TUESDAY, JANUARY 8, 2013
The Franklin County Commissioners met Tuesday, January 8, 2013, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance proceeded with the business of the day.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to adopt the agenda.
Kim Wertz provided public comment and asked if the County is going to help
M.H.A. in light of the Sandybrook Elementary incident because there needs to be a
better early intervention program to help those people that are suffering some type of
mental health issue to catch them before they go over the deep end. Ms. Wertz also
asked if there are any guidelines to put an inmate into some type of halfway house when
they are released from the jail because she had an issue with an ex-inmate in her
apartment building.
The minutes of January 3, 2013 meeting were reviewed. These will be approved
Thursday, January 10, 2013.
The Board reviewed Agreements, Contracts and Reports. Commissioner
Thomas explained that board action items #7 & 8 are apartments for individuals being
released from the jail and if they don’t behave then they are put back in jail.
Commissioner Thomas asked if the three conflict attorney contracts are normally three
year contracts. Mr. Hart responded that always have done a two or three year contract
in the past but only did a one year contract last year, moving back to a three year
contract this year. The following items were approved today and the remainder items
will be approved Thursday, January 10, 2013.
The Board reviewed Courts matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved the contract between the County
of Franklin and Kulla, Barkdoll & Associates, P.C. to perform the duties of conflicts
attorney for Franklin County at a starting rate of $53,000.00 and will increase 3% each
year with a rate of $54,590.00 for the year 2014 and a rate of $56,227.70 for the year
2015. The contract will be reimbursed for printing costs not to exceed $100.00, per
case. Printing costs over $100.00, per case, will require a Court Order. In cases which
go to trial, the Contractor will be paid at the rate of $65.00 per hour including all time
after the pre-trial conference with the Court. This contract is for the period of January 1,
2013 through December 31, 2015.

between the County of Franklin and James K. Reed, P.A. to perform the duties of
conflicts attorney for Franklin County at a starting rate of $53,000.00 and will increase
3% each year with a rate of $54,590.00 for the year 2014 and a rate of $56,227.70 for
the year 2015. The contract will be reimbursed for printing costs not to exceed $100.00,

conflicts attorney for Franklin County at a starting rate of $53,000.00 and will increase
3% each year with a rate of $54,590.00 for the year 2014 and a rate of $56,227.70 for
the year 2015. The contract will be reimbursed for printing costs not to exceed $100.00,
per case. Printing costs over $100.00, per case, will require a Court Order. In cases
which go to trial, the Contractor will be paid at the rate of $65.00 per hour including all
time after the pre-trial conference with the Court. This contract is for the period of
January 1, 2013 through December 31, 2015.
The Board reviewed Grants Management matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Lease Extension
Agreement between the County of Franklin and Johnson Road Properties, LLC for rental
of a unit as part of the reentry pilot program for participants lacking a 90 day home plan
which will reduce recidivism by supporting eligible offenders and in time will lower the
jail’s cost as these clients cycle out of the county jail. This agreement is at a cost of
$6,540.00 for the period of January 1, 2013 through December 31, 2013.
The Board reviewed additional Grants Management matters. On a motion by
Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Lease
Extension Agreement between the County of Franklin and Rossi Realty of
Chambersburg LP to lease a one-bedroom unit in the Borough of Chambersburg as part
of the re-entry pilot program for inmates released from jail with no approved home plan
while providing community support and treatment, for the period of January 1, 2013
through December 31, 2013, in the amount of $6,600.00.
The Board requested to go into an executive session to discuss real estate
transaction matters which there will be no action taken after the executive session and
also announced it could be a lengthy session. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved to enter an executive session at
9:44 a.m. this date for the purpose to review real estate transaction matters. The Board
reconvened into regular session at 11:45 a.m.
The meeting was adjourned at 11:45 a.m. with a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas.
