The Franklin County Commissioners met Thursday, June 27, 2013, with the
following members present: David S. Keller and Robert G. Ziobrowski. Chairman Keller
presided and after calling the meeting to order, a Moment of Silence, and the Pledge of
Allegiance proceeded with the business of the day.
On a motion by Robert G. Ziobrowski, seconded by David S. Keller; unanimously
approved to adopt the agenda.
Sheri Morgan provided public comment to inform the Board of an online petition
and Facebook page titled "Keep Our Nursing Home Ours" and they should be receiving
comments by email about the sale of the nursing home.
On a motion by Robert G. Ziobrowski, seconded by David S. Keller; unanimously
approved all bills presented and ordered paid.
On a motion by Robert G. Ziobrowski, seconded by David S. Keller; unanimously
approved the minutes of June 18, 2013 and June 20, 2013 meetings.
The Board reviewed Aging matters. On a motion by Robert G. Ziobrowski,
seconded by David S. Keller; unanimously approved the Amendment to the Title XIX
Medicaid Waiver Grant Agreement changing the payee from the Department of Aging to
Department of Public Welfare (DPW) at the State level. Title XIX covers DPW funded
programs including Nursing Home Transition. This amendment is to update the
agreement to allow Department of Public Welfare to make payments.
The Board reviewed Commissioners matters. On a motion by Robert G.
Ziobrowski, seconded by David S. Keller; unanimously approved the agreement
between the County of Franklin and Susquehanna Group Advisors, Inc. to provide
consulting to prepare solicitation documents to assist the County in evaluating the
qualifications of potential purchasers of the Franklin County Nursing Home. Contract
term is June 13, 2013 to December 31, 2013 with a fee of 3.25% of the purchase price.
No compensation is due if Falling Spring is not sold. Contract can be terminated by
either party upon 30 days prior written notice.
The Board reviewed Emergency Services matters. On a motion by Robert G.
Ziobrowski, seconded by David S. Keller; unanimously approved the Haz -Mat
Emergency Response Preparedness Report for Calendar Year 2012, showing that Act
165 generated funds were expended according to prescribed standards within Act 165.
The Board reviewed Human Services matters. On a motion by Robert G.
Ziobrowski, seconded by David S. Keller; unanimously approved the amendment to the
contract between the County of Franklin and Amanda J. Black extending ending date
from June 30, 2013 to July 31, 2013. Contract is for LINK Coordinator, information and
referral services and other human services projects. This will enhance the ability to
provide Information and Referral services to the elderly and disabled population for the
County. All other terms and conditions of the original agreement will remain in full force
and effect.
The Board reviewed Human Services matters. On a motion by Robert G.
Ziobrowski, seconded by David S. Keller; unanimously approved the contract between
the County of Franklin and BOPIC to translate Human Services Information and Referral
documents into Spanish. Contract term is June 25, 2013 through December 31, 2013 at
a cost of $3,440.00 which is covered by HSDF (Human Services Block Grant). Three
quotes were received and this was the lowest qualified quote.

The Board reviewed Planning matters. On a motion by Robert G. Ziobrowski,
seconded by David S. Keller; unanimously approved the First Amendment to Contract
No. C000036496 is an extension to the FY2008 Community Development Block Grant
(CDBG) entitlement funding. The Department of Community and Economic
Development (DCED) has granted a one (1) year extension to complete the Quincy
Township - Furnace Road Water Line CDBG project. The aforementioned grant's
termination date will be moved from August 2013 to August 2014.
The Board reviewed Property Management /Commissioners' Office matters. On
a motion by Robert G. Ziobrowski, seconded by David S. Keller; unanimously approved
for the Chairman of the Board to execute the contract between the County of Franklin
and Universal Door & Specialties for the purchase of double exterior doors to the
basement boiler room in the commissioner's complex for a onetime cost of $879.46.
The Board reviewed additional Property Management/FSNRC matters. On a
motion by Robert G. Ziobrowski, seconded by David S. Keller; unanimously approved for
the Chairman of the Board to execute the contract between the County of Franklin and
TYCO /Simplex Grinnell for sprinkler testing and inspection of the wet /dry system and
backflow throughout the nursing home. On a motion by Robert G. Ziobrowski, seconded
by David S. Keller; unanimously approved for the Chairman of the Board to execute the
Contract term July 1, 2013 through June 30, 2015 at a cost of $2,884.00.
Mary Beth Shank, County Solicitor, met with the Board for them to consider a
resolution to reaffirm abolishment of Office of Jury Commissioner. Ms. Shank explained
that in May 2012 the Board passed a resolution to abolish the Office of Jury
Commissioner. In response to legislation that passed granting counties the authority to
do so. The Supreme Court of PA declared the law was unconstitutional as a violation of
the single subject provision of the Pennsylvania Constitution. Since that time Governor
Corbett signed into law Act 4 of 2013 that grants the Board of Commissioners the
authority to abolish the Office of Jury Commissioner. Ms. Shank met with Judge
Herman who affirmed the current make -up of the jury pool provides a representative
cross section of citizens who may be selected for jury duty in Franklin County.
On a motion by Robert G. Ziobrowski, seconded by David S. Keller; unanimously
approved Resolution #2013 -07, which is attached and made a part of these minutes, for
the purpose of reaffirming the abolishment of the Office of Jury Commissioner.
Commissioner Ziobrowski said he had earlier requested information from the
Court Administrator as to the duties and functions of the Jury Commissioners.
Technology in jury selection has reduced their jobs, through no fault of their own, to
roughly 50 hours per year of envelope stuffing. At a pay rate of over $10,000 per year,
that works out to over $200 per hour for clerical duties, which is why the Commissioners
again are acting to eliminate the positions.

WHEREAS, legislation granthig county commissioners i11 2A and third through eighth class eolintles the option to abolish

Commissioneis passed a resolution dated May 16, 2012 abolishing the office of jury commissioner effective January 1,
2014; and
Whereas the Supreme Coort of Pennsylvania subsequently ruled the law was unconstitutional as a violation of the single
subject provision of file Pennsylvania Constitution; and

way be deldincntal to the Court's efforts to obtain a diverse pool of jurors who will be capable of rendering fair and
impartial verdicts;" and
