HomeMy WebLinkAbout2019-07-16 Commissioner Minutes TUESDAY, JULY 16, 2019 The Franklin County Commissioners met Tuesday, July 16, 2019, with the following members present: David S. Keller and Robert L. Thomas. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. Chairman Keller announced that Commissioner Ziobrowski will not be in attendance today. Carrie Gray, County Administrator, asked to amend the agenda to include a nonbinding letter of intent for the sale of property. On a motion by Robert L. Thomas; seconded by David S. Keller; unanimously approved to adopt the amended agenda. There was no public comment. The minutes of the July 9, 2019 and July 11, 2019 meetings were reviewed. These will be decided upon on Thursday, July 18, 2019. The Board reviewed Agreements, Contracts and Reports. Ms. Gray explained that she has a nonbinding letter of intent from TH Minit Markets, LLC for the purchase of .84 acres on Franklin Farm Lane, Chambersburg. Mary Beth Shank, County Solicitor, explained that this letter of intent is not a binding agreement since it just opens the door for further discussions and negotiations. The next action will be an agreement of sale. She will include this on the board action approval for Thursday. Chairman Keller said that this item was discussed during an executive session last week and Ms. Gray announced after the executive session that the letter of intent would be reviewed this week. Commissioner Thomas mentioned the Adult Probation Grant-In-Aid request that goes back 30 years. The State is to pay 80% of Probation salaries but not benefits. Out of this $1.5 M that is requested, the County historically receives $153,000 or 10% of the request. This is a full mi covered by the County. The Board was asked to consider approving the Archive Director position description in the Archives Department and the Human Services Program Specialist position description in the Human Services Department. Ms. Gray explained that the to include activities that the prior person either had been doing or they want the person to expand into. In particular there was nothing about supporting the community and providing support to the public which will happen more frequently once the department moves to the new archives facility. Ms. Gray said that this position always reported to the CIO so this needs reflected in the position description. Stacie Horvath, Human Services Administrator, explained that when the person left the Human Services Program Specialist position, they took the opportunity to review and see what is needed in the scope of the position. The only change internally is that the Link Coordinator duties have moved over to another position but they kept the Ombudsman program the same and added volunteer coordination duties. On a motion by Robert L. Thomas; seconded by David S. Keller; unanimously approved both position descriptions as presented. The Board was asked to consider Ordinance #2019-02 to authorize Franklin County to enter into an Intergovernmental Cooperation Agreement with the Borough of Chambersburg for the County to perform intake and processing of individuals arrested by Borough Police Officers. Mary Beth Shank, County Solicitor, explained that this was presented to the Board a few weeks ago and the Board authorized her to advertise the Continued on page 2 ordinance. She continued that this facilitates Chambersburg Police being able to process arrested individuals at the Franklin County Jail Central Booking. It was or its approval. Commissioner Thomas asked why we are doing this now when we already provide this same service for other police departments. Ms. Gray responded that the team at the Borough requested the ordinance be approved since they will have to provide funds for a patch for the systems to interface. Chairman Keller said that the concept was well received by the public since he has not received any comments. On a motion by Robert L. Thomas; seconded by David S. Keller; unanimously approved Ordinance #2019-02 and that a copy of this ordinance will be kept on file in the The Board was asked to consider approval of a Community and Education Contribution Agreement between Kent and Dee Saunders, Franklin County, Warren Township and the Tuscarora School District. Ms. Shank explained the subject of the agreement is the Saunderosa Campground in Warren Township. She continued that some of the recreational trailers there appear to be high-end that have a lot of amenities that clearly shows the intent of the homeowners to be staying during the whole open season of the campground. The campground has 287 lots and after negotiations this agreement will value them at $10,000 per lot. This will be assessed to the Saunders only; not to each trailer owner. Ms. Shank said this agreement provides stability and the first payment will be made this month for $28,000.00. There will be annual payments to the township of $1,000, $5,000 to the County and $22,000 to the Tuscarora School District. Th Saunderosa, the Township, and the School District. She commented that the sites were not being taxed; only the land was taxed. Ms. Shank said the Tax Office brought this to our attention when they were looking at areas that were under assessed. On a motion by Robert L. Thomas; seconded by David S. Keller; unanimously approved the Community and Education Contribution Agreement with Kent and Dee Saunders as presented. On a motion by Robert L. Thomas; seconded by David S. Keller; unanimously approved to enter an executive session at 10:02 a.m. this date for the purpose to review Orndorff v. Franklin County Board of Assessment - residential tax assessment appeal matters. Action may be required after the executive session. The Board reconvened into regular session at 10:13 a.m. On a motion by Robert L. Thomas; seconded by David S. Keller; the Board unanimously approved (with Commissioner Ziobrowski absent) a stipulation with Mark and Angela Orndorff to settle their residential tax assessment appeal, Docket 2018- 4982, for an implied fair market value of $410,000 commencing January 1, 2019. The settlement of this appeal will result in a refund to the appellant in the amount of $66.63. The meeting was adjourned at 10:14 a.m. with a motion by Robert L. Thomas; seconded by David S. Keller.
