WEDNESDAY, JANUARY 12, 2022
The Franklin County Commissioners met Wednesday, January 12, 2022, with the
following members present: David S. Keller, John T. Flannery and Robert G. Ziobrowski.
Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the
Pledge of Allegiance, proceeded with the business of the day.
The meeting was live streamed.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously
approved to adopt the amended agenda. Carrie Gray, County Administrator, asked to modify
the board actions and omit item #1 from consideration today.
There was no public comment.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously
approved all bills presented and ordered paid.
The minutes of the January 3 and January 5, 2022 meetings were reviewed. These will
be decided upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. Chairman Keller asked Ms.
Gray to explain board action item #9, contract with SCCAP. Ms. Gray explained that the
contract is to continue the collaboration with the South Central Community Action Programs
(SCCAP) for the reentry coalition, Franklin Together. This agreement provides for a facilitator
that works to identify barriers that people face when they get out of Jail. The coalition is asking
this contract be renewed for 4 years instead of 2 years. She continued that if the annual
amount is not spent then it does not roll over into the next year and there is also a 30 day out
clause. Chairman Keller asked if this contract is grant funded and Ms. Gray responded that the
coalition helps to find grants to cover reentry costs and they also are paid to hold reentry
simulations that show what barriers people face when they leave the jail. Glenda Helman,
Director of Grants Management provided more information that SCCAP receives mini grants
from the Human Services Block Grant, PCCD Moving Forward grant and a small grant from
Wellspan to buy equipment for Moving Forward Support Groups. Commissioner Flannery
asked Ms. Gray to explain what Conflict Attorneys are, referring to items #2 and 3. Ms. Gray
explained that conflict attorneys are available to assist courts when there is a conflict with
indigent individu
counsel know the system and criminal justice process more intimately than would attorneys who
have had
afternoon session.
The Board recessed and will reconvene at 2:00 p.m. for final approval of the items that
were reviewed.

On a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously
approved the minutes of the January 3 and January 5, 2022 meetings.

The Board reviewed Court Administration matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the contract between the County of
Franklin and Taccino Law Office to perform the duties of conflicts attorney of Franklin County at
a starting rate of $65,854.39 and will increase 2% each year with a rate of $67,171.47 for the
year 2023 and a rate of $68,514.90 for the year 2024. Printing costs not to exceed $100.00, per
case, will be reimbursed to the contractor. Printing costs over $100.00, per case, will require a
Court Order. In cases which go to trial, the Contractor will be paid at the rate of $80.00 per hour
once the defendant instructs the Contractor to file a post-sentence motion or appeal. This
contract is for the period of January 1, 2022 through December 31, 2024.
The Board reviewed additional Court Administration matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the contract between the
County of Franklin and Kulla, Barkdoll & Stewart, P.C. to perform the duties of conflicts
attorney of Franklin County at a starting rate of $5,854.39. Printing costs not to exceed $100.00
per case will be reimbursed to the Contractor. Printing costs over $100.00 per case will require
a Court Order. In cases involving persons charged with criminal homicide, attempted homicide,
or homicide by motor vehicle or drug delivery resulting in death, the rate of pay for said cases
will be $80.00 per hour. Cases involving persons petitioning the Courts for relief under the Post-
Conviction Collateral Relief Act, should the Contractor agree to represent these types of cases,
will be paid at the rate of $80.00 per hour. This contract is for the period of January 1, 2022
through December 31, 2022.
The Board reviewed Drug & Alcohol matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the updated contract listing for all
contracts and addendums for the time frame of April 1, 2021 through November 30, 2021 for
the Drug & Alcohol department. Contract listing is maintained for proper accounting of all
contracts to include vendor name and address, type(s) of service provided and rate(s) charged
for services.
The Board reviewed Grants Management matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to
amount of $20,000.00 to be used to expand Operation Save-a-Vet, Save-a-Pet to include
National Guard and Reserve components that have completed their obligation. This expansion
would directly benefit those service members that do not hold a veteran status and to expand
apy Riding Program to provide alternatives for those reluctant to
access traditional services and increase the number of veterans participating.
The Board reviewed Human Resources matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the revised Paid Time Off Program
(PTO) Policy, Number 321.04, to provide employees with the opportunity to take time off from
work with pay for vacation, sick or personal needs, effective January 12, 2022.
The Board reviewed Jail matters. On a motion by John T. Flannery, seconded by Robert
G. Ziobrowski; unanimously approved the transport agreement between the County of Franklin
and the PA State Constable Shannon Strizziere for service of approved transports for the Jail
for an amount of $30.00 for the first hour and $3.50 for each additional quarter hour for a term of
January 1, 2022 through December 31, 2022. Constables are required to follow state, local
laws and Franklin County rules, regulations and policies.
The Board reviewed Planning matters. On a motion by John T. Flannery, seconded by
Robert G. Ziobrowski; unanimously approved the revised Resolution #2021-09 that was signed
on December 22, 2021 to update the signatory to allow Steven Thomas, the Planning/MPO
Director to sign all Metropolitan Planning Organization (MPO) agreements and work orders
regarding the Pennsylvania Department of Transportation 2023-2028 Open End Planning
Agreement. This resolution is being revised due to PennDOT requesting the document be
updated to include the effective dates of July 1, 2022 to June 30, 2028.

The Board reviewed Reentry Services Center matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the contract between the
County of Franklin and South Central Community Action Programs (SCCAP) to provide services
and coordination connected to the function of the Franklin Together reentry coalition for an
amount of $319,328.00 for the period of January 1, 2022 through December 31, 2026.
The Board reviewed Tax Claim matters. On a motion by John T. Flannery, seconded by
Robert G. Ziobrowski; unanimously approved to accept a bid made by Jeremy West in the
amount of $1,000.00 on the repository sale of a mobile home located in Lurgan Township.
In accordance with PA Act notifications, martin and martin, inc. notified the County of a
Pennsylvania Department of Environmental Protection PAG-02-NPDES Permit Application
being applied for by AES Compassionate Care, LLC for an industrial facility expansion with
Chambersburg.
The meeting was adjourned at 2:08 p.m. with a motion by John T. Flannery; seconded
by Robert G. Ziobrowski.
