Tarquino, Planning Director Franklin County Planning Commission Administrative Annex 218 North Second Street Chambersburg, PA 17201 Re: Proposed Rezoning Dear Mr. Tarquino: The Borough of Waynesboro is considering a proposed amendment to Zoning Ordinance No. 937 establishing a new zoning district known as the Downtown Business District "DBD". This new zone will be within the current Town Center District and encompass an area of approximately 37.30 acres. The zone will be from Grant Street eastward to Broad Street and northward to Alley # 1 North and southward to Gay Street. The purpose of this new zoning district is to establish guidelines for new building construction and to maintain the integrity of the downtown area. I have enclosed a copy of proposed Ordinance No. 1040 and a Zoning Map indicating the new Downtown Business District for your review. Sincerely, Engineering Services ORDINANCE NO. 1040 AN ORDINANCE AMENDING ORDINANCE NO. 937, THE WAYNESBORO ZONING ORDINANCE, ADOPTED DECEMBER 4, 1991, AS AMENDED. Be enacted and ordained by the Borough Council of the Borough of Waynesboro, Pennsylvania, and it is hereby enacted and ordained by the authority of the same: Ordinance No. 937 is hereby amended to include the following: ARTICLE V Zone Districts and Permitted Uses 28. DBD - DOWNTOWN BUISNESS DISTRICT. The purpose of this district is to preserve and protect the visual continuity and general aesthetics of the downtown business area; to encourage the utilization of land and the harmonious design, erection and use of the buildings to maintain linear arrangement with existing buildings; and to provide for professional and business offices, retail sales and commercial services in a diversified downtown business district. 29. Use regulations. A. Uses by right. 1. Retail sales and services. 2. Governmental structures and facilities. 3. Civic and cultural facilities, indoor theaters. 4. Eating and drinking places, not including drive-in service places. 5. Business or administrative or corporate offices for public agencies, profit organization, or private corporations. 6. Professional offices. 7. Business offices. 8. Banks and other financial institutions, not including drive-in service places. 9. Passenger terminals, including taxi stands and bus stations. 10. Houses of worship and related religious facilities. 11. Commercial schools. 12. Membership clubs and fraternal organizations. 13. Multi-family dwellings above the first floor of commercial uses. 14. Funeral homes. 15. Home occupations and home professional offices. 16. Licensed Group Home Dwelling. B. Special exception uses. 1 . Eating and drinking places, which include drive-in services. 2. Banks and other financial institutions, which provide drive-in services. 3. Other uses permitted in this District where drive-in services are provided. 4. Hotels, motels and motor inns. 5. Parking lots and parking structures. 6. Automobile Repair Garages. 7. Day Care Centers. 8. Bed and Breakfast. C. Conditional uses. 1. Planned Downtown Center Development, per Article VII. D. Accessory uses. 1 . Any use, which is entirely incidental and subordinate to the above permitted uses and is located on the same lot or parcel. E. Prohibited uses. Health club, health spa and exercise studio any of which conduct their activities in such a manner as to appeal to the prurient interest without any redeeming social value and massage parlor, massage studio, adult theater and an adult bookstore or similar establishments primarily showing films commonly denoted "adult films" or films having as a main or central theme any appeal to the prurient interest without any redeeming social value, said theaters hereinafter referred to as "adult theaters, or any bookstore primarily engaged in the sale of books commonly denoted "adult books" or books having as a main or central theme any appeal to the prurient interest without any redeeming social value, said bookstores hereinafter being referred to as "adult bookstores" shall be prohibited.
