Reserve capacity for Nursing Home Rehabilitation placements: Waiver slots could be held for up to 180 days when an individual temporarily enters a Nursing Home. If an individual is in a 6400 or 6500 license home it will be up to the provider if they hold that residential slot for the individual. The question was asked can a residential provider change the program capacity for the home while the individual is in the NH. Example would be a 3 person home would be changed to a 2 person home. Here’s the answer from ODP, “No, they can’t do that. They can use the empty bed for respite, but they cannot temporarily decrease the approved program capacity while a person is temporarily in a NH”. 2. Emergency respite in a 6400 home beyond the program capacity: All emergency respite beyond 6400 program capacity homes need to have prior approval by ODP, before the respite can take place. Providers need to reference Informational Packet 066-12 “Providing emergency respite above a home’s approved program capacity” located on the ODP consulting website. 3.
