Amount of plan copies to submit for review from 12 to 15. 2. Submission of plans from 10 days to 30 days. 3. Provision requiring Water and Sewer Main Extension Agreements to be approved prior to final approval by the Borough Authority. AN ORDINANCE OF THE BOROUGH OF WA YNESBORO, FRANKLIN COUNTY, PENNSYLVANIA, AMENDING THE SUBDIVISION AND LAND DEVELOPMENT ORDINANCE OF THE BOROUGH OF WA YNESBORO BE IT ENACTED AND ORDAINED, by the Mayor and Borough Council of the Borough of Waynesboro, Franklin County, Pennsylvania, and it is enacted and ordained as follows: SECTION I: The Subdivision and Land Development Ordinance of the Borough of Waynesboro, Article III thereof, subsection 1-2, is hereby amended, so that Article 111-1-2 shall read: ~ Fifteen (15) copies of a completed Sketch Plat should be submitted. SECTION II: The Subdivision and Land Development Ordinance of the Borough of Waynesbofo, Article III thereof, subsection 2-1, is hereby amended, so that Article 111-2-1 shall read: 11. Within thirty (30) days of receipt, the sketch plat maps and materials shall be submitted by the Director of Borough Engineering to the Borough Planning Commission, which will review the sketch plat at its next regular meeting, provided that submission to the Director of Borough Engineering occurs no less than thirty (30) days prior to such scheduled meeting. SECTION III: The Subdivision and Land Development Ordinance of the Borough of Waynesboro, Article IV thereof, subsection 1-3, is hereby amended, so that Article IV-1-3 shall read: Official submission of a preliminary plat to the Director of Borough Engineering shall comprise submitting the following information no less than thirty (30) days priorto a regularly scheduled Planning Commission meeting: (1) Submission of one (1) copy of a completed preliminary subdivision or land development application, and the appropriate submission fee. (2) Submission of fifteen (15) paper prints of the preliminary plat, which shall fully comply with provisions of this ordinance as set forth in Section IV-3. (3) Submission of three (3) copies of all required supplemental information as set forth in Section IV-3. (4) The Director of Engineering shall retain one (1) copy of the application, one (1) plat print and one (1) copy of the supplemental information. He shall then submit one (1) copy of the application, four (4) plat prints and one (1) copy of the supplemental information to the Franklin County Planning Commission; and one (1) copy of the application, one (1) plat print and one (1) copy of the supplemental information to each of the members of the Borough Planning Commission, each Councilman, the Zoning Enforcement Officer and the Borough Solicitor for recommendations as to changes, alterations and modifications. (5) Additional prints of the preliminary plat shall be submitted to the respective agencies in each of the following circumstances: a. Whenever the property being subdivided or developed abuts a State Legislative Route, one (1) print of the preliminary plat shall be submitted to the Pennsylvania Department of Transportation. b. Whenever a proposed subdivision or land development is located in more than one municipality or located adjacent to another municipality, one (1) print of the preliminary plat shall be submitted for each municipality. c. Whenever required, one (1) print shall be submitted to utility companies, Soil Conservation District and/or Pennsylvania Department of Environmental Protection. SECTION IV: The Subdivision and Land Development Ordinance of the Borough of Waynesboro, Article IV thereof, subsection 3, is hereby amended to add a subsection 11 , so that Article IV-3-11 shall be added and shall read: The preliminary plat shall be accompanied by an approved application for water and/or sewer main extensions. SECTION V: The Subdivision and Land Development Ordinance of the Borough of Waynesboro, Article V thereof, subsection 1-6 is hereby amended, so that Article V-1-6 shall read: Official submission of a final plat to the Director of Borough Engineering shall comprise submitting the following information no less than thirty (30) days prior to a regularly scheduled Planning Commission meeting: (1) Submission of one (1) copy of a completed final subdivision or land development plat application, and the appropriate submission fee. (2) Submission of fifteen (15) paper prints of the final plat. (3) Submission of six (6) copies of all required supplemental information. (4) Submission of two (2) copies of all offers of dedication and covenants, governing the reservation and maintenance of undedicated open space, which shall bear the certificate of approval of the Borough Solicitor as to their legal sufficiency. (5) The Director of Engineering shall retain one (1) copy of the application, one (1) plat print, and one (1) copy of the supplemental information. He shall then submit one (1) copy of the application, four (4) plat prints and one (1) copy ofthe supplemental information to the Franklin County Planning Commission; and one (1) copy of the application, one (1) plat print and one (1) copy of the supplemental information, offers of dedication and covenants governing undedicated open space to each of the members of the Borough Planning Commission, each Councilman, the Zoning Enforcement Officer and the Borough Solicitor. SECTION VI: The Subdivision and Land Development Ordinance of the Borough of Waynesboro, Article V thereof, subsection 2-2(1) is hereby amended, so that Article V-2- 2( 1) shall read: When a final plat has been officially submitted, it shall be placed on the agenda of the Borough Planning Commis_sion for review at its next regular meeting, provided that such official submission to the Director of Borough Engineering has occurred no less than thirty (30) days prior to such regular meeting. The Planning Commission may hold a public hearing at this time if the final plat departs substantially from the preliminary plat. SECTION VII: The Subdivision and Land Development Ordinance of the Borough of Waynesboro, Article V thereof, subsection 3, is hereby amended to add a subsection 15, so that Article V-3-15 shall be added and shall read: The final plat shall be accompanied by approved water and/or sewer main extension agreements. SECTION VIII: Repealer. All provisions of previous ordinances of the Borough of Waynesboro, which are contrary to this ordinance, are expressly repealed. SECTION IX: Savings Clause. In all other respects, the Subdivision and Land Development Ordinance of the Borough of Waynesboro shall remain as previously enacted and ordained. SECTION X: Effective Date. This ordinance shall take effect sixty (60) days from the date of enactment. ENACTED, ORDAINED AND APPROVED this day of ,2007.
