and Glenn Watson from Dennis E. Black Engineering, Inc. provided a presentation on the Court Complex Lot Consolidation. Ms. Gray explained this request includes the acquisition of public right-of-ways including land owned by the Borough of Chambersburg. Ms. Gray is seeking approval for staff to move forward with requesting consolidation of the parcels the county owns as this is a best land practice. Glenn Watson explained that the map shows the nine properties the borough owns that includes public alleys and a sidewalk. He explained that a piece of the historic part of Montgomery Avenue was to be county property as a public walkway but the transaction was never completed. Commissioner Thomas explained that this is just cleaning up some things that should have been completed before. Mr. Watson said he has had positive preliminary discussions with the Borough. He said the ultimate goal is to submit a lot consolidation plan to the Borough including a portion of public right-of- ways that the Borough controls. Commissioner Thomas said that the County currently maintains these areas that are owned by the Borough. Mr. Watson explained that there are 15 different deeds to the county dated 1784 through 2014 which was when the last property was purchased by the county. Commissioner Ziobrowski asked if we reach an agreement with the Borough to acquire the alleys, if the adjacent property owners would need access so the alleys could not be closed off. Mr. Watson said agreements would need to be reached with the property owners but he believes a couple of the alleys could be closed off. He believes this plan would streamline the process to get the permits needed for the construction. Commissioner Ziobrowski said that he supports moving forward with this request but he would like the opportunity to make comments in the process on technical items. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved for staff to move ahead with the court complex lot consolidation, including acquisition of public right-of-ways and transfer of property owned by the Chambersburg Borough. On a motion by Robert G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved to enter an executive session at 10:06 a.m. this date for the purpose to settle the Appeal of Aldine D. Martin, Margaret E. Martin, Michael L. Martin, and Ladean A. Martin, Docket No. 2015-4493 and settlement of the Appeal of David and Leslie A. Matiko Docket No. 2017-4200. Action will be requested after the Executive Session. The Board reconvened into regular session at 10:34 a.m. Continued on page 2 Mary Beth Shank, County Solicitor, asked approval to settle the residential tax assessment appeal of David and Leslie A. Matiko Docket No. 2017-4200. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; the Board unanimously approved to authorize Mary Beth Shank to enter into an agreement with David and Leslie A. Matiko. This is a 2017 residential appeal for the 2018 tax year and consists of one parcel in St. Thomas Township with an address of 1140 Edwards Drive. The original assessment of $54,360 equates to a fair market value of $415,000. The Solicitor proposed a settlement of $295,000 (FMV) for 2018 based upon the discovery conducted in this case. This motion also includes approval to settle the commercial tax assessment appeal with Aldine D. Martin, Margaret E. Martin, Michael L. Martin, and Ladean A. Martin, Docket No. 2015-4493. This is a 2015 commercial appeal for the 2016 tax year and consists of four parcels in the Borough of Greencastle, including Sunnyway Foods, Rite Aid and a residential property. The assessed value at the time of the appeal is $501,150.00 which equates to a fair market value of $3,768,000.00 when the common level ratio is applied. The Solicitor proposed a settlement of $3,000,000 (FMV) in years 2016-2018 based upon the discovery conducted in this case. The meeting was adjourned at 10:22 a.m. with a motion by Robert G.
