§ 38-1. Definitions.
For the purposes of this chapter, the following definitions
shall have the meanings indicated:
DURATION— Any burn ban imposed under this
ordinance shall remain in effect until it has been
canceled by the Saint Thomas Township Emergency
Management Coordinator after obtaining approval from
the Chairman of the Board of Supervisors.
OPEN BURNING—Ignition and subsequent burning of
any combustible material out-of-doors in either a burn
barrel (screened or unscreened), fire rings, or on the
ground. The use of propane or gas stoves, charcoal grills,
or use of tobacco in any form, is not covered under this
definition.

§ 38-2. Authority to impose burn ban.
The Saint Thomas Township Emergency Management
Coordinator and the Chairman of the Saint Thomas Township
Board of Supervisors shall have the authority to impose a ban
on open burning when they determine that such a ban is
necessary for the health, safety and welfare of the people of
Saint Thomas Township.
§ 38-3. Notice.
Any burning ban imposed under this chapter shall take effect
48 hours after the ban has been advertised by newspaper,radio
and television channel of general circulation within the
township.
§ 384. Prohibited open burning.
Upon commencement of the burning ban all open burning as
defined in this chapter shall be prohibited within the township.
Controlled burns shall be permitted during a ban after
receiving written approval from the Chairman of the Saint
Thomas Township Board of Supervisors.
§ 38-5. Violations and penalties.
This chapter shall be enforced by an action brought before a
District Justice in the same manner provided for the enforce-
ment of summary offenses under the Pennsylvania Rules of
Criminal Procedure. Any person who violates or permits a
violation of this chapter shall, upon conviction in a summary
proceeding, be punishable by a fine of not more than $100 for
the first offense, $200 for the second offense and $300 for the
third offense.

§ 38-6. Enforcement.
The Saint Thomas Township Code Enforcement Officer and
any police officer having jurisdiction within the township shall
be responsible for enforcing the provisions of this chapter.
