The Franklin County Commissioners met Thursday, August 24, 2017, with the
following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski.
Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and
the Pledge of Allegiance, proceeded with the business of the day.
Carrie Gray requested to amend the agenda to postpone the award/reject of the
Coyle Free Media Vending machine bid until Tuesday August 29, 2017 to allow the
Library to provide additional information regarding their recommendation. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt
the amended agenda.
There was no public comment.
John Hart requested that five items be pulled from today's voucher listing. He
explained that additional documentation is needed before they are approved. John Hart
and the Controller will meet regarding processes. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered
paid with the exception of the items that staff has requested to be deferred until next
week.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the August 15, 2017 and August 17, 2017
meetings.
The Board reviewed Adult Probation matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Grant-In-Aid Continuing
Program Application to the Pennsylvania Board of Probation and Parole for the State
Offender Supervision Fund Agreement services, requesting an amount of$1,307,000.00
for fiscal year 2017-2018. This program is to help fund Adult Probation salaries.
The Board reviewed Children & Youth matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the updated contract listing for
all contracts and addendums for Fiscal Year 2017/2018 for the Children & Youth
department. Contract listing is maintained for proper accounting of all contacts to include
vendor name and address, type(s) of service provided and rate(s) charged for services.
The Board reviewed additional Children &Youth matters. On a motion by Robert
L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the change order
from General Code to purchase 44 Laserfiche licenses at a total cost of$39,358.00. As
part of the Paper on Demand Project, Laserfiche will allow CYS staff to streamline the
paper process, maintain and archive electronic case files which will reduce the chance of
confidential information being lost or compromised. The IT grant will pay $25,976.00 of
the cost.
The Board reviewed Domestic Relations/Adult Probation/Juvenile Probation
matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the Supplemental Appropriation in the amount of$181,717.00 to
provide funds for 2017 increases and back pay retroactive to October 2016 for the
Teamsters contract. This applies to officers in Domestic Relations, Adult Probation and
Juvenile Probation.

The Board reviewed Grants matters. On a motion by Robert L. Thomas, seconded
by Robert G. Ziobrowski; unanimously approved the PCoRP Loss Prevention Grant
Program Application requesting funding to cover costs for purchasing needed risk
reduction equipment to include: Guardian Touch Point devices and licenses for the Jail,
UbiDuo 2 Communication device for hearing impaired, back pack trauma kits and bullet
resistant vests. The amount being requested is $20,000.00 for the 2017-2018 Fiscal
Year.
The Board reviewed Grants/CJAB matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the grant application to PA
Commission on Crime and Delinquency (PCCD) to continue funding on behalf of Over the
Rainbow Children's Advocacy Center. Funds will be used to strengthen the CAC through
supporting MDIT collaboration on child abuse investigations, service provision of forensic
interviews and developing and implementing policies and procedures aligned with NCA
standards. The grant amount requested is $40,000.00 for the period of January 1, 2018
through December 31, 2018. Franklin County serves as the pass-through for these funds.
In accordance with PA Acts 14, 67, 68 and 127 notifications, R. Lee Royer &
Associates notified the County of a Pennsylvania Department of Environmental Protection
NPDES General Permit application being applied by Emmanuel Full Gospel Church for
proposed construction of a new church located in Washington Township, PA.
In accordance with PA Acts 14, 67, 68 and 127 notifications, Wilson Consulting
Group, PC notified the County of a Pennsylvania Department of Environmental Protection
NPDES General Permit application being applied by Wilson College for the Wilson
College Bridge Replacement Project located in the Borough of Chambersburg, PA.
In accordance with PA Acts 14, 67, 68 and 127 notifications, St. Thomas
Development, Inc. notified the County of a Pennsylvania Department of Environmental
Protection renewal NPDES General Permit application being applied for the St. Thomas
Asphalt Plant located in the St. Thomas Township, PA.
The Board reviewed Personnel matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the revised job descriptions for
Director of Human Resources and Second Deputy/Director of Auditing.
Mary Beth Shank, County Solicitor, asked to go into an executive session to
discuss pending litigation. She said action may be required after the executive session.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously
approved to enter an executive session at 9:43 a.m. this date for the purpose of reviewing
pending litigation on the Tax Assessment Appeal of Chambersburg Mall. The Board
reconvened into regular session at 9:52 a.m.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the County Solicitor to settle real estate tax assessment appeals
2012-4740 and 2015-4293 for the Chambersburg Mall located in Greene Township and
the Chambersburg Area School District (CASD) for the following assessments: 2013:
$3,480,000, 2014: $1,558,200; 2015: $1,464,500; 2016: $1,263,500 and 2017:
$1,260,000. This settlement was previously approved by the taxpayer, CASD and the
Franklin County Board of Assessment. The county will owe the taxpayer approximately
$168,628.64 in tax refund, which shall be paid 50% within 60 days of the order and serve
as a credit against future taxes until paid in full. The parties agreed to not file an appeal in
2018. The Board authorized the county solicitor to settle real estate tax assessment

appeals filed by the CASD 2011-5008 through 2011-5012 pertaining to 5 outparcels
surrounding the Chambersburg Mall. The following assessments were authorized by the
Board for the combined parcels: 2012 -2014: $1,694,200; 2015-2017: $1,741,200. The
taxpayer will owe the county an additional $25,545.92 in taxes for the combined years.
The taxpayer, CASD and Franklin County Board of Assessment previously approved the
settlement
