WEDNESDAY, SEPTEMBER 16, 2020
The Franklin County Commissioners met Wednesday, September 16, 2020, with
the following members present: David S. Keller, John T. Flannery and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment.
The minutes of the September 9, 2020 meeting were reviewed. These will be
decided upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. John Hart, Project
Manager, explained change order # 24 for the Judicial Center Project from Lobar, Inc. is
to weld steel angles onto a chiller platform framing to support mechanical equipment that
supports the chiller on the roof. He said the wrong size was ordered. He explained that
change order #25 is roof screen to help protect the mechanical equipment on the roof
from the weather and for appearances. This was not included in the bid specs but we

heard that with change orders, contractors have a higher profit margin than they do on
the general contracts so he asked how we are controlling this. Mr. Hart responded that
John Boozer and himself look at man hours, effort and material and will ask for reduced
costs if needed. He said we have excellent contractors. Chairman Keller asked for
more explanation of items 7 and 8. Carrie Gray, County Administrator, explained that
item #7 is a renewal of the consultant services agreement with John Hart and #8 is
related to the professional services agreement with John Boozer, who is doing business
as Franklin Advisory, for the judicial center, administration building and archives building
projects. We are reaching the next phase of the construction project which includes
remodeling of the historic courthouse as well as bidding for the courthouse annex and
phase II of the archives building. Ms. Gray continued that the quality of the project
management contracts are stellar and she gets unsolicited positive comments from
architects and contractors alike. She explained further that change orders for a project
this size averages 10-12% but right now our change orders for the Judicial Center is
1.03% and Administration is at 1.19%. With these contracts there will be a restructure of
management efforts are increasing, resulting in a 20.5%cost reduction overall.
Chairman Keller responded that this is not the first modification and these contracts have
been anticipated with the function of the changing nature of projects as we move through
them. He said it is good to hear positive feedback. Commissioner Flannery said that
most everyone knows that he was critical of these projects but we are well underway
and they are beautiful projects. Moving forward he cannot say enough good things
about John Hart and John Boozer. They have done a good job controlling costs and
keeping the projects on schedule. He supports this an
completion. Commissioner Ziobrowski asked John Theirwechter to explain item #5,
issues with people cutting across the banks along the old Elks parking lot which pose
safety and jay-walking challenges for pedestrians crossing Route 30 to get to the
courthouse. This fencing will direct people to walk to the intersection to cross the road.
Shook Home will reimburse the County $1,810. Commissioner Ziobrowski thanked Mr.
Allen Coffman, Councilman from the Borough of Chambersburg who was present for the

meeting and said that Mr. Coffman will appreciate fewer tickets for jay walking and he
also thanked the Borough for allowing parking along Route 30 for voters who want to go
to Voter Registration to cast their ballot. The items will be approved in the afternoon
approval session.
Mike Ross, President of Franklin County Area Development Corporation
(FCADC) presented recommendations on the Small Business COVID Recovery Grant
Program. Mr. Ross explained that the purpose of the funding that was signed by
Governor Wolf on May 29, 2020 was to provide $625 million in CARES Act funding by
means of block grants for counties in the Commonwealth through the Department of
Community and Economic Development (DCED). He continued that this funding is
strictly for support of COVID-19 related activities to offset the cost of direct county
COVID-19 response; assist businesses and municipalities; provide behavioral health
and substance use disorder treatment services; fund non-profit assistance programs;
and deploy broadband to unserved or underserved areas. Mr. Ross provided the
background that the Small Business Recovery Grant (SBRG) program was created to
provide funding to eligible Franklin County small businesses impacted by the COVID-19
Pandemic. Phase 1 of the application process was administered by the Franklin County
Area Development Corporation (FCADC) to determine applicant eligibility. Phase 2 of
the process will be administered by the Franklin County Commissioners who will make
final determinations of individual grant amounts and disbursement of funds. He said that
the Franklin County Commissioners have tentatively allocated $5,898,000 to the SBRG.
To qualify for funding a business must operate as a for-profit; have been in operation
prior to May 1, 2019; and have fewer than 100 employees (including related or affiliated
businesses worldwide). Mr. Ross said the results were 187 total applications received
with 177 total applications that were deemed eligible for SBRG funding. Mr. Ross
provided the geographic distribution which represents all areas of the county from all six
school districts and economic sectors for the applications that were received. He
thanked the staff at FCADC for being the point of contact and responding to the
businesses. Chairman Keller responded that the Board thanks the staff at FCADC for
their efforts and for getting the word out and providing the applications to the County.
Ms. Gray said the next steps will include county staff taking over and reviewing all the
applications to determine the award amounts and return to the Board of Commissioners
with recommendations in approximately two weeks. Timing of the awards depends on a
number of factors, including the time to gather all documentation and sign the contracts.
The Board thanked Mr. Ross for providing an excellent executive summary and they will
do their best to get the funds out to the community in the 30 day timeframe.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter an executive session at 11:32 a.m. this date for the
purpose to review potential litigation matters. The Board reconvened into regular
session at 12:29 p.m. No action was required after the executive session.
The Board recessed and will reconvene at 1:00 p.m. for final approval of the
items that were reviewed.

unanimously approved all bills presented and ordered paid.

The Board reviewed Children & Youth matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the report to the
Commonwealth of Pennsylvania, Bureau of Budget and Program Support, Office of
Children, Youth & Families showing revenue and expenditures of Act 148 funding for
April 1, 2020 through June 30, 2020. The total amount of the report is $3,166,512.00 for
2019/2020 fiscal year.
The Board reviewed additional Children & Youth matters. On a motion by John
T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
Supplemental Appropriation is needed to fund the deficit in State Act 148 funding for FY
2019-2020. Expenditures totaled $7,506,096.00, the state allocation totaled
$7,158,242.00 resulting in a need for County overmatch. A request will be made to the
state for additional state funding for County reimbursement.
The Board reviewed Commissioners Office matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute Change Order #24 from Lobar, Inc. to weld steel angles onto chiller
platform framing to support the metal platform grating at the Courthouse project for an
additional cost of $6,324.55.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
extensions to Roof Screen Bases for proper flashing in order to achieve roof warranty
and to install spray foam insulation in Roof Screen Bases to prevent condensation and
thermal shorts, and provide Elastoform Flashing at Base caps to ensure water-tightness
at the Courthouse project for an additional cost of $11,007.71.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
parking lot for a cost of $5,119.00. Multiple quotes were received with this one being the
lowest, responsive quote.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
agreement with WellSpan Health, through the Healthy Franklin County Program to
provide COVID-19 pandemic response as well as provide administrative support to
Franklin County Government to facilitate the Franklin Forward Task Force and develop
and implement the application, scoring and recommendations for the nonprofit grantees
of the PA Department of Community and Economic Development's COVID-19 County
Relief Block Grant in Franklin County at a contract price of $20,000.00.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
Consulting Services Agreement between the County of Franklin and John A. Hart to
provide construction project management and coordination of a large-scale, multi-
property and multi-building Court Facility Improvement Project at a cost of $15,000.00
per month for a period from September 9, 2020 through September 8, 2021. Services
include project and plan design, trade solicitation, contract development, project
implementation, progress reports, county code compliance and budget management.

The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute the Professional Services Agreement (Phase 4)
between the County of Franklin and John Boozer D/B/A Franklin Advisory for design,
engineering, construction and procurement management for all Franklin County Judicial
Center projects at a cost of $19,500.00 per month. This phase also includes expended
hours beginning on August 16, 2020.
The Board reviewed Department of Emergency Services matters. On a motion
by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
quote from DataWorks Plus for development of a necessary interface for the cNET RMS
to receive and distribute CAD information to Franklin County cNET user agencies, at a
cost of $19,440.00. This will include development, testing and integration of the
interface with the Spillman CAD system which is scheduled to go live by year end.
The Board reviewed Drug & Alcohol matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the FY 2019-2020 Department of Drug and Alcohol Programs fiscal
report is completed online through DDAP's data management system. The revenue
report is showing that the County owes a refund under federal prevention block grant
dollars in the amount of $12,398.00 and VA state funding for $3,757.00.
The Board reviewed Fiscal matters. On a motion by John T. Flannery, seconded
by Robert G. Ziobrowski; unanimously approved the engagement letter from
Zelenkofske Axelrod, LLC for independent audit services for the year ended December
31, 2019, including the audit of the County's GASB 34 financial statements and the
County's Single Audit, required for all programs receiving federal and pass-through
funds. This is consistent with the multi-year contract signed by the Board on February
22, 2018. The contract period is from January 1, 2020 - December 31, 2020 at a total
cost of $104,911.00.
The Board reviewed Tax Services matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the amendment to the
original agreement dated June 4, 2020. The amendment to the Independent Contractor
Agreement establishes Douglas Boozer as an alternate member of the Franklin County
Board of Assessment and Revision of Taxes.
In accordance with PA Act notifications, St. Thomas Development, Inc. notified
the County of a Pennsylvania Department of Environmental Protection renewal of a
GP13 General Operating Permit for its asphalt plant in St. Thomas Township.
The Board presented a nursing scholarship to a recent local high school
graduate who is entering a college nursing program. Tiffany Bloyer, Human Resources
Director, explained that in the past the Commissioners would attend the ceremonies at
the high schools but this year it had to be done differently. The following graduate was
recognized today: Andrea Fox from Career Magnet School who is attending Penn State
Mont Alto.

Barvinchack, Planner were present to provide more information on the Agriculture Land
Preservation program that has 141 farms totaling 17,991 acres in the program to date.

acres of farmland. This will help to double the acres in the county that can be reserved
in 2021. Ms. Gray announced that his bequest totaled $268,729.66. Chairman Keller
said that every dollar will go towards Agricultural Preservation. The Board thanked Mr.
William Schroyer and how he was born and raised in Waynesboro, PA and during the
daily. His brother lived most of his life in PA except for when he served in the military.
William and his wife taught school for a combined total of 70 years. When he would
come get his brother they would drive on Interstate 81 and William would comment
about all the construction and warehouses built on farmland. He was very conservative
and prudent with his spending and Menno Haven, where he and his wife resided, his
church and land preservation were his three loves. Mr. Schroyer thanked the
Commissioners, administrators and everyone present for this certificate of appreciation
for his brother.
The meeting was adjourned at 1:22 p.m. with a motion by John T. Flannery;
seconded by Robert G. Ziobrowski.
