HomeMy WebLinkAbout2009-12-31 Commissioner MinutesTHURSDAY, DECEMBER 31, 2009 The Franklin County Commissioners met Thursday, December 31, 2009, with the following members present: Robert L. Thomas, David S. Keller and Robert G. Ziobrowski. Chairman Thomas presided and after calling the meeting to order, and the Pledge of Allegiance proceeded with the business of the day. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the minutes of December 22, 2008 meeting. The Board reviewed Commissioners' matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved Resolution #2009-16 authorizing the Tax and Revenue Anticipation note, which is attached and made a part of these minutes. The Board reviewed Assessment matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Exoneration list for Waynesboro Area School District parcels for the 2009 County and County Library taxes in 2010. The Board reviewed Children & Youth matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Three Subsidized Adoption Assistance Agreements on behalf of the Franklin County Children and Youth Department for payment in the amount of $35.00/day for each for the period of January 14, 2010 through January 13, 2011 and will include a 2% cost of living increase per year through January 13, 2015 as listed on each agreement, in addition a one time payment not to exceed $160.00 each to cover non-recurring adoption expenses. The Board reviewed Commissioners' Office matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Lease Agreement between the County of Franklin and Borough of Mercersburg for leasing of office space on the second floor of Borough Hall consisting of approximately 1,115 square feet at a cost of $750.00 per month for the year 2010 and will automatically increase 3% per year beginning January 1, 2011 through December 31, 2012. The Board reviewed Grants Management matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Grant Application to PA Commission on Crime & Delinquency to develop and fund a Forensic Peer Support Program to implement at the Franklin County Jail, written to sole source these services to Nulton/PeerStar requesting a grant amount of $299,773.00 from April 1, 2010 through March 31, 2012. The Board reviewed additional Grants Management matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Grant Application to PA Commission on Crime & Delinquency Application for Electronic Process for Assigning Court Counsel, requesting a grant amount of $121,460.00 from April 1, 2010 through March 30, 2012. Continued on page 2 The Board reviewed Jail matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Request from Warden Wetzel to designate the monies from sale of items at the Jail Annex in the amount of $6,163.24 and to keep in an account unrelated to the 2010 budget for usage of future projects. The Board reviewed Property Management matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the 2009 Budget Adjustment for Old Prison repairs in the amount of $26,000. The Board reviewed Visitors Bureau matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Advertising Contract between the County of Franklin and Riverview Publishing to purchase cone-third page full-color ad in the Gettysburg Visitors Guide at a cost not to exceed $1,820.00 for the period of December 31, 2009 through February 15, 2010. In accordance with PA Acts 67, 68 and 127 notifications, Dennis E. Black Engineering, Inc. notified the County of a Pennsylvania Department of Environmental Protection renewal General NPDES Permit being applied by Martin P. Coblentz, Jr. for stormwater discharges associated with construction activities for construction of the remaining two phases of the Brookdale single-family residential development project located in Hamilton Township. In accordance with PA Acts 67, 68 and 127 notifications, Johnson Controls notified the County of a Pennsylvania Department of Environmental Protection Plan Approval Application from York International Corporation for the boilers and process heaters in the manufacturing facility located in the Waynesboro Borough. John Hart, Chief Clerk/County Administrator reported to the Board that the County received authorization from the Federal Communications Commission approving the County's license for T-Band. Mr. Hart forwarded the letter to Department of Emergency Services for confirmation. The Board presented the 2010 Franklin County budget for adoption this date. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the following resolution adopting the 2010 budget: RESOLUTION #2009 - 17 WHEREAS, the 2010 Franklin County Budget has been prepared in accordance with the County Code Act of August 9, 1955 (P.L. 323, No. 130) as amended. WHEREAS, the 2010 Franklin County Proposed Budget was approved on Thursday, December 10, 2009 and was made available for public inspection for at least 20 days. WHEREAS, the Proposed Budget and date set for the final action on the budget has been made a matter of public notice. WHEREAS, the Adopted Budget does not have increased expenditures of more than ten (10) per centum in the aggregate or more than twenty-five (25) per centum in any function over the proposed budget as made available for public inspection. WHEREAS, the Adopted Budget reflects as nearly as possible the estimated revenues and expenditures for the year 2010. BE IT RESOLVED AND ENACTED, and is hereby resolved and enacted by the Board of Commissioners of the County of Franklin, PA, to adopt the 2010 Budget as presented this date. Continued on page 3 On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved that the following Resolution be adopted fixing the millage rate for real estate taxes for the year 2010 and the specific sums established to be required for the specific purposes of County Government; hereinafter, set forth during the current fiscal year: RESOLUTION #2009 - 18 BE IT RESOLVED AND ENACTED, and is hereby resolved and enacted by the Board of Commissioners of the County of Franklin, PA. SECTION 1 - That a tax be set and the same is hereby levied on all real property within Franklin County subject to taxation for the County purposes for the fiscal year 2010 as follows: Tax rate for general purposes, the sum of twenty-two and fifty-five hundreds (22.55) mills of each dollar assessed valuation with an additional two and six tenths (2.60) mills for the purposes of retirement of County debt services. SECTION 2 -That for the expenses of the County for the fiscal year 2010 the following amounts are hereby appropriated from the revenue available for the fiscal year for the specific purposes, which amount are fully itemized in the County budget. SECTION 3 -That any Resolution, or part of a Resolution, conflicting with this Resolution be and the same is hereby repealed in so far as the same affects this Resolution. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the following Resolution imposing a total of eight tenths (.8) mills of real estate taxes for the purpose of the County Library in voting districts that have approved imposition of such tax by referendum and as authorized under the laws of the Commonwealth of PA in those voting districts. RESOLUTION #2009 - 19 BE IT RESOLVED, that a tax at the total rate of eight tenths (.8) mills on each dollar or eight (8) cents per one hundred (100) dollars of assessed valuation for the fiscal year 2010 for the County Library purposes, shall be and the same is hereby imposed upon all taxable real estate in Franklin County as heretofore authorized by the voters of the various voting districts and as authorized under the laws of the Commonwealth of PA. The meeting was adjourned at 9:52 a.m. with a motion by David S. Keller; seconded by Robert G. Ziobrowski. FRANKLIN COUNTY COMMISSIONERS
