Please be advised that Washington Township has received the following zoning
map amendment request. The first application was denied by the Supervisors in
September. The applicant is reapplying with the same request.

Please provide comments on this rezoning request and the enclosed ordinance.
The Washington Township Planning Commission will review this change at their
November 10,2008 meeting, and the Township Supervisors will have a public hearing
on the proposed changes in December 2008.

ORDINANCE NO.
AN ORDINANCE
OF THE BOARD OF SUPERVISORS OF WASHINGTON
TOWNSHIP, FRANKLIN COUNTY, PENNSYLVANIA,
AMENDING THE WASHINGTON TOWNSHIP ZONING
ORDINANCE.
WHEREAS, the Board of Supervisors of Washington Township, Franklin County,
Pennsylvania, adopted on April 2, 2001, Washington Township Ordinance No. 153, known
as the Washington Township Zoning Ordinance and thereafter as amended; and
WHEREAS, the Board of Supervisors of Washington Township deems it to be in the
interest and welfare of the residents of the Township to amend the Washington Township
Zoning Ordinance by altering the Washington Township Zoning Map as described below
and as shown on the attached map.
NOW, THEREFORE, by the authority of and pursuant to the provisions of Article V
of Act No. 247, as amended, of the General Assembly of the Commonwealth of
Pennsylvania, approved July 31, 1968, known as, and cited as the "Pennsylvania
Municipalities Planning Code"; and any amendments and supplements thereby, amending
Ordinance No. 153, adopted by the Board of Supervisors of Washington Township on April
2nd, 2001, and known as the Washington Township Zoning Ordinance, be it enacted and
ordained by the Board of Supervisors of Washington Township, Franklin County,
Pennsylvania, that the Zoning Map of the Township adopted pursuant to Ordinance No.
153, known as the Washington Township Zoning Ordinance be revised and Ordinance No.
153 is hereby amended as follows:
ARTICLE 1. The zoning of the D. Curtis and Julia A. Mummert property located at
the rear of 13138 Midvale Road, containing 0.6025 acres, shall be changed from Low
Density Residential (R-1) to Commercial (C). The description of the property and the
zoning change is as follows:
Section 1. BEGINNING at a spike in the center of State Route 2007, at a
corner of lands now or formerly of Mullenix; thence with the center line of State Route
2007, North 44 degrees 55 minutes 07 seconds East 84.54 feet to a spike; thence by
lands now or formerly of Hebb and Delauter through an existing iron pin, South 41
degrees 08 minutes 08 seconds East 175 feet to a set iron pin; thence by lands now or
formerly of Delauter, South 41 degrees 45 minutes 02 seconds East 27.70 feet to a set
iron pin; thence along lands now or formerly of Hebb, South 31 degrees 48 minutes 50
seconds West 69.47 feet to a set iron pin; thence along lands now or formerly of Wayne
L. & Alice J. Fisher, North 46 degrees 22 minutes 31 seconds West 200 feet to a set iron
pin; thence by lands now or formerly of Mullenix, North 45 degrees 48 minutes 20
seconds West 170 feet to a spike in the center of State Route 2007, the place of
beginning; being Lot #1 on a plan of lots prepared by R. Lee Royer, R.S., dated March

1980, approved by the Washington Township Board of Supervisors on April 21, 1980,
and recorded in Franklin County Deed Book Volume 814, Page 345,
Section 2. BEGINNING at a set iron pin at the southeast corner of lands owned
now or formerly owned by D. Curtis and Julia A. Mummert, being Lot 1 described in
Section 1, thence South 41 degrees 45 minutes, 02 seconds East 184.50 feet to an
existing iron pin; thence along lands now or formerly of the First Baptist Church of
Waynesboro South 41 degrees 07 minutes 34 seconds West 53.17 feet to an existing iron
pin; thence continuing along lands of the First Baptist Church of Waynesboro North 46
degrees 22 minutes 31 seconds West 172.00 feet to a set iron pin; thence along lands now
or formerly of Carl Summers North 31 degrees 48 minutes 50 seconds East 69.47 feet to a
set iron pipe, the place of beginning; being Lot #2 on a plan of Lots prepared by R. Lee
Royer, R.S. Dated March 1980, approved by the Washington Township Board of
Supervisors on April 21, 1980, and recorded in Franklin County Deed Book Volume 814,
Page 345.
ARTICLE 2. In all other respects, the provisions of Ordinance No. 153, as
amended, and the Washington Township Zoning Map, as amended, shall remain in full
force and effect.
ARTICLE 3. If any article, section or provision of this Ordinance should be decided
by the courts to be unconstitutional or invalid, such decision shall not affect the validity of
this Ordinance as a whole or any part thereof other than the part so decided to be
unconstitutional or invalid.
ARTICLE 4. This ordinance shall take effect five (5) days after its enactment.

Supervisors of Washington Township, Franklin County, Pennsylvania, in lawful session
duly assembled.

RESOLUTION NO.
OF THE BOARD OF SUPERVISORS OF THIS TOWNSHIP
AMENDING THE 1999 WASHINGTON TOWNSHIP
COMPREHENSIVE PLAN.
WHEREAS, on February 17, 1999, the Washington Township Supervisors
adopted an updated Comprehensive Plan; and
WHEREAS, recent amendments to the Pennsylvania Municipal Planning code
require the Township's Comprehensive Plan to be generally consistent with the
Township's Zoning Ordinance; and
WHEREAS, the Township has received an application to rezone 0.6025 acres of
land currently zoned Low Density Residential (R-1); and
WHEREAS, the Township desires to keep the Comprehensive Plan consistent
with the Zoning Ordinance by amending the Comprehensive Plan to mirror the
requested zoning changes.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of this
Township, as follows:
Section 1. Amends the Future Commercial & Industrial Land Use Plan, M13,
Future Residential Land Use Plan, M14, and the Comprehensive Land Use Plan, M16,
to reflect the following residential zoning changes:
The D. Curtis and Julia A. Mummert, property at 13138 Midvale Road, from Low Desitity
Residential (R-1) to Commercial (C).
