PROCEDURE:
MH/IDD/EI and all service providers contracted by the MH/IDD/EI Office or service agencies
are required to adhere to the provisions and procedures established through Act 33 and Act 73.
Beginning July 1, 2015, clearances must be obtained every sixty (60) months. Timelines for
renewed clearances are based upon the date of each individual clearance. If an individual or
agency elected to renew all clearances at the same time, the date of the oldest clearance rather
than the most recent would be used. Any employee with current certification issued prior to July
1, 2015 must renew their certifications within sixty (60) months from the date of their oldest
certification or if their current certification is older than sixty (60) months. If an individual or
agency, however, elects to renew all certifications at the same time, the date of the oldest
certification, rather than the most recent, is the date to be used for the renewal date.
All personnel hired after January 1, 1986 will submit an application for Child Abuse Clearance
and Criminal History Background check as follows:
1. Form CY 113-PA Child Abuse History Clearance can be completed online or submitted
to Child Line and Abuse Registry, P.O. Box 8170, Harrisburg, PA 17105-8170. To
access online, visit the Child Welfare Portal: www.compass.state.pa.us/cwis. Those
submitting a new application will need to create a User account.
2. Form SP4-164 Request for Criminal Records Check can be completed online at
https://epatch.state.pa.us/ or submitted to PA State Police Central Repository, 1800
Elmerton Avenue, Harrisburg, PA 17110-9758.

3. FBI Federal Criminal History Clearance (fingerprinting background check) must register
at https://www.identogo.com/. After registering online, a fingerprint submission must
be completed at one (1) of the locations listed on the IdentoGo System website.
Any service program which, either routinely or periodically, serves children is required to have
appropriate reference checks and supportive documentation on file for each staff person hired
after January 1, 1986. This includes direct contact with the children to be served, or staff
members who are identified by contract personnel roster as having direct service staff
responsibilities for a service program that serves or could serve children. When an employee
begins employment with a new agency, institution, organization or other entity that is
responsible for the care, supervision, guidance or control of children, new clearances must be
obtained prior to the start of employment.
Each agency must have on file, and available for review by MH/IDD/EI staff, DHS staff or their
designees, agency procedures for meeting the requirements of Act 33 and Act 73. This must
include a procedure for requesting from applicants a background check from the Department of
Human Services, the Pennsylvania State Police, and the Federal Bureau of Investigation. An
agency procedure on processing applications using the background check is required. Agency
procedures must also clearly state the criteria for applicants who are not covered under the
provisions of Act 33 and Act 73.
