THURSDAY, MAY 30, 2019
The Franklin County Commissioners met Thursday, May 30, 2019, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the May 23, 2019 meeting.
The Board reviewed Aging Office matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Food and Beverage License to the Pennsylvania Department of
Agriculture for the Path Valley Senior Activity Center at a cost of $82.00 each. It is a
state regulation to have a food and beverage license renewed annually. There is no
increase from last year and is funded by the Pennsylvania Department of Aging Block
Grant.
The Board reviewed Commissioners Office matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute an addendum to the lease between the County of Franklin and
Chambersburg Lodge No. 600 Benevolent and Protective Order of Elks dated October
23, 2019. This addendum is to provide 10 additional parking spaces for use by the
County in addition to the 18 parking spaces listed in the original lease agreement and to
extend the time period of an additional 30 days through July 20, 2019. All other terms
and conditions of the original agreement will remain in full force and effect.
The Board reviewed Fiscal matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Supplemental
Appropriation in the amount of $35,660.00 to establish a budget for our self-funded
dental program. The county is providing employee dental benefits through a self-funded
program beginning in 2019.
The Board reviewed Jail matters. On a motion by Robert L. Thomas, seconded
by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to
execute the agreement between the County of Franklin and Real Time
Networks/Keytracer Systems, Inc. to provide maintenance services on the key
management system that gives the Jail access and total accountability of all security
keys at a cost of $4,410.00 for the period of July 25, 2019 through September 1, 2020.
This system provides the ability to create logs and inventories providing additional
security safety measures.

The Board reviewed Juvenile Probation matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the agreement
between the County of Franklin and the Tuscarora School District for the School-Based
Probation program. The school district agrees to provide $9,308.40 for services during
the 2019-2020 school year. Franklin County will carry liability insurance for its
employees and the program.
The Board reviewed Property Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the quote from Bricker Welding to make expanded metal grates for
the hearing annex building at a cost of $1,200.00.
The Board reviewed additional Property Management matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute the quote from HPG Windows to purchase a steel
door, frame, hinges, hardware, etc. for the hearing annex building at a cost of $1,929.00.
In accordance with PA Acts 14, 67, 68 and 127 notifications, Arcadis notified the
County of a Pennsylvania Department of Environmental Protection general permit
registration form for maintenance, testing, repair, rehabilitation of water obstructions and
encroachments (BWEW-GP-11) being applied by Columbia Gas Transmission, LLC for
Line 1804 Dig ABS 109946.92 Project on property located in Warren Township.
In accordance with PA Acts 14, 67, 68 and 127 notifications, Arcadis notified the
County of a Pennsylvania Department of Environmental Protection general permit
registration form for a temporary road crossing (BWEW-GP-8) being applied by
Columbia Gas Transmission, LLC for Line 1804 Dig ABS 121991.258 Project on
property located in Warren Township.
In accordance with PA Acts 14, 67, 68 and 127 notifications, Arcadis notified the
County of a Pennsylvania Department of Environmental Protection Bureau of Waterways
Engineering and Wetlands Chapter 105 General Permit registration form being applied
by Columbia Gas Transmission, LLC for Line 1804 Dig ABS 137055.513 Project on
property located in Montgomery Township.
The Board was asked to review a resolution to permanently acquire a right of
way and temporarily acquire the easement for construction of a bridge along Heisey
Road over the West Branch of the Conococheague Creek in Montgomery Township,
Franklin County as it is in need of replacement and/or repair. Mary Beth Shank, County
Solicitor, provided clarification to the agenda that before the Board is an ordinance; not a
resolution. She explained that the County Code was changed in 2018 and that eminent
domain has to be done by an ordinance. In the past we typically did this by resolution.
Ms. Shank continued that this is the Heisey Road bridge, in Mercersburg that engineers
determined needed repaired or replaced. She is seeking approval to advertise the
ordinance as a result of a small complication. Typically the board does not have this
come before them as right of way issues are typically resolved without an ordinance.
She explained further that we need to obtain a small triangle subset of a 0.1 acre
permanently. She explained that agreements were reached with all surrounding
landowners but no one can determine ownership of this piece of land. We need this
completed to start the repair and replacement of the bridge. The ordinance would be to
move this forward and address this issue. Commissioner Ziobrowski asked if we are
seeking a quick claim deed. Ms. Shank responded yes so the county will own it and the
bridge can be repaired. Commissioner Ziobrowski said that no one knows who owns

entering property that someone deems as theirs. No one is claiming this parcel, and no
one wants it. She will provide service with all surrounding owners. This is just proper
housekeeping that needs done. Commissioner Thomas asked how a little piece of land
cannot be owned by anyone. Ms. Shank said there is no definitive owner.
Commissioner Thomas said this bridge is being totally replaced, not repaired. Ms.
Shank said after the ordinance is properly advertised she would like to put it on the
consent agenda for approval by the Board. Commissioner Thomas said that a resolution
was done in the past so what is changed in the county code with resolution vs.
ordinance. Ms. Shanks said in the prior code it was not clear if it was a resolution or an
ordinance. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to authorize Ms. Shank to advertise the ordinance as presented.
The meeting was adjourned at 9:45 a.m. with a motion by Robert L. Thomas;
seconded by Robert G. Ziobrowski.
