The Franklin County Commissioners met Thursday, February 16, 2017, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the February 7, 2017 and February 9, 2017
meetings.
The Board reviewed Children & Youth matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the report to
Pennsylvania Department of Human Services showing expenses and revenues of Act
148 funding for July 1, 2016 through December 31, 2016. The total amount of the report
is $5,293,177.00 for 2016/2017 fiscal year.
The Board reviewed Commissioners Office matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved Resolution #2017-
01, authorizing the donation of personal property to a non-profit organization located in
Chambersburg, which is attached and made a part of these minutes.
The Board reviewed additional Commissioners Office matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the
amendment to the Conflicts Attorney Contract (dated January 7, 2016) between the
County of Franklin and Kulla, Barkdoll and Stewart, P.C. to provide Conflicts Attorney
services. This amendment is to include "or drug delivery resulting in death" into
paragraph eight. All other terms and conditions of the original contract dated January 7,
2016 will remain in full force and effect.
The Board reviewed additional Commissioners Office matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the

County of Franklin and Eric J. Weisbrod, Esquire to provide Conflicts Attorney services.
This amendment is to include "or drug delivery resulting in death" into paragraph eight.
All other terms and conditions of the original contract dated January 21, 2016 will remain
in full force and effect.
In accordance with PA Acts 14, 67, 68 and 127 notifications, Red Barn
Consulting, Inc. notified the County of a Pennsylvania Department of Environmental
Protection NPDES renewal Permit CAFO application being applied by Steve Hykes for a
property located in Greencastle, PA.

In accordance with PA Acts 14, 67, 68 and 127 notifications, Department of the
Army notified the County of a Pennsylvania Department of Environmental Protection Air
Quality Permit application being applied by Letterkenny Army Depot for a property
located in Greene Township.
Access to Franklin County's Radio System by Non Public Safety Entities
Access to Franklin County's Radio system traditionally has been limited to Public Safety Agencies. This
limitation helps ensure that the radio system is utilized for its primary intended purpose which is public
safety. It also helped to keep users and radio traffic at manageable levels so the system is available to
all authorized users as needed.
Franklin County also recognizes that radio access to a very limited number of non Public Safety Agencies
or users may be beneficial in emergency situations. Upon request, consideration will be given to
granting access to educational entities. In order to receive consideration,the educational entity must
offer a dormitory type of setting. Requests received from educational entities that do not offer a
dormitory setting will not be considered.
In accordance with PA Acts 14, 67, 68 and 127 notifications, William A. Brindle
Associates, Inc. notified the County of a Pennsylvania Department of Environmental
Protection NPDES renewal Permit application being applied by Shane C. Stouffer for a
property located in Greene Township.
John Hart, Chief Clerk, presented a request to provide radio access to the
County's radio system for an educational institution. He explained the radio system
traditionally has been limited to Public Safety Agencies. This limitation ensures that the
radio system is utilized for its primary intended purpose and to manage radio traffic. He
said Dave's Trucking was granted access to the system due to his company having the
heavy duty towing equipment to help in emergency situations. Mr. Hart said the
education entity has dormitory style living arrangements on their campus for their
students. He explained that Mont Alto College and Shippensburg University have law
enforcement on their campuses that have access to the radio system. Franklin County
school districts have their own law enforcement on their grounds that also have access
to the radio system. He is requesting to have a process in place that if the education
institutions have a dormitory type setting, the County could honor their request to be
added to the radio system. If they don't have a dormitory setting, then their request will
be denied. Commissioner Ziobrowski asked why not give access to anybody that might
have need for it. He asked why access is restricted and why taking this action to
establish some rules as to where we will allow it to go beyond restrictions normally. Mr.
Hart responded that the primary purpose is to manage radio traffic and keep the airways
open. There are numerous agency channels and talk groups. We try to limit traffic and
manage it so when there is an incident, our dispatchers are able to dispatch.
Commissioner Thomas thinks this is reasonable but it's important to point out that there
are multiple channels. He stated the Game Commission was not on the main police
channel and asked Mr. Hart if this was correct. Mr. Hart responded he could not answer
this question. When the dispatch channels were established a committee of interested
parties assisted in developing the talk groups and dispatch channels. Commissioner
Thomas said that the protocol that John is presenting, there would be limited use on the
main channel except in an emergency situation. Mr. Hart added there are various
channels and if the requester wants to have a conversation, it would not be on the main
channel. Chairman Keller asked how many radios this institution would have and how
many times they have contacted dispatch. Mr. Hart responded 2 radios and from his
knowledge there where two times that they contacted dispatch. Mr. Hart said this entity
is Mercersburg Academy but could add other educational institutions in the area with
dormitory type settings. Chairman Keller said this is a reasonable request and the policy
put together makes sense to provide a footprint moving forward so he supports it. Mr.
Hart said if they misuse the system, we can remove them from it. We can block the
radio and make it dead but he doesn't anticipate that would happen but if need to we
have the capability to do that. On a motion by Robert L. Thomas, seconded by Robert
G. Ziobrowski; unanimously approved the attached procedure as presented.
The meeting was adjourned at 9:55 a.m. with a motion by Robert L. Thomas;
seconded by Robert G. Ziobrowski.
FRANKLIN COUNTY COMMISSIONERS
