WEDNESDAY, DECEMBER 30, 2020
The Franklin County Commissioners met Wednesday, December 30, 2020, with
the following members present: David S. Keller, John T. Flannery and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
Chairman Keller asked if the Board wanted to add an item to the agenda in
relation to the public comment last week provided from Valerie Jordan asking the
Commissioners to adopt a resolution to provide parents the options to allow their
children to learn virtually or attend in person at the Chambersburg Area School District.
He explained that there is no constitutional requirement for the County to intervene in
this matter. He thinks it would be appropriate to not include the resolution on the
agenda. Commissioner Flannery responded that he agrees with the Chairman: passing
the resolution has no impact on local municipalities or school boards so he supports the
decision. Commissioner Ziobrowski agreed. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda.
There was no public comment.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
The minutes of the December 23, 2020 meeting were reviewed. These will be
decided upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. John Hart, Project
Manager, attended virtually and discussed change orders number 4 and 5 from Franklin
B. Lesher for the Administration Building Project and change order number 47 for Lobar,
Inc. for the Judicial Center project. Mr. Hart provided an updated report of the change
orders. For the Judicial Center project the change orders are at 1.49% and for the
Administration Building the change orders are at 1.67%. Nicole Bowling, Senior
Planner, attended virtually to provide more information on the contract extensions for the
Tourism and Quality of Life Enhancement Grants. The items will be approved in the
afternoon approval session.
The Board recessed and will reconvene at 1:00 p.m. for final approval of the
items that were reviewed.

There was no public comment.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the December 23, 2020 meeting.
The Board reviewed Commissioners Office matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute change order #4 from Frank B. Lesher Co., Inc. to provide four
es in Corridor 125, delete cable tray, add two duplex receptacles,
provide two R2 lighting fixtures in M108/W120 vestibules, and provide two R2 lighting
fixtures in M117/W116 vestibules at the Administration Building Project. This change
order will be completed at an additional cost of $906.00

The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute change order #5 from Frank B. Lesher Co., Inc. to
provide additional 30-amp 208-volt circuits at the Administration Building Project. This
change order will be completed at an additional cost of $3,229.00.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute change order #47 from Lobar, Inc. will revise Detail
8/A623, first floor bulkhead at the Judicial Center Project. This change order will be
completed on a time-and-material basis, not to exceed the amount of $10,455.83.
The Board reviewed Court Administration matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved renewal of an
agreement between the County of Franklin and Josephina C. Souders to provide
English-Spanish interpreter services for the Franklin County Court System at a rate of
$52.25 per hour for a minimum of 16 hours per week, services over 16 hours will incur a

rate of $55.00 per hour, up to a maximum of $400.00 per day commencing with the 17
hour worked in a work week (Monday-Friday). This agreement is for the period of
January 1, 2021 through December 31, 2023. Ms. Souders is certified by the
Administrative Offices of Pennsylvania Courts (AOPC), and each county is required to
utilize an APOC certified translator during formal court hearings.
The Board reviewed Planning Office matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the contract extensions between the County of Franklin and the
following organizations for funding received through the Franklin County Tourism and
Quality of Life Enhancement Grant (TQLEG) program. These organizations have
requested a one-year extension of their existing contract in order to complete their
projects.

The Board reviewed Property Management matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the renewal of agreement between the County of Franklin and
Diamond Automatic Sprinkler in the amount of $1,010.00 for the period of January 1,
2021, through December 31, 2021. Diamond Automatic Sprinkler will provide annual
mandated inspection for the wet pipe and preaction automatic system in Building 426 at
390 NY Ave., and annual mandated inspection for the wet pipe automatic sprinkler
system at the Admin Annex.

The Board reviewed additional Property Management matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute agreement between the County of Franklin and
Compliance Management International in the amount of $5,980.00 for environmental
and air quality testing at the Courthouse Annex, Administration Annex, and at the
Human Services building.
In accordance with PA Act notifications, Leslie Bowman notified the County of a
Pennsylvania Department of Environmental Protection renewal of a NPDES PAG-12
Permit for S&J Farms, LLC, located in Lurgan Township.
In accordance with PA Act notifications, Red Barn Consulting, Inc. notified the
County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being applied by Steve
Hykes for an existing operation on property located in Greencastle.
The Board reviewed Personnel matters. Ms. Gray explained that with the
upcoming retirement of the Deputy Warden it is standard protocol to review the job
description to make it more up to date with the current duties of the position. On a
motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved
the revised Deputy Warden of Inmate Custody position description at the Jail.
The meeting was adjourned at 1:12 p.m. with a motion by John T. Flannery;
seconded by Robert G. Ziobrowski.
