Home My WebLink AboutRule 39-14. 2 Adjudication of Incompetency and Appointment of a Guardian of the Estate of an Incompetent Rule 39-14. 2 Adjudication of Incompetency and Appointment of a Guardian of the Estate of an Incompetent A petition to adjudicate a person incompetent and to appoint a guardian shall be filed with the Clerk of Orphans' Court after a time and place for the hearing on the matter shall be fixed by the court and notice shall be given to next of kin of the alleged incompetent and such other persons as the court may direct to show cause why the alleged incompetent should not be so adjudicated and a guardian of the estate be appointed. Such notice shall be at least twenty (20) days prior to the date of the hearing on the matter.
