The Franklin County Commissioners met Thursday, February 5, 2009, with
the following members present: Robert L. Thomas, David S. Keller and Robert G.
Ziobrowski. Chairman Thomas presided and after calling the meeting to order, and
the Pledge of Allegiance proceeded with the business of the day.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
Pubic Comment was received from Allen Piper, Citizens for Responsible
Government whom is concerned about the declining economy and funds being cut
from the State and Federal level. Other municipalities allow public comment during
the meeting not just at the beginning of the meeting. Mr. Piper would also like to
hear what is going on at the meetings so Board should purchase microphones so all
public can hear what is being said and would like to know contracts the board is
approving. Mr. Piper is asking the Board to be open and honest and also would like
to see prayer or a moment of silence at the beginning of each meeting.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by David S. Keller, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of January 27, 2009 and January 29, 2009
meetings.
The Board reviewed Assessment matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved the changes to the
attached Singlewide Mobile Home List for Tax Year 2009, which is attached.
The Board reviewed additional Assessment matters. On a motion by David
S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Acceptance
and Authorization of Additions and Exonerations to the Tax Collectors of Franklin
County for the years 2007 and 2008, in order that the Tax Collectors listed may
close their 2007 and 2008 County and County Library Duplicates and that the
attached lists entitled "Board of Assessment -Summary Report" dated January 16,
2009 be made a part of these minutes.
The Board reviewed additional Assessment matters. On a motion by David
S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to certify the
amount of County and County Library Taxes on real estate and mobile homes in the
various political subdivisions of the County and the name of the Tax Collectors of
said political subdivision for the year 2009.
The Board reviewed additional Assessment matters. On a motion by David
S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Request
from Forest Air Service for list of land owners who own more than 10 acres in
Franklin County to contact them about possible gypsy moth problem.

The Board reviewed Community Services Department matters. On a motion
by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the
Report on food distribution in the amount of $3,062.70 for personnel, travel, copies,
telephone, supplies/postage, space costs, & liability insurance for the period of
October through December, 2008.
The Board reviewed FSNRC matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved the Nondiscrimination
Policy Statement for the Falling Spring Nursing and Rehabilitation Center.
The Board reviewed additional FSNRC matters. On a motion by David S.
Keller, seconded by Robert G. Ziobrowski; unanimously approved the Addendum to
Vision Share Inc. Network Service Agreement to include an additional license for
submission of Medicare A billing, a requirement by the Federal Government at an
additional cost of $799.00. All other terms and conditions of the original agreement
will remain in full force and effect.
The Board reviewed additional FSNRC matters. On a motion by David S.
Keller, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman
of the Board to execute the Advertising Agreement between the County of Franklin
and Public Opinion for advertising in the Active Living Section at a cost not to exceed
$2,835.00 for the period of January 1, 2009 through December 31, 2009.
The Board reviewed additional FSNRC matters. On a motion by David S.
Keller, seconded by Robert G. Ziobrowski; unanimously approved the Second
Amendment to the Agreement dated January 1, 2006 between the County of
Franklin and Martin Hudzinski, MD to provide Medical Director services. This
Amendment shall extend the term to December 31, 2009 at a cost of $103.00 for
administrative duties, $22.00 per physical for new employees and resident care
services will be billed by the Medical Director directly and shall not be compensated
by the Facility. All other terms and conditions of the original agreement will remain in
full force and effect.
The Board reviewed Liquid Fuels matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved the Report of County
Liquid Fuels Tax Fund to Pennsylvania Department of Transportation for the year
2008.
The Board reviewed Visitors Bureau matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved the Professional Services
Agreement between the County of Franklin and Main Street Deli to provide food and
refreshments for the Live & Learn reception at a cost not to exceed $600.00 for the
period of February 5, 2009 through February 23, 2009.
The Board reviewed Visitors Bureau matters. On a motion by David S. Keller,
seconded by Robert G. Ziobrowski; unanimously approved the Professional Services
Agreement between the County of Franklin and Patriot News to advertise in the
Central PA Magazine -February issue at a cost of $1,000.00 for the period of
February 5, 2009 through February 20, 2009.

The Board reviewed additional Visitors Bureau matters. On a motion by
David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the
Professional Services Agreement between the County of Franklin and 2"d Floor
Media, LLC to make upgrades to the FCVB website to accommodate social
networking integration and expand website tools at a cost of $3,900.00 for the period
of February 5, 2009 through April 3, 2009.
The Board reviewed additional Visitors Bureau matters. On a motion by
David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the
Professional Services Agreement between the County of Franklin and The Ragged
Edge Inn to provide lunch for the participants of the Live & Learn Weekend and a
house tour at a cost of $900.00 for the period of February 5, 2009 through February
23, 2009.
The Board reviewed additional Visitors Bureau matters. On a motion by
David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the
Professional Services Agreement between the County of Franklin and WITF Central
PA Magazine for advertising in the winter and spring issues of WITF Central PA
Magazine at a cost of $2,600.00 for the period of February 5, 2009 through April 3,
2009.
In accordance with PA Act 14 notification, Alfred Benesch & Company
notified the County of a PA Department of Environmental Protection General Permit
(GP-11) Application being applied by PENNDOT District 8-0 for replacement of
Water Obstructions and Encroachments for replacement of the TanYard Road
structure over Conodoguinet Creek located in Lurgan and Southampton Townships.
In accordance with PA Act 14 notification, Lanny Shields notified the County
of a PA Department of Environmental Protection Water Obstruction and
Encroachment Permit to install a new walkway bridge located in St. Thomas
Township.
In accordance with PA Acts 67, 68 and 127 notifications, Dennis E. Black
Engineering, Inc. notified the County of a PA Department of Environmental
Protection NPDES Permit being applied by Rachuba Group for discharge of
stormwater from construction activities for construction of Mill Creek Acres located in
Guilford Township.
The Board reviewed C.D.B.G. matters and conducted a Public Meeting for
the 2009 Community Development Block Grant (C.D.B.G.) Entitlement Application.
The Pennsylvania Department of Community and Economic Development (DCED)
have not released the amount that Franklin County will receive. Six organizations
submitted applications. The Franklin County Planning Office will submit their
recommendations to the Board at the final public hearing held on Thursday,
February 19, 2009 at 9:30 a.m. as long as the State announces the amount released
to Franklin County.
The Board reviewed Property Management matters. The Board opened bids
for the Sale of a 1994 Dodge Van. One bid was received. On a motion by David S.
Keller, seconded by Robert G. Ziobrowski; unanimously approved to award/reject on
Tuesday, February 10, 2009 at 9:15 a.m.
