WEDNESDAY, OCTOBER 27, 2021
The Franklin County Commissioners met Wednesday, October 27, 2021, with the
following members present: David S. Keller, John T. Flannery and Robert G. Ziobrowski.
Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the
Pledge of Allegiance, proceeded with the business of the day.
The meeting was live streamed.
On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously
approved to adopt the agenda.
Chairman Keller announced that the meeting next week will be held on Thursday at
10:00 a.m. and 2:00 p.m. due to election responsibilities.
Valarie Jordan from Fayetteville provided public comment as per the document that is
attached to these minutes. Ms. Jordan also wanted to mention the debt information she
received from Jean Byers through her open records request that most of the debt is from 2002
onward so this is a big project. She mentioned some of the numbers and that they are just
principle and not interest
wants the Commissioners to go to the supermarkets and see that shelves are going bare,
especially yogurts, milk and paper products which Costco is starting to limit.
On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously
approved all bills presented and ordered paid.
The minutes of the October 20, 2021 meeting were reviewed. These will be decided
upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. John Boozer, Project
Manager, explained board action item # 1 Change Order with Lobar is an extension of the
duration of the contract for the Judicial Center project which was caused by COVID and the
asbestos and lead paint issue in the Historical Courthouse. He explained that the impact
as insurance and bond costs. Commissioner Ziobrowski asked for more information on board
action #9, contract with Michael Baker. Steve Thomas, Planning Director, explained that across
the nation the US Bike Route system is an idea that connects bike routes to major tourist areas.
There are 20 to 30 routes across the country. The closest route to our area is route 50 at the
C&O Canal. He said we will partner with PennDOT; they want to make sure the routes will be
done in a safe manner. The route starts in North Carolina and ends in New York. Mr. Thomas
provided more information on the process including partnering with Franklin County Cyclists,
engaging with municipalities and public engagement of the project. Chairman Keller suggested
looking at a route from Gettysburg through Monterey Pass in Blue Ridge Summit, Waynesboro
and Hagerstown. He commented that the route could connect to C&O Canal in Williamsport.
The items will be decided upon in the afternoon approval session.
The Board reviewed Commissioners Office matters and conducted a bid opening for the
Lease of farm land on Franklin Farm Lane. The following bidder submitted a bid: Derwood
Martin DBA Clearview Farm bid a monthly amount of $1,581.07. On a motion by Robert G.
Ziobrowski, seconded by John T. Flannery; unanimously approved to award to Derwood Martin
DBA Clearview Farm and for staff to move forward with developing the lease documents. This
was the only bid received.

The Board recessed and will reconvene at 2:00 p.m. for final approval of the items that
were reviewed.

On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously
approved the minutes of the October 20, 2021 meeting.
The Board reviewed Commissioners Office matters. On a motion by Robert G.
Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute Change Order #GC-107 from Lobar, Inc. to provide extended general
conditions labor coverage for the extended construction period for an additional amount of
$96,241.79; credit the remaining corner guard installation costs and turn over remaining corner
guard material to owner for a deduct of $3,833.08 and credit temporary utility charges paid
directly by the owner for a deduct amount of $55,860.60 for a total change order amount of
$36,548.11 for the Judicial Center project.
The Board reviewed additional Commissioners Office matters. On a motion by Robert
G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute the rental agreement between the County of Franklin and the Commonwealth
of PA Department of Military and Veteran Affairs for the use of the National Guard Armory as

a polling place for Hamilton 1 at the upcoming November 2 Municipal General Election. There
is no cost assigned to this agreement.
The Board reviewed additional Commissioners Office matters. On a motion by Robert
G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute the renewal agreement between the County of Franklin and the Zigmund Co.,
Ltd. for insurance consulting services at a cost of $5,000.00 charged annually, plus an hourly
fee of $100.00 for consultation and $50.00 for clerical support time, federal mileage rate per
travel mile and other expenses incurred, for the period of November 1, 2021 through October
31, 2022.
The Board reviewed Department of Emergency Services matters. On a motion by
Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the agreement
between the County of Franklin and AllPaid (formerly GovPayNet) for an online credit card
acceptance system for the Department of Emergency Services. AllPaid charges a fee of 3% for
all transactions, which is paid by the user not Franklin County. This will allow companies to pay
online for chemical fees, planning fees and incident expenses owed to County HazMat or
Emergency Management.
The Board reviewed Grants matters. On a motion by Robert G. Ziobrowski, seconded
by John T. Flannery; unanimously approved the renewal grant application to the Department of
Housing and Urban Development for the PA0649 grant which is a 10-unit program to house
chronically homeless individuals with a disability. The grant request is for the amount of
$109,550.00 for the grant period of August 1, 2022 through July 31, 2023. The program
currently houses 4 individuals who are chronically homeless and have a mental health
diagnosis. However, moving forward as part of the Community Connections Housing
department, units will house eligible individuals who are chronically homeless and have a
diagnosed disability.

The Board reviewed additional Grants matters. On a motion by Robert G. Ziobrowski,
seconded by John T. Flannery; unanimously approved the renewal grant application to
Department of Housing and Urban Development for the PA0182 which provides 23 units of
Supportive Housing for individuals who are chronically homeless and also have a Serious
Mental Health diagnosis. All units are full at this time. The grant request is for the amount of
$261,018.00 for the grant period of August 1, 2022 through July 31, 2023.
The Board reviewed Human Resources matters. On a motion by Robert G. Ziobrowski,
seconded by John T. Flannery; unanimously approved the amendment to the existing
agreement with Gallagher Benefit Services, Inc. to provide benefit broker services to assist in
review of our health benefits and works with insurance carriers and third party administrators to
ensure well-negotiated renewals. This amendment is to extend the agreement from January 1,
2022 through December 31, 2025 for a cost of $85,000.00 annually. Their total compensation
varies based on commissions received from our ancillary benefits and a performance guarantee
that is reviewed at the end of each plan year.
The Board reviewed Human Services Administration matters. On a motion by Robert G.
Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute the contract between the County of Franklin and Rhodes Grove for Human
Services Training Days on April 6, 2022, that will be for 150 individuals at the Rhodes Grove
Conference Center at a cost of $3,225.00. Any additional meals above the 150 will be provided
at an additional cost of $21.50 per person. Price includes one breakfast, one lunch and one
snack per person during the course of the one-day training session. Cost also includes
necessary requirements for the event, such as: main conference room, four breakout session
rooms, Wi-Fi, projector, screens, ample parking, staff cooperation and room set-ups.
The Board reviewed Planning matters. On a motion by Robert G. Ziobrowski, seconded
by John T. Flannery; unanimously approved for the Chairman of the Board to execute the Work
Order Authorization from Michael Baker International to perform an evaluation of routes within
Franklin County being considered as part of a cross-state bicycle route on the U.S. Bicycle
Route System at a cost of $75,000.00, 80% of which is paid with Federal Highway funds, 10%
state funds, and 10% county funds. The MPO is performing an evaluation of the proposed
corridors to determine their suitability for cross-state bicyclists, and to identify either alternate
routes or improvements needed to offer safe and meaningful riding experiences through
Franklin County.
The Board reviewed additional Planning matters. On a motion by Robert G. Ziobrowski,
seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute
the easement agreement between the County of Franklin and Ivan and Rhoda Leid at a cost of
$298.88. Cumberland County is replacing Bridge 1 on Stonewall Road in Shippensburg,
changing it from a one-lane bridge to two lanes. Cumberland will pay for the full cost of the
improvements. Bridge 1 is jointly owned by Cumberland and Franklin County, and they have
asked Franklin to do the easement agreements with two landowners. The permanent right of
way is 1,868 sq. ft. The temporary right of way is 1,940 sq. ft.
The Board reviewed additional Planning matters. On a motion by Robert G. Ziobrowski,
seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute
the easement agreement between the County of Franklin and Mervin and Lori Oberholtzer at a
cost of $1.00. Cumberland County is replacing Bridge 1 on Stonewall Road in Shippensburg,
changing it from a one-lane bridge to two lanes. Cumberland will pay for the full cost of the
improvements. Bridge 1 is jointly owned by Cumberland and Franklin County, and they have
asked Franklin to do the easement agreements with two landowners. The permanent right of
way is 2,795 sq. ft. The temporary right of way is 4,045 sq. ft.

The Board reviewed Planning matters. On a motion by Robert G. Ziobrowski, seconded
by John T. Flannery; unanimously approved Resolution #2021-07, application certification,
disclosure report and language access plan certification to PA Department of Community and
Economic Development for the 2021 Community Development Block Grant (CDBG) program
requesting an amount of $151,942.00.
The Board reviewed Property Management matters. On a motion by Robert G.
Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the
Board to execute the agreement between the County of Franklin and Ehrlich Pest Control to
provide preventative services for pest control at the Franklin County Judicial Center located at
14 North Main Street. The cost is a monthly charge of $60.00 plus an additional one-time fee of
$240 to provide pest control for active rodents found in the building due to the recent completion
of construction. This agreement is for the period of October 1, 2021 through December 31,
2022.
The Board reviewed Tuscarora Managed Care Alliance matters. On a motion by Robert
G. Ziobrowski, seconded by John T. Flannery; unanimously approved amendment #1 to the
agreement between the County of Franklin and Tuscarora Managed Care Alliance (TMCA) for
staffing. This amendment covers staffing changes to the TMCA Data Warehouse team whereas
-50%. All other
terms and conditions of the original agreement will remain in full force and effect.
In accordance with PA Act notifications, C. S. Davidson, Inc. notified the County of a
Pennsylvania Department of Environmental Protection General Permit No. 11 Permit being
applied for by the St. Thomas Township Municipal Authority to allow for the continued discharge
of effluent from the St. Thomas Township Wastewater Treatment Facility located in St. Thomas
Township.
On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously
approved to enter an executive session at 2:04 p.m. this date for the purpose of reviewing
potential litigation matters. The Board reconvened into regular session at 2:29 p.m. No action
was required after the executive session.
The meeting was adjourned at 2:30 p.m. with a motion by Robert G. Ziobrowski;
seconded by John T. Flannery.

Franklin County Commissioner Chair Dave Keller,
I'm sure you have read my emails to you within the last couple of days. There is no denying that
you have been more than generous to WellSpan Health when its officials sought you out. Your
county minutes memorialized your generosity to one official in Chambersburg Hospital.
Chambersburg Mall was a BIG FAVOR granted by you to this official. In my humble opinion,
it's now your turn to ask BIG FAVORS from WellSpan Health's CEO and Board of Directors in
order to stop the needless firings of their personnel who refuse to follow an unconstitutional
mandate.
When I attended the rally on Saturday supporting our local, WellSpan Health workers, I sat next
to a young woman who actually recognized me. She identified herself to me, as a lab technician,
who draws blood out of two WellSpan Health facilities: Waynesboro Hospital and WellSpan
Mont Alto Health Center. She is planning to either leave or get fired from WellSpan Health if
WellSpan Health holds firm to its vaccine requirement. I'm here advocating for her, for myself,
for my husband, and the other 160,000 residents of this county who will be hurting because of
one corporation forcing this unconstitutional mandate of theirs onto all of us. This mandate
doesn't just affect employees. It affects everyone needing a service from WellSpan Health.
While battling breast cancer 11 years ago, I had to have my blood thrown all the time. Imagine if
too many lab technicians walk away from this vital job? Cancer patients will immediately suffer
the consequences of WellSpan Health's needless actions. Cancer patients can't wait. The last
time that I stood before you and the other commissioners, I also learned that someone in this
room has a family member who is now suffering from cancer.
So, I ask publicly of you and the other four county chairs in Adams,York, Lebanon and Lancaster
to hold a meeting, as soon as possible, with the executives of WellSpan Health to strongly
discourage them to stop this unwarranted and unconstitutional mandate. You have it within your
power to do so.
Important Footnote: UPMC is not mandating its employees to get vaccinated. Google why this
healthcare system is not.
