WEDNESDAY, JUNE 24, 2020
The Franklin County Commissioners met Wednesday, June 24, 2020, with the
following members present: David S. Keller, John T. Flannery and Robert G.
Ziobrowski. Commissioner Flannery participated in the meeting remotely. Chairman
Keller presided and after calling the meeting to order, a Moment of Silence, and the
Pledge of Allegiance, proceeded with the business of the day.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment.
The minutes of the June17, 2020 meeting were reviewed. These will be decided
upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. The items will be
approved in the afternoon approval session.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter an executive session at 11:07 a.m. this date to review
contract negotiation matters. The Board reconvened into regular session at 11:15 a.m.
No action was required after the executive session.
The Board recessed and will reconvene at 1:00 p.m. for final approval of the
items that were reviewed.

There was no public comment.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the June 17, 2020 meeting.
The Board reviewed Archives matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the quote from Image
Access, Inc. to purchase the Bookeye 4 V1A overhead scanner to safely and efficiently
digitize hundreds of oversized and delicate books that contain permanent records of
legal, administrative and historical value. Creating digital copies of these books will
improve access by county personnel and the general public, while protecting them from
further damage. This purchase directly supports the goals of the Franklin County
Comprehensive Records Management Plan. This purchase of $41,012.00 will be paid
with Records Improvement Funds that have been approved by the Records
Improvement Committee.

The Board reviewed Commissioners Office matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute Change Order #010 for the Admin Building project from Lobar, Inc.
for changes to countertop support in Voter Registration for a deduct of $125.31; delete
four automatic door operators for a deduct of $12,670.00 and provide a retaining wall at
Commissioners parking lot for an additional cost of $12,458.39. The total for this change
order will be a reduction of $336.92.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute Change Order #4 for the Admin Building Project from
Mann Plumbing and Heating, LLC for a credit to be applied to previously issued change
grade for a decreased amount of $150.01.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute Resolution #2020-09 authorizing the County
Administrator to execute and take approval action as it relates to any and all invoices for
CDBG and HOME programs.
The Board reviewed Grants Management matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the grant
agreement between the County of Franklin and Department of Community and
Economic Development (DCED) in the amount of $14,000,311.00 for the COVID-19
Community Relief Block Grant and Resolution 2020-10 for the authorization of the grant
application. Funds will be used to support COVID-19 related activities. Grant period is
March 1, 2020 through December 30, 2020.
The Board reviewed Veterans Affairs matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the agreement between the
County of Franklin and Nolan-Carlson Canine, LLC DBA Good Dog Boarding and
Training for dog training services for Operation Save-A-Vet, Save-A-Pet service dog
program in the amount of $17,015.00, for the period of June 1, 2020 through December
31, 2020. Funded by the Veterans Trust Fund Grant and Veterans Affairs Outreach
Fund.
In accordance with PA Act notifications, Gwin Dobson & Foreman Engineers
notified the County of a Pennsylvania Department of Environmental Protection General
Renewal Permit being applied by Bear Valley Franklin County Joint Authority for
groundwater Source Development Project located in Peters Township.
Andrew Benchoff, County Solicitor, provided information and answered questions
on four separate tax appeals that were discussed during an executive session with the
Board last week. Attorney Benchoff asked for approval and authority for him to sign the

unanimously approved to enter into 2 settlement agreements for the tax assessment
appeals of CABOT III PA2B01 LP, No. 2019-4286 and 2019-4287. The properties are
located partially in Guilford Township, and partially in Chambersburg Borough, Franklin
County, Pennsylvania. Docket No. 2019-4286, parcel no. 10-0D08-184-000000 is
originally assessed for $3,468,840.00 and the new assessment will be $3,101,900.00.
Docket No. 2019-4287, parcel no. 06-1F00.-016.-000000 is originally assessed for
$1,558,460 and the new assessment will be $1,393,600.00. The Stipulations and Orders
of Settlement memorialize the specific settlement terms.

On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter into a settlement agreement for the taxassessment
appeal of Menno Haven, Inc., No. 2011-5336. Assessment for Parcel No. 02-1C00.-00.-
010 will be $2,388,150.00, Assessment for Parcel No. 02-1C00.-029 will be
$3,260,850.00, Assessment for Parcel No. 02-1C00.-029A will be $692,430.00,
Assessment for Parcel No. 09-0C12.-038 will be $4,088,440.00, Assessment for Parcel
No. 09-0C12.-236 will be $3,645,750.00, Assessment for Parcel No. 09-0C17B-001 will
be $166,550.00, Assessment for Parcel No. 09-0C17B-004 will be $144,810.00. The
specific terms of the settlement are as set forth in the Stipulation of Settlement of Tax
Assessment Appeal.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter into a settlement agreement for the tax assessment
appeal of Westside Plaza Associates, LP No. 2019-4557. The property is located at 875
Lincoln Way West, Hamilton Township, Franklin County, Pennsylvania. The original
assessment is $458,000.00. The new assessment will be $355,200.00 with an implied
market value of $3,200,000.00. The specific terms are set forth in the Stipulation and
Agreement.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter an executive session at 1:21 p.m. this date for the
purpose of reviewing personnel matters. The Board reconvened into regular session at
2:05 p.m. No action was required after the executive session.
The meeting was adjourned at 2:06 p.m. with a motion by John T. Flannery;
seconded by Robert G. Ziobrowski.
