FAX (717) 597-1734 February 7, 2006 Mr. Phil Tarquino Franklin County Planning Commission 218 North Second Street Chambersburg, Pa. 17201 Dear Mr. Tarquino: Borough Council reviewed a letter dated January 11, 2006 from attorney Shawn D. Meyers at their meeting held last evening. The letter was written by Mr. Meyers on behalf of his client, Vijay Khanna, owner of the Castle Green Motel at 671 East Baltimore Street. The letter requests that Borough Council consider amending the Zoning Ordinance to provide parking requirements that would pennit 1.2 parking spaces per room for hotels and motels. Following review of this request, Borough Council voted to refer the matter to the GreencastIe Planning & Zoning Commission and the Franklin County Planning Commission for review and comments. Please review this matter and forward your recommendation and/or comments in writing to my attention. I have enclosed a copy of the letter from Mr. Meyers for your review. Greencastle Borough Police and neighboring properties. Mr. Khatµl8. has also d!scovered that the bar is not a pleasant Qusiness to manage. However, he has experienced satisfaction in operating the motel. Accordingly, he desires to continue to operatè the motel provided he can construct additional rooms to replace the income generated by the bar/restaurant. Currently, the property is located m an area zoned Highway-Commercial by the Borough. Under the zoning ordinanc.e parking: re.quirem~ts a commercial business ~s required to supply one (1) parking spot for every two hundred (200) square feet. This bro~d requirement does not take into account the different natUre of a 1p.ctel or hotel from a store, professional office or other' Commercial use. . .' .... . . Currently, the existing parking spaces at the Castle Green Motel do not meet the requirements of the zoning ordinance. According to Mr. Schemmerling, each motel room is approximately 500 square feet, '\Yhich requires that Mr. Khanna provide at least two or more parking spaces pa hotel room. This requir~ent is not reflective of the typeofho"tel occupant which travels the 1-81 cotridor. Under my client's calculations, this would result in a need to provide twenty eight (28) parking spaces for the twenty eight (28) rooms and an additional six (6) parking spaces which would provide additional parking for the office manager and the two (2) cleaning staff who are present for only a portion of the day, for a total of thirty-four (34) parking spaces. If the Borough Council is willing to consider such an amendment to the zoning ordinance, we would ask that we be provided an opportunity to submit a.n actual draft amendment and welcome your ínput prior to its submission. Obviously, my client realizes he would be expected to reimburse the Borough for its professional fees and costs associated with implementing an amendment. Please provide me with a scale of fees to be paid in the event the Borough is willing to consider an amendm,ent to the zoning ordinance. Myers. Following a zoning meeting on February 22, 2006 I submitted the enclosed suggested amendment which I believe Mr. Myers has forwarded to you. My client and I are hopeful that the Borough Planning Commission will recommend the adoption of the amendment to the Greencastle Borough Council. Detached commercial and industrial uses [Amended 1-3-1995 by Ord. No. 1995-2] shall be amended as follows: A.
