Thank You For Your Business! PAYMENT TERMS A deposit of 50% of the total is due with the signed acceptance of this contract prior to work commencing. Balance is due with 15 days of the final invoice date. Terms and Conditions attached. BAER’S SIGN SERVICE, LLC TERMS AND CONDITIONS 1. This proposal is made subject and under all the terms and conditions set forth herein. 2. Basic estimates and bids are at no charge; however, insurance bids over $500.00 will have a fee of $35.00 due upon receipt. This fee is non-refundable and will be credited to the customer’s account with job confirmation. 3. All labor, material and equipment costs and completion dates listed herein are contingent on availability, strikes, accidents, forces of nature and/or causes beyond the control of Baer’s Sign Service, LLC and may change without notice. 4. Special contractual conditions contained within customer supplied purchase orders or other agreements in no way negate any term or condition in this proposal unless Baer’s Sign Service, LLC agrees in writing signed by it. Upon customer’s acceptance, this proposal becomes a binding contract, and the customer agrees to all the conditions herein. 5. It is the responsibility of the customer to obtain and post all necessary permits and pay all fees required prior to the commencement of work. 6. If during installation unusual digging conditions are encountered such as rock, water, etc. this contract is binding; however, an addition charge based on time and materials plus 35% on necessary sub-contract labor, materials and equipment will be added to the quoted price. 7. When installation is not performed by Baer’s Sign Service, LLC, the customer assumes complete responsibility for installation and/or damage to product or property incurred as a result. 8. The customer agrees to pay all costs, taxes and fees herein, and all collection, attorney and court costs in the event of default of payment. 9. Interest shall be due on all amounts outstanding for more than thirty days at the rate of 1.5% per month. 10. Basic sketches will be supplied upon acceptance of proposal. Custom designs and logos will be priced on an hourly rate with a minimum fee. Additional charges for more than two revisions of original design. 11. All sketches designs and artwork other than those supplied by the customer, remain the property of Baer’s Sign Service, LLC, and may not be used or reproduced in any fashion without written permission from the designer. Purchase of a sign with a custom design does not indicate ownership of said design for use as a logo. 12. The customer assumes complete responsibility for patent, trademark or copyright infringements when the customer supplies designs or artwork. 13. Prices for designs and artwork contained in this proposal are estimates for the specified work only and may change without notice due to changes in design. Customer supplied artwork quality, photographs, overtime, design changes, special consultations and delays by customer and all other project related expenses that cannot be estimated accurately in advance may be billed additionally. 14. Any concept, design or artwork designed by Baer’s Sign Service, LLC identical or in close facsimile that is used without written permission will be billed at full price. 15. Customer supplied artwork must be vectorized line art files in an eps or pdf file format. Baer’s Sign Service, LLC may request camera-ready artwork if disks or emails are not compatible. 16. Baer’s Sign Service, LLC has the final determination as to whether specific customer supplied artwork is acceptable. Any additional clean up to this artwork will be charged separately at an hourly rate and with a minimum fee. 17. Variations in final design, surface finish and/or color may occur due to production methods and material availability and characteristics. 18. Customer agrees to allow Baer’s Sign Service, LLC to remove/repossess products due to default of payment. Any removal/reinstallation costs are the complete responsibility of the customer. 19. Work specified within this document will not proceed until this contract has been signed by the customer and received by Baer’s Sign Service, LLC with any required deposit. 20. Customer consents to jurisdiction and venue in the courts of Franklin County, Pennsylvania. 21. Acceptance of this contract provides Baer’s Sign Service, LLC with permission to use photos and other images of the sign or vehicle in company advertising and marketing methods. 22. Acceptance of this contract provides Baer’s Sign Service, LLC with permission to place a contractor sign on the jobsite during the job and up to two weeks following completion.
