The Franklin County Commissioners met Thursday, April 23, 2009, with the
following members present: Robert L. Thomas and Robert G. Ziobrowski.
Chairman Thomas presided and after calling the meeting to order, and the Pledge of
Allegiance proceeded with the business of the day.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to adopt the agenda.
Allen Piper, Citizens for Responsible Government, provided public comment and
had a few questions - do the Commissioners plan any further cuts in the budget? Mr.
Piper would like public comment held at the end of each meeting instead of at the
beginning because this suppresses the general public from expressing opinions during
the public meeting. Why are meetings held in morning unlike most other government
entities that have meetings in the evenings? Would like this to change because most of
the public cannot attend because of work hours. Mr. Piper would like to know how his
questions will be answered and would like comments be made a public record and
would like a call or a-mail of answers to his questions.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved all bills presented and ordered paid.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved the minutes of April 14, 2009 and April 16, 2009 meetings.
The Board reviewed Children & Youth matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Subsidized
Adoption Assistance Agreement on behalf of the Franklin County Children and Youth
Department for payment in the amount of $70.00/day, for the period of May 4, 2009
through December 21, 2010, in addition a one time payment not to exceed $0 to cover
non-recurring adoption expenses.
The Board reviewed Day Reporting Center matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Revised
Letter of Approval to Gary Mahon to adjust the rent by 20% of the Day Reporting Center
Building Lease. The new monthly rental will now be $3,760.00 for the period of April 1,
2009 through December 31, 2009 for a savings of $8,460.00. This is a correction to
action taken on April 9, 2009.
The Board reviewed Election matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the Agreement between the
County of Franklin and Beidel Printing House, Inc. for printing of the ballots for the
Municipal Primary Election held on May 19, 2009 at a cost of $24,921.00.
The Board reviewed additional Election matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Quarterly
Reimbursement Request and Performance Report for HAVA Grant -Section 261 for the
reporting period of January 1, 2009 through March 31, 2009.
The Board reviewed Fiscal matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the 2009 Budget Adjustment
in the amount of $72,500.00 to use contingency funds to pay for the costs of the facility
study.

The Board reviewed Magisterial District Justice matters. On a motion by Robert
G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Lease
Agreement between the County of Franklin and Rescue Hose Company No.1, Inc. for
leasing of office space located at 401 S. Washington Street, Greencastle for the
Magisterial District Judge at a cost of $3,396.00 per month for the period of January 1,
2010 through December 31, 2020. The rent will increase to $3,820.50 in year five;
$4,298.06 in year ten and $4,835.32 in year 15.
The Board reviewed Property Management matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Service
Agreement between the County of Franklin and NAC Divisions to provide semi-annual
inspection and annual preventative maintenance on the fire alarm system at the
Administrative Annex Building at a cost of $103.00 per month for the period of April 15,
2009 through December 31, 2009.
The Board reviewed additional Property Management matters. On a motion by
Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the
2009 Budget Adjustment in the amount of $5,600.00 for transfer of funds to repair roof at
the old jail.
The Board reviewed Retirement matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the 2009 Budget
Adjustment to provide additional funding in the amount of $4,000.00 for required
independent audit fee.
The Board reviewed Visitors Bureau matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Advertising
Agreement between the County of Franklin and Washingtonian.com to advertising for
the upcoming Live and Learn Weekend in Carlisle on May 8-9 for a maximum cost of
$500.00 for the period of April 23, 2009 through May 1, 2009.
The Board reviewed additional Visitors Bureau matters. On a motion by Robert
G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the
Professional Services Agreement between the County of Franklin and Hagerstown
Broadcasting to sponsor a recreation and outdoor show called Outdoors in Franklin
County and will air five daily promotions of the event at a cost of $900.00 for the period
of April 23, 2009 through December 31, 2009.
The Board reviewed additional Visitors Bureau matters. On a motion by Robert
G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the
Professional Services Agreement between the County of Franklin and Celebrate
Gettysburg for advertising for the upcoming Live and Learn Weekend in Carlisle on May
8-9 at a cost of $522.50 to be paid for by the Humanities Council Grant for the period of
April 23, 2009 through June 30, 2009.
The Board reviewed additional Visitors Bureau matters. On a motion by Robert
G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the
Agreement between the County of Franklin and Main Line Broadcasting/MIX 95 for one
commercial to promote the upcoming John Brown Sesquicentennial for 24 hours each
day for nine days at a cost of $2,500.00 for the period of April 23, 2009 through May 31,
2009.

In accordance with PA 67, 68 and 127 Notifications, CH2MHill notified the
County of a Pennsylvania Department of Environmental Protection Individual NPDES
Permit being applied by Texas Eastern Transmission, LP for hydrostatic discharges
associated with the uprate portion of the TEMAX/TIME III Projects on property located in
Peters Township.
In accordance with PA 67, 68 and 127 Notifications, CH2MHill notified the
County of a Pennsylvania Department of Environmental Protection Erosion and
Sediment Control General Permit being applied by Texas Eastern Transmission, LP for
earth disturbance associated with oil and gas exploration, production, processing or
treatment operations or transmission facilities on property located in Guilford and
Greene Townships.
In accordance with PA 67, 68 and 127 Notifications, William A. Brindle
Associates, Inc. notified the County of a Pennsylvania Department of Environmental
Protection NPDES Permit being applied by Century, Inc. for a commercial development
located in Antrim Township.
In accordance with PA 67, 68 and 127 Notifications, Herbert, Rowland & Grubic,
Inc. notified the County of a Pennsylvania Department of Environmental Protection
BWM-GP-11 General Permit and Water Obstruction and Encroachment Permit being
applied by Cumberland County Commissioners for repair and maintain of bridge F-1
located in Cumberland County.
In accordance with PA 67, 68 and 127 Notifications, Martin and Martin, Inc.
notified the County of a Pennsylvania Department of Environmental Protection BWM-
GP-11 General Permit and BWM-GP-7 General Permit being applied by Fannett
Township Board of Supervisors to encase sanitary sewer force main in concrete on
property located in Antrim Township.
In accordance with PA 67, 68 and 127 Notifications, R. Lee Royer & Associates
notified the County of a Pennsylvania Department of Environmental Protection General
NPDES permit being applied by Family Life Worship Center for a new building and
additional parking on property located in the Borough of Waynesboro.
In accordance with PA 67, 68 and 127 Notifications, Department of Army,
Letterkenny Army Depot notified the County of a Pennsylvania Department of
Environmental Protection Application for Plan Approval to replace the paint booths in
Building 57 located at Letterkenny Army Depot.
The Board reviewed Assessment matters.
The Board reviewed Assessment matters. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved that the
premises of Franklin County Tax Parcel #2630-073 of Zachary D. Burt having the
assessment of $43,580.00 shall have the lawful assessment of $31,200.00 for the
tax year 2009 and all future tax years.
The Board reviewed additional Assessment matters. On a motion by Robert
G. Ziobrowski, seconded by Robert L.

On a motion by Robert G. Ziobrowski, seconded by Robert L. Thomas;
unanimously approved to enter an executive session at 9:40 a.m. this date for the
purpose to discuss Chambersburg Town Center tax appeal matters. The Board
reconvened into regular session at 9:49 a.m.
The Board reviewed additional Assessment matters. On a motion by Robert
G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved to settle the
appeal and change the market value of Chambersburg Towne Center to $6,250,000
which is the agreed upon fair market value.
The Board recessed and will reconvene at 10:30 a.m.
The Board participated in the Take Our Child to Work Day.
The meeting was adjourned at 10:58 a.m. with a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas.
