(December 25, 1993) Amended by Order of Court dated July 17, 2006 Published at 36 Pa. Bull. 4178 (August 5, 2006) Rule 39-1301. Compulsory Arbitration. Scope. All cases which are at issue where the amount in controversy shall be $50,000.00 or less, except those involving title to real estate, shall first be submitted to and heard by a Board of three (3) members of either Bar of the Judicial District for consideration and award. Cases involving title to real estate and cases involving more than $50,000.00 may be heard by the Board upon agreement of counsel for both sides filed in the case. Cases which are not at issue and whether or not suit has been filed in which the amount in controversy shall be $50,000.00 or less may be referred to the Board of Arbitrators by Agreement of Reference signed by counsel for both sides in the case, which said Agreement of Reference shall define the issues involved and for determination by the Board and, when agreeable, shall also contain stipulations with respect to facts submitted or agreed upon, or defenses waived. In such cases the Agreement of Reference shall take the place of the pleadings in the case and be filed of record.
