Dear Mr. Brookens;
The Franklin County Planning Commission staff has reviewed the proposed zoning change
request by Charles R. Roman c/o Earthnet, LLC. We are in agreement with the change of the
approximately 4 acres of land on S.R. 433 Sunset Pike from light industrial to highway
commercial. We recommend disaproval though to the change of the 62 acres from light
industrial to medium density. The proposed zoning change is inconsistent with the Franklin
County Comprehensive Plan.

Dear Mr. McNew:
The Department hereby approves the December 27, 2006 document titled "Final Report," for the
property located at 4369 Sunset Pike in Greene Township, Franklin County. This report was amended on
April 16, 2007. The report was prepared by Skelly and Loy, Inc. and submitted to the Department in
accordance with the Land Recycling and Environmental Remediation Standards Act (Act 2) and
constitutes a "Final Report" as defined in Chapter 3 of Act 2.
A Final Report summary is enclosed that describes the area(s) of the property characterized,
contaminants identified, remediation perfonned, and standards attained, A figure depicting the areal
extent and the reference coordinates of the site(s) remediated is included, The Department approves this
report for the substances identified and remediated to an Act 2 standard within the site(s) specified, This
report was reviewed by or under the supervision of a Pennsylvania licensed. professional geologist.
Chapter 5, Section 501 of Act 2, provides the liability protection where attainment of Act 2
cleanup standards is demonstrated. Cleanup liability protection provided by this chapter applies to the
current and future owner or any other person who participated in the remediation; a person who
develops or occupies the site; successor or assign of any person to whom liability protection applies; and
public utility to the elttent the public utility performs activities on the identified site,
The subject property is a 62-acre tract oflargely undeveloped land. A portion of the property
was used fOf salvage/storage of Army surplus materials in conjunction with the Army Surplus Store on
site, Arsenic impacted soil was detected at two debris pile locations during site characterization
activities consisting of a geophysical investigation, a soil boring investigation, and a test pit
investigation,

Subs.equent to the excavation of 192.57 tons of soil at Area #1, and the excavation and
reinsertion of soils at Area #2, the residential statewide health standard and site-specific standard was
achieved for arsenic in surface and subsurface soils, respectively.
While pillllacled bedrock was intercepted during the excavation process, groundwater was not
encountered. Soil to groundwater pathway thresholds were upheld for arsenic in the area of impact.
Although remediation under Act 2 is now complete for this site, you are advised that any future
earth disturbance or development may require either approvals or permits from the appropriate CO\.U1ty
soil conservation district. Therefore, you should contact the conservation district before engaging in any
such activities.

Your efforts are helping to return land to productive use and prevent the needless loss of greenspace
across the Commonwealth,

This notice is to inform the Planning Commission of a application received by the Greene
Twp. Supervisors for a zoning map change amendment. The request was submitted by
Charles R. Roman and the Virginia A. Roman Estate, 4369 Sunset Pike, Chambersburg
c/o Earthnet, LLC 95. Brim Boulevard, Chambersburg.
The applicants are requesting a Zoning Map Change Amendment for approximately 66
acres of property on Sunset Pike. The property is currently zoned as L-I Light Industrial
District and they are requesting approx. 62 acres be rezoned to R-2 Medium Density
Residential District and approx. 4 acres be rezoned to H-C Highway Commercial District
(shown on attached sketch plan).
The required public hearing on this request has been scheduled before the Greene
Township Supervisors for Tuesday evening, June 26, 2007 at 7:00 p.m. here at the
Greene Township Building Meeting Room, Scotland. Your comments on this proposed
rezoning request would be appreciated prior to the hearing date. If you have any
questions regarding this matter, please give Travis or Dan a call.
