HomeMy WebLinkAbout2021-03-31 Commissioner Minutes WEDNESDAY, MARCH 31, 2021 The Franklin County Commissioners met Wednesday, March 31, 2021, with the following members present: David S. Keller, John T. Flannery and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. Carrie Gray, County Administrator, asked to amend the agenda to include an action for 2 N. Main Street that involves lead paint abatement. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved to adopt the amended agenda. Mayor Richard Starliper from Waynesboro provided public comment and said he is looking for money if they want to send any to the southern end of the county. He also extended an invitation for all of them to stop by the Republican Headquarters anytime they are able. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved all bills presented and ordered paid. The minutes of the March 24, 2021 meeting were reviewed. These will be decided upon in the afternoon approval session. The Board reviewed Agreements, Contracts and Reports. John Hart, Project Manager, explained actions #3, #6 and #9 all change orders from Lobar, Inc. for the Judicial Center Project that are over $10,000.00 He also reported that the budget is on track for the Administration Building that is closing out. Change orders for the Judicial Center project are tracking at less than 2% which is less than most projects which usually average 10-12%. The items will be decided upon in the afternoon approval session. The Board reviewed Commissioners Office matters and conducted a bid opening for the printing of ballots for the Municipal Primary Election. The following bidders submitted a bid: Beidel Printing House from Shippensburg, PA; Single Point Sourcing from Dillsburg, PA; Brad Houseknecht NPC, Inc. from Claysburg, PA; and Fort Orange asked if we have a requirement and make it clear in the bid specifications for geography in case there would be last minute changes of ballots. He continued that it appears that some of these would be non-responsive. Jean Byers, Deputy Chief Clerk, responded that there is a paragraph that the bidders are required to be within 30 miles of Chambersburg in the bid specs. And another provision is that they need at least 5 suggests having a special election board meeting before awarding these next week. Chairman Kel meeting next week. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved to forward the bids received to Ms. Byers for review and will award or reject the bids on Wednesday, April 7, 2021 at 11:10 a.m. AJ Benchoff, Solicitor attended virtually and asked for approval to enter into a settlement agreement and authority to sign the Stipulation of Value of Parties on behalf of the Board of Commissioners for the tax assessment appeal of Farmers Union Cooperative, Inc. v. Franklin Co. BART, No. 2019-4657. The property Continued on page 2 is located in Greencastle Borough, Franklin County, Pennsylvania. Parcel No. 08- 2B05.-015.-000000 was originally reassessed by the BART from $115,220 to $75,000, after the Board-level hearing, and the new assessment will be $55,500 with an implied market value of $500,000.00. The stipulations and Orders of Settlement memorialize the specific settlement terms. Attorney Benchoff explained that the Greencastle School District and Borough of Greencastle signed off on the stipulation. He explained that this appeal was discussed recently during an executive session with the Board. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved to authorize the Solicitor to execute the settlement agreement on behalf of the County. The Board recessed and will reconvene at 2:00 p.m. for final approval of the items that were reviewed. The Board reconvened at 2:00 p.m. There was no public comment. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the minutes of the March 24, 2021 meeting. The Board reviewed Adult Probation matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the State Offender Supervision Fund Agreement between the County and PA Parole Board, Bureau of Central Services for a one-year renewal for the period July 1, 2020 through April 30, 2021. The current five-year State Offender Supervision Fund Contract commenced on July 1, 2017 and ends June 30, 2022. The Pennsylvania Parole Board will return to the County the Offender Supervision Fees received by the Department of Revenue from the County for the period May 1, 2020 through April 30, 2021. The Board reviewed Aging matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the Cooperative Grant Agreement between the County and Pennsylvania Department of Aging (PDA) to utilize Federal and State funding for the provision of PDA services during the period of July 1, 2021 through June 30, 2025 for an annual payment of $2,694,514.00. The Board reviewed Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #EC - 009 from Lobar, Inc. to revise light fixtures B & M to alternate M2e fixtures in basement secure ceiling areas at the Judicial Center Project for an additional cost of $11,436.27. The Board reviewed additional Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #GC- furring channels in two locations to conceal structural steel that protrudes past the finish wall plane at the Judicial Center Project for an additional cost of $2,848.53. The Board reviewed additional Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #GC-065 from Lobar, Inc. to revise window infill at historic courthouse below bridge at the Judicial Center Project for an additional cost of $754.59. The Board reviewed additional Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #GC-066 from Lobar, Inc. to obtain Chambersburg Borough excavation permit for installation of sidewalks and curbs at the Judicial Center Project for an additional cost of $11,975.36. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #GC-067 from Lobar, Inc. to install ply Center Project for an additional cost of $1,506.77. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #GC-068 from Lobar, Inc. to eliminate the balance of temporary sidewalks that are no longer necessary due to schedule changes at the Judicial Center Project for a decreased cost of $7,180.00. The Board reviewed additional Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute Change Order #GC-069 from Lobar, Inc. to install expansion joints at bridge soffit and sides at connection to Historic Courthouse at the Judicial Center Project for an additional cost of $12,092.82. The Board reviewed additional Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the Professional Services Agreement between the County and Triad Engineering, Inc. to provide construction observation and testing services for the Archives Phase 2 project at a cost of $5,786.00. The Board reviewed additional Commissioners Office matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved for the Chairman of the Board to execute the proposal from Baxter Group, Inc. for removal of components that contain lead-based paint at 2 N. Main Street, Chambersburg at a cost of $10,900.00. The Board reviewed Domestic Relations matters. On a motion by Robert G. agreement between the County and James M. Stein to provide Support Master services until a new contract is approved. This contract is at rates listed under 3b of the agreement for the period of April 1, 2021 through May 31, 2021. The Board reviewed Grants matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the Project Modification to PA Department of Community & Economic Development for a request from South Central Community Action Program (SCAAP) to move $117,292 from Homelessness Prevention in the 2020 ESG-CV Grant Budget. This would move $17,292 to Rapid Rehousing - Services, $60,000 would be moved to the Emergency Shelter Component under Operations, and $40,000 will be moved to the Emergency Shelter Component under Essential Services. The Board reviewed Information Technology Services matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the proposal from Communications Supply Corporation for maintenance renewal for the UPS and HVAC systems of the Data Center located in the Archives building. This proposal is at a cost of $23,231.64 for the period of March 4, 2021 through March 3, 2022. The Board reviewed additional Information Technology Services matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the proposal from Morefield Communications to purchase new network switches for the Judicial Center for a cost of $99,542.81. Continued on page 4 The Board reviewed Planning matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the retainer agreement between the County and Herbert, Rowland and Grubic, Inc. to provide engineering services related to public works improvements, at a cost not to exceed $31,750.00. This agreement is for the period of March 25, 2021 through March 25, 2022, with automatic one-year renewals, until terminated by either party. The Board reviewed Tax Services matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the amendment to the agreement between the County and Palmetto Posting, Inc. to extend the term of the original agreement through calendar year(s) 2021, 2022 and 2023 at an average cost of $40,000.00 per year. The costs are passed on to the taxpayers delinquent accounts. All other terms and conditions of the original agreement will remain in full force and effect. The Board reviewed Veterans Affairs matters. On a motion by Robert G. Ziobrowski; seconded by John T. Flannery; unanimously approved the agreement between the County of Franklin and Nolan Carlson Canine, LLC DBA Good Dog Boarding and Training for dog training services for Operation Save-A-Vet, Save-A-Pet service dog program in the amount of $38,845.00, for the period of January 1, 2021 through December 31, 2021. Funded by the Veterans Affairs Outreach Fund which is funded with donations, contributions and through fundraising efforts. In accordance with PA Act notifications, RGS Associates notified the County of a Pennsylvania Department of Environmental Protection Planned Land Development for Chapter 102 permits being applied by White Rock, Inc. for construction of new residential homes, associated roadways and utilities located in Guilford Township. The Franklin County Commissioners on behalf of the STAR Committee (Special Thanks and Recognition) proudly presented the Employee of the Month award to Mr. Bradley Mills. Tiffany Bloyer, Human Resources Director said that Mr. Mills has been employed with Franklin County since March of 2010. He currently serves as Booking - Correctional Officer with the Franklin County Jail. The selection for the March 2021 Employee of the Month was determined by the STAR Committee. There were a total of 16 nominations, five of which were for Brad! The nomination form is attached and made a part of these minutes. Mr. Mills said it is an honor to represent the Jail and thanked enough for the great job he does every day. When things go by the book 99 times out of 100 and run as smooth as silk sometimes people become complacent but he obviously agreed with Chairman Keller, using the word complacency and thanked God Brad has not become complacent with his job. He thanked him for everything he does. Commissioner Ziobrowski said he must have the hours of tedium punctuated by moments of stark terror in He thanked him. The Board congratulated him on receiving the employee of the month award. The Board met with Tiffany Bloyer, Human Resources Director and the Controller Harold Wissinger for Salary Board matters. Also in attendance was Mark Singer, Court Administrator. The Board reviewed information regarding Franklin County Public Library Week. Bernice Crouse, Alice Elia from the Franklin County Library System and John Kilduff from Patriot Federal Credit Union were present to receive the proclamation. Ms. Crouse thanked the Board for being an anchor for funding for the libraries. She explained that library services took a huge turn in 2020. They had huge increases in e-books and audio book usage which were up by 61%. Their other electronic content use increased by 54%. She said all buildings are open now with modified hours and they are looking Continued on page 5 forward to getting more people back into their buildings. During their closure staff spent hours and hours offering curbside services and they are still continuing to do that when requested. She wanted to say thank you because the Board has been their support as they have worked hard to serve the county. She announced that she received a piece of news today that there is legislation at the State level to increase funding for public libraries. She requested if the Commissioners have any connections to please help with ate cut their funding dramatically. Ms. Elia thanked the Commissioners and all people from Franklin County for supporting electronics. They are grateful for all the support through tax dollars and fundraising they have received. Chairman Keller thanked both of them for keeping the library system but they believe in the service they provide and love helping people. He asked Bernice to please let her staff know how much the Board appreciates them. And they also appreciate the taxpayers. There was a bigger response to the annual appeal then any year prior. If they could continue that response this year that would be great. They are grateful to the taxpayers for their support. He also wanted to thank the business community like Patriot Federal Credit Union and many others for their support. Commissioner Flannery thinks the libraries are core to successful communities and they have achieved that. He congratulated them on the adjustments they had to make and it is nice to see there is still a lot of traffic there. He hears nothing but great things about our library system. He asked for more information on the new bill that she mentioned earlier. Commissioner Ziobrowski asked about the funding that he did calculations and they are getting 50% less from the State compared to what they used to get so he asked if the bill is for one time funding or on a continuing basis. Ms. Crouse responded that she believes it would be ongoing but the funding would need to be approved every year. There has not been a significant change in 15 years. Commissioner Ziobrowski said he is a frequent flyer to Coyle Library and he still likes to read hard copy books. He thanked everyone that has brought books out to him. Flannery; unanimously approved to sign Proclamation #2021-03 for the purpose of proclaiming the week of April 4-10, 2021 as Franklin County Public Library Week and that the attached proclamation be made a part of these minutes.
