WEDNESDAY, DECEMBER 16, 2020
The Franklin County Commissioners met Wednesday, December 16, 2020, with
the following members present: David S. Keller, John T. Flannery and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
Chairman Keller announced that the County is closing at noon today due to
inclement weather so the board meeting will only be held this morning and there will be
no afternoon meeting. There is also an addition to the board action listing to be added
for an agreement with County of Adams for the Jail for housing of adult offenders from
the County of Franklin. On a motion by John T. Flannery, seconded by Robert G.
Ziobrowski; unanimously approved to adopt the amended agenda.
There was no public comment.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
The minutes of the December 9, 2020 meeting were reviewed. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
minutes of the December 9, 2020 meeting.
The Board reviewed Agreements, Contracts and Reports. John Hart, Project
Manager, explained change order #43 from Lobar, Inc. for the Judicial Center Project is
to replace the risers on the steps at the courthouse for an additional cost of $9,360.90.
He explained change order #45 from Lobar, for the Judicial Center Project is to change
the lights in the ceiling grid for an additional cost of $7,276.67. John Thierwechter,
Assistant County Administrator, explained the Adams County Agreement for the Jail is
needed since time is of the essence.
The Board reviewed Commissioners matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the service agreement
between the County of Franklin and SMR Delivery, LLC (The Butcher Shoppe)for the
period of December 16, 2020 to December 31, 2022 to install, operate, and maintain a

agreement between the County of Franklin and the County Commissioners Association

The Board reviewed additional Commissioners matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved amendment #10
that modifies the Professional Facilities Development and Management Services
agreement dated January 4, 2006, between the County of Franklin and CGL
Engineering, Inc. The standard monthly fee will be increased 1.3% to $62,399.38
beginning January 1, 2021, for facilities and jail maintenance services each month.

The Board reviewed additional Commissioners matters. On a motion by John T.

the Board to execute change order #43 from Lobar, Inc. to replace the specified
concrete paver riser with cast stone at the two site stairs indicated in PR-GC-037 at the
Judicial Center Project for an increased cost of $9,360.90.

The Board reviewed Day Reporting Center matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the renewal of the
agreement between the County of Franklin and The Mental Health Association of
Franklin and Fulton Counties ending June 30, 2021. This agreement provides trained
Forensic Peer Mentors for CARE and CARE Plus participants at a rate of $14.70 per
fifteen-minute unit not to exceed $3,000.00. These services are covered by insurance.
The Board reviewed Emergency Services matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the motion to
approve the grant agreement between the County of Franklin and the Pennsylvania
Emergency Management Agency (PEMA) for the fiscal year 2020-2021 Hazardous
Materials Response Fund Grant (HMRF) in the amount of $19,300.00 for the period of
July 1, 2020 through June 30, 2021. Funds are to be used to develop, update, and
exercise response plans for responding to hazardous material releases.
The Board reviewed Grants/CJAB matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the amendment to the
contract dated October 1, 2017, between the County of Franklin and Pennsylvania
Counseling Services that provides substance abuse treatment services for program
participants in the Good Wolf Treatment Court. The amendment extends the contract
from September 30, 2020 to September 30, 2021. All other terms and conditions of the
original agreement will remain in full force and effect.
The Board reviewed additional Grants/CJAB matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the Project
Modification to PA Commission on Crime and Delinquency for the 2019 Drug Court
Initiative. This program modification is being requested to move funding from the CRS
position to the Case Manager position in the consultant category. Additional funding has
been moved from the supply category to help cover this cost. In addition, funding has
been moved within the supply category to include drug testing supplies for the GWTC
participants. The total amount of the grant is $142,835.00 for the grant period of
October 1, 2019 through September 30, 2021.
The Board reviewed Jail matters. On a motion by John T. Flannery, seconded by
Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute
the renewal of a supportive maintenance agreement between the County of Franklin and
Dagnostino Electronics Services, Inc. for the existing eleven video conference units in
the amount of $10,137.45 for the period of January 1, 2021, to December 31, 2023. This
agreement is for maintenance services, hardware and manufacture support, and
coverage of existing units.

The Board reviewed additional Jail matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the Intergovernmental
agreement between the County of Franklin and the County of Adams to house adult
offenders over the age of 18 for both male and female in accordance with the availability
of bed space. This facility is PREA certified and abides by all PA Title 37 regulations.
Adams County reserves the right to accept offenders at their discretion. All medical
expenses accrued will be solely the responsibility of the County of Franklin. This
agreement is at a cost of $65.00 per inmate per day for the period of December 11, 2020
through January 25, 2021 with the option to extend for subsequent periods of 30 day
increments upon written approval of each County.
The Board reviewed additional Jail matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the renewal agreement between the County of Franklin and Terminix
Commercial Pest Control in the total amount of $2,760.00 for the period of January 1,
2021, to December 31, 2021. This includes semi-monthly service with no more than two
times per month unless otherwise approved or contacted. This agreement covers
interior and exterior general pest control coverage.
The Board reviewed additional Jail matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the renewal agreement
between the County of Franklin and the County of Armstrong Armstrong County Jail
which agrees to house both male and female adult offenders over the age of 18 at a rate
of $55.00 per inmate per day for the period of January 1, 2021 through December 31,
2021. Service is based on availability of cell space. The County of Armstrong
Armstrong County Jail is PREA certified and abides by all Pennsylvania State Title 37
regulations. The County of Armstrong reserves the right to accept offenders at their
discretion. All medical expenses accrued will be solely the responsibility of the County
of Franklin.
The Board reviewed additional Jail matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the addendum to the agreement between the County of Franklin and
Waste Connections of Pennsylvania, Inc. for the period of December 3, 2020, to
December 31, 2024. This agreement covers the emergency trash pick-ups necessary
for the additional trash created due to COVID-19 from things such as additional paper
towel use and inmate meals being served in Styrofoam containers. Additional pick-ups
will cost an additional $50.00 each.
The Board reviewed Purchasing matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute renewal agreement between the County of Franklin and Thomson
Reuters for Westlaw Edge user licenses. The renewal is for a period of 42 months
beginning January 1, 2021, in the amount of $302,502.00. The current rate will remain
the same for the first 6 months while moving from 40 to 50 users and adding new
features in Westlaw Edge. In July, the contract rate properly reflects the 10 additional
users. There is a 3% increase in July 2022 and again in July 2023.
The Board reviewed Risk Management matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the service agreement between the County of Franklin and Tyco
Fire & Security Simplex Grinnell in the amount of $700.00 for the period of one year
beginning December 16, 2020. This agreement is for fire alarm monitoring service for
the Simplex Grinnell fire alarm system at the new Administration Building and covers
system monitoring coordinated through Johnson Control Systems, the contracted
system installer.

notified the County of a Pennsylvania Department of Environmental Protection, Bureau
of Air Quality General Permit being applied to allow use of a portable nonmetallic mineral
processing crushing and screening plant at a facility located in Chambersburg.
In accordance with PA Act notifications, Red Barn Consulting, Inc. notified the
County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being issued by Eldwin
Mart for an existing operation on property located in Mercersburg.
In accordance with PA Act notifications, Red Barn Consulting, Inc. notified the
County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being issued by Milton
Rotz for an existing operation on property located in Chambersburg.
In accordance with PA Act notifications, Red Barn Consulting, Inc. notified the
County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being issued by Hord
Family Farm, Franklin Hog Farm for an existing operation on property located in
Mercersburg.
In accordance with PA Act notifications, AET Agricultural Consulting, Inc. notified
the County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being issued by Lynn
Eberly Mt. Pleasant Farms for an existing operation on property located in Greene
Township.
In accordance with PA Act notifications, AET Agricultural Consulting, Inc. notified
the County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being issued by Jeff
Wagner Dry Run Farm, LP for an existing operation on property located in Fannett
Township.
In accordance with PA Act notifications, AET Agricultural Consulting, Inc. notified
the County of a Pennsylvania Department of Environmental Protection General Renewal
NPDES Concentrated Animal Feeding Operation (CAFO) Permit being issued by Paul
Ebersol for an existing operation on property located in Greene Township.
Vickie Kamler, Healthy Living Coordinator, was present to provide a fundraising
check to the Wellspan
fundraiser. She explained that 11 employees participated in two categories . The baby
face category contestants were Charles Martin, Human Resources; John Thierwechter,
Commissioners Office; Nov
Office. The habitual hairiness category contestants were Ben Sites, Brian Cramer, Jeff
Sarver, and Jorge Jimenez-
Emergency Services; Joel Burkholder from ITS; and Matt Foschia from Children &
Youth. She explained that they raised $951 from the contest and another $496
fromdress-down stickers. She continued that in 2017 we raised $515; in 2018 $870; and
in 2019 $1,476. This year the total is $1,477. Ms. Kamler said that Robert Marshall won
the baby face category and Matt Foschia won the habitual hairiness category. She said
the winners each won a 13 piece beard trimmer. Ms. Kamler announced that Mr. Martin

raised the most funds again this year so he won three months membership to Results
Gym. Carolyn Clouser, Director of Development, Summit Health Foundation and Jill
Simonson, Development Associate, Summit Health Foundation participated virtually and
each thanked the County for this fundraiser that will be used by patients for prescriptions
or paying their bills. The funds stay in Franklin County and they are working on raising
awareness of the fund since some patients are hesitant to accept help. The
Commissioners thanked everyone who participated and appreciate all that employees
have done for this fundraiser.
Carrie Gray, County Administrator, provided information on the COVID Relief
Block Grant for Broadband recommendations. She explained that John Thierwechter,
Assistant County Administrator and Kurt Hoffeditz, Chief Information Officer worked with
the local school districts and received requests from 3 of the 6 school districts. The
school districts of Chambersburg, Greencastle and Tuscarora are requesting funds to
make broadband available to more students. Chambersburg is requesting $113,127.94,
Greencastle is requesting $833,165.53 and Tuscarora is requesting $18,525.00. These
requests total $964,818.47. Ms. Gray explained that each school district took a varied
approach. Tuscarora is looking at hotspots, Greencastle is requesting cost of equipment
for themselves and for more access to 1,400 students and Chambersburg combined
some cellular costs and equipment that would enhance and amplify their wireless
network. These requests were reviewed internally with the solicitors, Fiscal Director and
Paralegal. Commissioner Ziobrowski said he is struck by the disparity in the amounts
and asked if it was based on their platforms. John Thierwecter responded that Mr.
Hoffeditz took the lead on this and he had a number of conversations with district
representatives on what their thoughts were to qualify. We never quantified what was
available to them; we let it up to them to put in what they needed. Chairman Keller said
he has no reason to question the process but they could approve the recommendations
upon one more final call if everything checks out. Ms. Gray responded that there is time
to do more due diligence since the payment deadline is in February. Commissioner
Flannery said that Greencastle did the right thing and should not be penalized for that
but -up phone call to Chambersburg and Tuscarora to let them
know there are more funds they could apply for. Ms. Gray responded that each school
district was contacted twice informing them of these funds. After more discussion the
decision was to defer until next week to provide more due diligence before making a final
approval of the recommendations.
Ms. Gray provided information on COVID Relief Grants to 501(c)6s which are
funds for the Chambers of Commerce. She explained they are civic organizations with a
501(c)6 designation according to state guidelines. Chambersburg, Waynesboro,
Shippensburg and Greencastle requested funds ranging from $11,785.35 to $65,013.80.
Commissioner Flannery said the key word is charitable but they are not nonprofit. He
continued that Tuscarora Chamber is partially closed and the director is working
their bills. He supports these recommendations. Chairman Keller said these
organizations are relying on help so he feels good that we are helping these groups
sustain themselves. On a motion by John T. Flannery, seconded by Robert G.
Ziobrowski; unanimously approved the recommendations and processing the contracts
at the not to exceed amounts to the awardees.
This is the date for the Board to approve the 2021 Budget. Teresa Beckner,
Fiscal Director, said that there has not been any public comment but there have been a
few minor changes to the budget that was proposed on November 25th. The
adjustments made are allowed within the variances for adopting the budget, per county
code. She explained the Commissioners asked for an adjustment to budget 2% pay
increases for non-bargaining unit staff and an additional $15,000 for Ag. Preservation, to
come from Act 13 funds. The adjustments did not exceed 25%.

The Board presented the 2021 Franklin County budget for adoption this date. On
a motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously
approved the following resolution adopting the 2021 budget:
RESOLUTION #2020-17
WHEREAS, the 2021 Franklin County Budget has been prepared in accordance with the
County Code Act of August 9, 1955 (P.L. 323, No. 130) as amended.
WHEREAS, the 2021 Franklin County Proposed Budget was approved on Wednesday,
November 25, 2020 and was made available for public inspection for at least 20 days.
WHEREAS, the Proposed Budget and date set for the final action on the budget has
been made a matter of public notice.
WHEREAS, the Adopted Budget does not have increased expenditures of more than ten
(10) per centum in the aggregate or more than twenty-five (25) per centum in any
function over the proposed budget as made available for public inspection.
WHEREAS, the Adopted Budget reflects as nearly as possible the estimated revenues
and expenditures for the year 2021.
BE IT RESOLVED AND ENACTED, and is hereby resolved and enacted by the Board of
Commissioners of the County of Franklin, PA, to adopt the 2021 Budget as presented
this date.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved that the following Resolution be adopted fixing the millage rate
for real estate taxes for the year 2021 and the specific sums established to be required
for the specific purposes of County Government; hereinafter, set forth during the current
fiscal year:
RESOLUTION #2020-18
BE IT RESOLVED AND ENACTED, and is hereby resolved and enacted by the Board of
Commissioners of the County of Franklin, PA.
SECTION 1 - That a tax be set and the same is hereby levied on all real property within
Franklin County subject to taxation for the County purposes for the fiscal year 2021 as
follows: Tax rate for general purposes, the sum of twenty-five (25) mills of each dollar
assessed valuation with an additional four and one tenth (4.1) mills for the purposes of
retirement of County debt services.
SECTION 2 - That for the expenses of the County for the fiscal year 2021 the following
amounts
are hereby appropriated from the revenue available for the fiscal year for the specific
purposes, which amount are fully itemized in the County budget.
SECTION 3 - That any Resolution, or part of a Resolution, conflicting with this
Resolution be and the same is hereby repealed in so far as the same affects this
Resolution.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved the following Resolution imposing a total of one and three tenths
(1.3) mills of real estate taxes for the purpose of the County Library in voting districts that
have approved imposition of such tax by referendum and as authorized under the laws
of the Commonwealth of PA in those voting districts.

RESOLUTION #2020-19
BE IT RESOLVED, that a tax at the total rate of one and three tenths (1.3) mills on each
dollar of assessed valuation for the fiscal year 2021 for the County Library purposes,
shall be and the same is hereby imposed upon all taxable real estate in Franklin County
as heretofore authorized by the voters of the various voting districts and as authorized
under the laws of the Commonwealth of PA.
The Board reviewed an appointment to the Franklin County Industrial
Development Authority Board (FCIDA). On a motion by John T. Flannery, seconded by
Robert G. Ziobrowski; unanimously approved to appoint Valerie Meyers to fill an
unexpired term through April 4, 2023.
The meeting was adjourned at 12:08 p.m. with a motion by John T. Flannery;
seconded by Robert G. Ziobrowski.
