amendment request:
1. RZ08-003, Donald E. Zody: from medium density residential (R-2) to
commercial (C)
Please review and provide comments on this rezoning request and the enclosed
ordinance. The Washington Township Planning Commission will review this change at
their January 12,2009 meeting and the Township Supervisors will have a public hearing
on the proposed changes in either late January or February of2009.

ORDINANCE NO.
AN ORDINANCE
OF THE BOARD OF SUPERVISORS OF WASHINGTON
TOWNSHIP, FRANKLIN COUNTY, PENNSYLVANIA, AMENDING
THE WASHINGTON TOWNSHIP ZONING ORDINANACE.
WHEREAS, the Board of Supervisors of Washington Township, Franklin County,
Pennsylvania, adopted on April 2, 2001, Washington Township Ordinance No, 153,
known as the Washington Township Zoning Ordinance and thereafter as amended; and
WHEREAS, the Board of Supervisors of Washington Township deems it to be in
the interest and welfare of the residents of the Township to amend the Washington
Township Zoning Ordinance by altering the Washington Township Zoning Map as
described below and as shown on the attached map.
NOW, THEREFORE, by the authority of an pursuant to the provisions of Article V
of Act No. 247, as amended, of the General Assembly of the Commonwealth of
Pennsylvania, approved July 31, 1968, known as, and cited as the "Pennsylvania
Municipalities Planning Code"; and any amendments and supplements thereby,
amending Ordinance No. 153, adopted by the Board of Supervisors of Washington
Township on April 2nd, 2001, and known as the Washington Township Zoning
Ordinance, be it enacted and ordained by the Board of Supervisors of Washington
Township, Franklin County, Pennsylvania, that the Zoning Map of the Township
adopted pursuant to Ordinance No. 153, known as the Washington Township Zoning
Ordinance be revised and Ordinance No. 153 is hereby amended as follows:
ARTICLE 1. The zoning of the Donald E. Zody property located in the rear of the
Donald E. Zody property at 11737 Wharf Road, containing 6.98 acres, shall be changed
from Low Density Residential (R-1) and Medium Density Residential (R-2) to
Commercial (C). The description of the property and the zoning change is as follows:
Section 1. BEGINNING at a rebar and cap set South 46 degrees 04
minutes 36 seconds East, 90 feet from a 40-inch white oak tree, which is a boundary
corner of other lands of Donald E. Zody, Franklin County deed book 1142, page 519,
and Franklin County deed book 996, page 297. Thence along other lands of Donald E.
Zody South 46 degrees 04 minutes 36 seconds East, 617.85 feet to a point. Thence
along the lands of Kristan A. Zody South 40 degrees 02 minutes 51 seconds West,
87.03 feet to a point. Thence along other commercial zoned lands of Donald E. Zody
and running 300 feet parallel to Wharf Road (T-340) South 40 degrees 02 minutes 51
seconds West, 719.11 feet to a point. Thence along other lands of Donald E. Zody
North 72 degrees 01 minutes 00 seconds West, 30.07 feet to a point. Thence along
lands of Douglas Zody North 18 degrees 00 minutes 00 seconds East, 90,14 feet to an
iron pipe found. Thence along lands of Douglas Zody North 51 degrees 58 minutes 38
seconds West, 53,22 feet to a rebar found at post. Thence by the same North 51
degrees 58 minutes 38 seconds West, 50 feet to a rebar and cap set. Thence though
lands of Donald E. Zody North 07 degrees 58 minutes 04 seconds East, 664,53 feet to
a rebar and cap set. Thence through lands of Donald E. Zody North 27 degrees 19
minutes 03 seconds East, 218.17 feet to a rebar and cap set and point of beginning,
Containing 6.9838 acres, according to a survey by Dennis E, Kauffman, P,L.S, dated
October 17, 2008,
ARTICLE 2. In all other respects, the provisions of the Ordinance No, 153, as
amended, and the Washington Township Zoning Map, as amended, shall remain in full
force and effect.
ARTICLE 3. If any article, section or provision of this Ordinance should be
decided by the courts to be unconstitutional or invalid, such decision shall not affect the
validity of this Ordinance as a whole or any part thereof other than the part so decided
to be unconstitutional of invalid.
ARTICLE 4. This ordinance shall take effect five (5) days after its enactment.
DULY ENACTED AND ORDAINED this _ day of 2009, by the
Board of Supervisors of Washington Township, Franklin County, Pennsylvania, in lawful
session duly assembled.
