Please be advised that Washington Township has received the following zoning
map amendment request:
RZ06-003: LL T Partners, LLC/Avalon Park - 2 acres on Polktown Road.
Rezone 2 acres from Commercial (C) to Medium Density
Residential (R-2). Property is presently zoned Commercial and is
within 1,000 feet of existing public water and sewer lines.
Please provide comments on this rezoning. The Township Supervisors will have
a public hearing on this proposed change in March or April 2006.
It has been noted that this rezoning amendment is inconsistent with the current
Comprehensive Plan for Washington Township.

ADDENDUM TO APPLICATION
ZONING MAP AMENDMENT
LLT PARTNERS LLC
WASHINGTON TOWNSHIP

This addendum accompanies the application of LL T Partners LLC for the property known as the
Tennis Club remnant and a portion in the southwest comer of the tract found on the Washington
Township Tax Map Q5-106, along Polktown Road (S.R. 2005), and 450 feet from the
intersection with PA Route 16. This property was originally zoned "R-2" in the 1990's, and
converted to a "c" district. It is requested that this property consisting of 2.89 Acres be returned
to "R-2". It is situated behind the Tennis Club, and located adjacent to the Hawkstone
Subdivision. It is found between seven homes on the west side and three homes on the east side.
There are businesses on Route 16 and across the street on Polktown Road, namely Frank's Pizza,
Walker's Home Remodeling Business and Bingaman's Auto Radiator Service (the latter two
businesses are home occupations). There is also a mobile home park (Pleasant View) at the
intersection of Polktown Road and Hawkcrest Drive on the east side.
An intense commercial zone is incompatible with the predominant residential character of the
neighborhood. Residential development guidelines also favor the site's topographic features,
drainage patterns, indigenous soils, geology and vegetative cover. A proposed townhouse
project would be quite suitable for this property. Therefore, the zoning district should be
changed from "c" to "R-2" in accordance with Section 1900 of the Washington Township
Zoning Ordinance. It does not adversely impact public service facilities. It also provides
regional housing needs. The property is suitable for a maximum of 21 townhouse units, a play
area and a stormwater basin including garages, driveways, curbs, sidewalks, grassed channels
and landscape trees. It is being designed to facilitate smooth, safe traffic flow onto and off the
site. With common yards and permanent open space, it can also be designed in an
environmentally sensitive manner. As a result, re-zoning this property would be very
appropriate and beneficial to thè community.
The parcel of land is impractical for commercial development due to its topographic character
ranging from 7 to 11 percent slope. It is surrounded on two sides by the "R-2" district and two
sides by the "c" district. Regarding the site, there will be stonnwater runoff infiltration in
shallow, matted, grass-covered channels and detention in an on-site basin eliminating drainage
from crossing Polktown Road. Proposed grading, stormwater management and Soil Erosion and
Sedimentation Control Plans have been submitted to your Engineer, Martin and Martin Inc. for
review and comments. No additional runoff, actually less, will be generated from development
of this site. Also cleaner and slower flows will be determined according to our design. This will
be coordinated with Franklin County Conservation District.

We are proposing only 10 percent building area and another 25 percent impervious area
consistent with the R-2 district. We are leaving 65 percent in open space, while the "C" district
only requires 1 0 percent in lawns and landscaping. The "R-2" district allows condominium
townhouse dwellings not exceeding 3 stories in height and 6 units per structure, which cannot be
instituted in the "C" district. Rezoning this site is consistent with Township and County
planning. We request this zoning map amendment, and eight copies of our Sketch Plan are being
submitted for your review and action. A legal description of the property, and Martin and
Martin, Inc.'s report are being attached to enhance our request. No other objections were voiced
at the November public hearing. If favorable for this zoning map amendment, a Subdivision and
Land Development Plan will be forthcoming soon afterward.

ORDINANCE NO.
AN ORDINANCE
OF THE BOARD OF SUPERVISORS OF WASHINGTON
TOWNSHIP, FRANKLIN COUNTY, PENNSYLVANIA,
AMENDING THE WASHINGTON TOWNSHIP ZONING
ORDINANCE.
WHEREAS, the Board of Supervisors of Washington Township, Franklin County,
Pennsylvania, adopted on April 2, 2001, Washington Township Ordinance No. 153, known
as the Washington Township Zoning Ordinance and thereafter as amended; and
WHEREAS, the Board of Supervisors of Washington Township deems it to be in the
interest and welfare of the residents of the Township to amend the Washington Township
Zoning Ordinance by altering the Washington Township Zoning Map as described below
and as shown on the attached map.
NOW, THEREFORE, by the authority of and pursuant to the provisions of Article V
of Act No. 247, as amended, of the General Assembly of the Commonwealth of
Pennsylvania, approved July 31, 1968, known as, and cited as the "Pennsylvania
Municipalities Planning Code"; and any amendments and supplements thereby, amending
Ordinance No. 153, adopted by the Board of Supervisors of Washington Township on April
2nd, 2001, and known as the Washington Township Zoning Ordinance, be it enacted and
ordained by the Board of Supervisors of Washington Township, Franklin County,
Pennsylvania, that the Zoning Map of the Township adopted pursuant to Ordinance No.
153, known as the Washington Township Zoning Ordinance be revised and Ordinance No.
153 is hereby amended as follows:
ARTICLE 1. LL T Partners, LLC, property located at 12065 Polktown Road. The
zoning shall be changed from Commercial (C) to Medium Density Residential (R-2) for
2.88836 acres of land owned by LL T Partners, LLC. Description of the property is as
follows:
Beginning at a point in the center of Polktown Road (S.R. 2005) located at corner of
Lands herein described and lands of Donovan C. Carbaugh; thence along lands of
Donovan C. Carbaugh north 62 degrees 17 minutes 03 seconds west, a distance of
261.50 feet to a point; thence along lands of Eugene S. Albert, Jr., and Ronnie E. Kline,
lands of Dennis J. and Jenny T. Hinojos, lands of James L. Lowe, III, and Erin M. Smith
and lands of LL T Partners, LLC, north 39 degrees 56 minutes 57 seconds east, a distance
of 401.02 feet to a point; thence along lands of LL T Partners, LLC, south 60 degrees 31
minutes 56 seconds east, a distance of 275.51 feet to a point; thence along the same by a
curve to the left having a radius of 25.00 feet, an arc length of 39.27 feet and a chord
bearing and distance of north 74 degrees 28 minutes 04 seconds east, a distance of 35.36
feet to a point; thence along the same south 60 degrees 31 minutes 56 seconds east, a
distance of 25.00 feet to a point in Polktown Road; thence through Polktown Road along

lands of James K. and Sandra A. Walker and along lands of Lloyd O. Bingaman south 29
degrees 28 minutes 04 seconds west, a distance of 189.12 feet to a point; thence
continuing through Polktown Road and along lands of Lloyd O. Bingaman south 61
degrees 53 minutes 32 seconds west, a distance of 182.59 feet to a point; thence
continuing through Polktown Road and along lands of Anthony W. and Rose M. Todd
south 59 degrees 23 minutes 12 seconds west, a distance of 78.56 feet to a point in the
center of Polktown Road (S.R. 2005) being the point of beginning.
ARTICLE 2. In all other respects, the provisions of Ordinance No. 153, as
amended, and the Washington Township Zoning Map, as amended, shall remain in full
force and effect.
ARTICLE 3. If any article, section or provision of this Ordinance should be decided
by the courts to be unconstitutional or invalid, such decision shall not affect the validity of
this Ordinance as a whole or any part thereof other than the part so decided to be
unconstitutional or invalid.
ARTICLE 4. This ordinance shall take effect five (5) days after its enactment.

session duly assembled.

RESOLUTION NO.
OF THE BOARD OF SUPERVISORS OF THIS TOWNSHIP
AMENDING THE 1999 WASHINGTON TOWNSHIP
COMPREHENSIVE PLAN.
WHEREAS, on February 17, 1999, the Washington Township Supervisors
adopted an updated Comprehensive Plan; and
WHEREAS, recent amendments to the Pennsylvania Municipal Planning code
require the Township's Comprehensive Plan to be generally consistent with the
Township's Zoning Ordinance; and
WHEREAS, the Township has received an application to rezone approximately
2.9 acres of land currently zoned C to R-2; and
WHEREAS, the Township desires to keep the Comprehensive Plan consistent
with the Zoning Ordinance by amending the Comprehensive Plan to mirror the
requested zoning changes.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of this
Township, as follows:
Section 1. Amends the Future Commercial & Industrial Land Use Plan, M13;
the Future Residential Land Use Plan, M14; and the Comprehensive Land Use Plan,
M16, to reflect the following residential and commercial zoning changes:
The LL T Partners, LLC, property located at 12065 Polktown Road - change 2.888 acres
from Commercial (C) to Medium Density Residential (R-2).
DULY RESOLVED, this day of 2006 by the Board of
Supervisors of Washington Township, Franklin County, Pennsylvania, in lawful session
