HomeMy WebLinkAbout2023-07-19 Commissioner Minutes WEDNESDAY, JULY 19, 2023 The Franklin County Commissioners met Wednesday, July 19, 2023, with the following members present: David S. Keller, John T. Flannery and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. The meeting was live streamed. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved to adopt the agenda. There was no public comment. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved all bills presented and ordered paid. The minutes of the July 12, 2023 meeting were reviewed. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the minutes. The Board reviewed Agreements, Contracts and Reports. Carrie Gray, County Administrator, is requesting to hold board action #1 due to needing additional information that staff owes the Board regarding the reasons for the changes to some of the policies listed. She would like to pull that and provide them with the full picture for their consideration hopefully for items will be decided upon in the afternoon session. The Board reviewed information regarding Pretrial, Probation, and Parole Supervisions Week. Doug Wilburne thanked the Board for the opportunity of the recognition today. He is extremely proud of the work and efforts of our Probation Officers. They are changing lives challenging field. Probation Officers are tasked to guide individuals to the back end of the criminal justice system. They supervise and support those who have moved on to the community supervision phase. They are compassionate professionals that believe in the power of second chances and most importantly to the potential for transformation. Their dedication to the betterment of individuals in the communities they serve absolutely deserves special recognition. He continued that officers serve as mentors, counselors, and motivators working with individuals to address their underlying causes of criminal behavior. They try to understand their unique circumstances, challenges and their experiences that allow them to tailor their Probation Officers help individuals break through that cycle of crime providing them with tools rehabili evolved from that exclusive nail and jail them mentality to a more reformative approach of identifying what is driving that criminal behavior, that criminal thinking and focusing on how we difficult individuals. Their aim is to aid these individuals and achieve a positive transformation s primary goal and objective which is public safety. He can assure the Commissioners that our officers consistently make well considered discretionary judgments that ensure the safety of our communities on a daily basis. Chairman Keller thanked the Chief and the Board knew that President Judge Meyers would be here if he was able but he had a family matter that required him to be elsewhere. They appreciate the work they all have done and together in collaboration with the President Judge and the Court. He introduced District Court Administrator Mark Singer who is representing the President Judge. Mr. Singer said he appreciates hearing those words and thanked all the staff that are here. And Juvenile Chief Rick Ackerman is here for the Juvenile side as well. He appreciates all that Probation does. His roots brought him from Maryland to Pennsylvania so he had to learn the Pennsylvania probation system and they spent a lot of time opportunities like this to hear that and be present with the staff he appreciates. When he needs a pick up day he likes coming to something like this. He likes sitting on adoptions, he likes watching a wedding so this is a good day to celebrate the whole week and he thanked Probation and Probation staff and all they do, juvenile wise and adult wise and public safety is paramount. So he appreciates it as we return citizens to the community we want them to be d be here in person if he could but he has another matter he needs to attend to. Juvenile Chief Rick Ackerman said he is here in support want to take any thunder from them. He appreciates and agrees with everything Chief Wilburne some folks from the Human Services side here today as well. It illustrates the great working relationship that we have in Franklin County. He thanked them for being here showing their support. Chairman Keller read the proclamation. Commissioner Flannery thanked Chief Wilburne and that four years ago he had no idea what him and his staff did but being on Prison Board and hearing his updates once a month it strikes him to all the work that they put in, the dedication and commitment that him and his staff have here in Franklin County so he just wanted to thank them and this is well deserved. They deserve nothing more than to be recognized all year round, not just for a week. Commissioner Ziobrowski said when Commissioner Flannery came aboard three and a half years ago they had a conversation about the differences between business and government. He continued that John owned a restaurant and a bar and he told John the difference between business and government is when you have that. That is exactly the people we have to fix and some people end up going to jail for a while but ultimately they get out and end up with Adult Probation and oftentimes they end up with help particularly appreciative of the leadership role that our Juvenile Probation has played statewide at adopting best practices. The juvenile side has always been ahead of that curve and Rick Ackerman and Angie Mackley have always been intimately involved in that both locally and statewide. And Chief Wilburne, his leadership in making the sea change from nail them and jail them to justice reinvestment and restorative practices and helping folks getting their lives back on track and that is noteworthy and excep them to please keep it up. He thanked them. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved to sign Franklin County Proclamation #2023-18 proclaiming the week of July 16-22, 2023 as Pretrial, Probation, and Parole Supervisions Week in Franklin County and that the attached proclamation be made a part of these minutes. The Board recessed and will reconvene at 2:00 p.m. for final approval of the items that were reviewed. The Board reconvened at 2:00 p.m. There was no public comment. Continued on page 3 The Board reviewed Community Connections matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the following lease agreements for the HUD Permanent Supportive Housing Lease Program (SHP I/II) that covers the total rent plus any landlord covered utilities for their program participants. The leases are for the period of August 1, 2023 through August 1, 2024. The County holds the Lease with the landlord and the program participant subleases from the County. Program participants are responsible for utilities that are not included in the lease/rent. The rent and utilities cannot equal more than 30% of the program parti linked with Supportive Services and case management to assist them with maintaining permanent stable housing. a. Micah Gingrich for a total lease amount of $8,700.00 b. Sally C. Sussman for a total lease amount of $8,700.00 The Board reviewed Grants Management matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the 2023 Home4Good grant application is for a Federal Home Loan Bank grant requesting funding for Supportive Services for Shelter + Care program participants. In addition, funds will be used to provide basic furnishings for new participants. HUD provides funding to cover the rental subsidies for this program, but it does not provide funding for supportive services or basic furnishing necessities for individuals needing these forms of assistance. This funding will be used as part of the 25% required HUD match if it is awarded. The total amount of the grant is $20,000.00 for the time period of October 1, 2023 to September 30, 2024. The Board reviewed Jail matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved Resolution #2023-12 declaring the need for emergency replacement and repair of the generator at the Jail. The Board reviewed Planning Department matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the work order authorization from Michael Baker International to conduct a trail connector study between Waynesboro Borough and Washington Township near Renfrew Park. The Franklin County Metropolitan Planning Organization (MPO) approved this proposal at their last regularly scheduled meeting. The cost of work is based on a firm fixed price of $14,050.00 and will not exceed that amount unless otherwise agreed to in writing by both parties. Michael Baker will be providing planning services for the study through the MPO On-Call Contract dated February 17, 2021. The Board reviewed additional Planning Department matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved Resolution #2023-11 by the Franklin County Commissioners to approve the License Agreement, DEP File No. GP112803223-002, with the Commonwealth of Pennsylvania and to authorize Carrie Gray as County Administrator to take actions to enact that agreement. The Board reviewed Risk Management matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the quote from AllCom Global Services to upgrade Milestone so that all County cameras will be available without requiring remote access into other programs at a cost of $75,762.34. This also eliminates the need for users to check every camera to ensure it is functioning correctly and recording and will also reduce the lag we currently experience with cameras. In addition, this includes integration with custom software so we can receive specialized alerts. Continued on page 4 On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved to enter an executive session at 2:10 p.m. for the purpose of reviewing pending litigation matters. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approvedto reconvene into regular session at 2:48 p.m. Action will be required after the executive session. Chairman Keller said they just exited the executive session and as a result of the conversation during the executive session it was recommended that we amend the agenda to add consideration of an item related to the conversation that occurred during the executive session. He asked Carrie Gray or counsel to recommend the language for that motion to amend the agenda. Attorney Scott Wyland asked to amend the agenda as follows: adding the resolution authorizing Counsel for the County to sign a proposed settlement agreement regarding pending litigation, subject to court approval. The reason for the amendment is the receipt of the proposed settlement agreement on the morning of the meeting. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved the amended agenda. Chairman Keller asked what the authorization counsel is looking for. Attorney Scott Wyland said Counsel is asking for a motion to authorize counsel for the County to sign the proposed settlement agreement, subject to court approval, and which we just received this morning. Chairman Keller asked if there is a resolution that needs to go along with this request. Attorney Elliott Sulcove said there is and he read the resolution to the Board. Attorney Wyland wanted to add for the purposes of the minutes that the case has been placed under seal by the request of the plaintiff and by order of the Court. Attorney Frank Laverly wanted to reiterate that because of that there should not be further comment on the settlementuntil there is approval by the Court. Chairman Keller asked for a motion. On a motion by Robert G. Ziobrowski, seconded by John T. Flannery; unanimously approved to authorize attorneys to execute the agreements and other related documents as presented. The meeting was adjourned at 2:54 p.m. with a motion by Robert G. Ziobrowski; seconded by John T. Flannery. Carrie E.
