HomeMy WebLinkAbout2010-07-29 Commissioner Minutes THURSDAY, JULY 29, 2010 The Franklin County Commissioners met Thursday, July 29, 2010, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the Pledge of Allegiance proceeded with the business of the day. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. Virginia Stake provided public comment and is presenting a petition to the Commissioners in favor of retaining new proposed courthouse in core of downtown. This was organized by Downtown, Inc. and has 1,000 signatures and was primarily done th during Chamberfest although gathered 50 signatures at July 20 meeting and 8/9 local stores in downtown section. Ms. Stake provided a short history of Courthouse from the first courthouse built in 1794 through current. Franklin County is to provide payment of th one rose every year on June 28 to a descendent of Chambers family. Seems fitting to put new court facility close to the current courthouse. This is why over 1,000 people signed the petition. With acquisition of Harmon’s, Chambersburg Trust and Lightup Chambersburg could put facilities in one local location. Would cause minimum upheaval to downtown and encourages Commissioners to seize this opportunity and run with it. nd Could use 2 Street property for additional county offices and new county parking lot, raze Sheetz building and put parking there could help when constructing new courthouse on main street block. 800 signatures came from Chambersfest and more th signed at meeting on July 20. Eight individuals gathered names during Chambersfest. A few businesses circulated petition. Did not coax people to sign it but did have to determine if they were residents of Franklin County first. For most part people reacted fast to signing it. Ms. Stake came from this for the love of history but longer worked with materials that presented became convinced that this is the best site. Respectfully submit this petition to board and will be receiving the following items: copy of actual deed for two lots, three informational sheets of what heard today and then petition itself. She eliminated people she found out were not from Franklin County. Ron Maxson also provided public comment and wanted to confirm that so many people are excited about keeping courthouse downtown. When getting signatures he was asked to explain why he thought courthouse should remain downtown. Real people out there beyond signing petition without knowing what petition was about. Excitement among people in keeping site downtown. Allen Piper also provided public comment and said that there was turmoil from 1740-1764 and Franklin County was considered a frontier because a lot of southerners came here and from around the world. Owe a lot of recognition to forefathers and don’t give them a lot of credit. Mr. Piper wanted to remind Commissioners and have brought this up before numerous times, would like to see and encourage Commissioners, most government bodies start meetings with moment of silent prayer, in a bible belt here. Travels County all the time and challenges them to travel with him. Not infringing on anyone if having a silent prayer. Every other body has a moment of prayer, can’t get them to implement one silently and would like Chairman to explain why haven’t. Commissioner Keller responded that normally don’t respond directly during public comment but it’s safe to say that this board has recognized a moment of silence on some occasions, don’t do it habitually and will happen again in future. Personally when he prays it is his business and he does and don’t feel obligated to do it but when he chooses to. Commissioner Thomas also responded that not opposed, but when say will or shall will become more of a showcase, not what prayer is about but have a personal Continued on page 2 relationship with God and Jesus Christ. Knows power of prayer and in this most difficult time going through what went through understands this. Commissioner Keller said that any municipality that chooses to pray it is up to them. Commissioner Ziobrowski said that if anyone here reviews the minutes of County Commission for last 50 years haven’t changed anything and concur with Commissioners Keller and Thomas. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved payments made regarding Emergency Services CERT Grant and authorizes Chairman to approve those when information is known not to exceed $4,000 at a later time today. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the minutes of July 20, 2010 and July 22, 2010 meetings. The Board reviewed Commissioners Office matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Memorandum of Understanding between the County of Franklin and the Franklin County Conservation District to address district operations, functions and responsibilities as they relate to both state law and the county government in order to provide the highest degree of mutual understanding and cooperation. This Agreement will be reviewed every five years or as needed. The Board reviewed Community Services matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the PA Department of Agriculture State Food Purchase Program Expense and Data Report for Fiscal Year 2009/2010 for the South Central Community Action Program. The Board reviewed Fiscal matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the IDIS OnLine Access Request to Housing and Urban Development (HUD) to include Nancy Johns from Fiscal as a grantee and requestor for grants. This is a correction to Board Action taken on April 15, 2010. The Board reviewed additional Fiscal matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Engagement Letter from Zelenkofske Axelrod, LLC to complete the 2009 financial statement and single audits at a cost not to exceed $100,125.00 to be completed by August 31, 2010. The Board reviewed Grants Management matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the JAG Local Jurisdiction Waiver Application to apply for funding for the Victim of Juvenile Offenders from PA Commission on Crime and Delinquency. The Board reviewed Jail matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Proposal from NAC Divisions to purchase CRT monitors for Central Security for the Jail at a cost of $2,129.00. Three quotes were received and this was the quote selected due to the locality of the business and promptness on installation of the monitors. Ziobrowski; unanimously approved the 2010 Budget Adjustment to amend the Jail Work Program’s budget to reflect revenue received and related expenses. In accordance with PA Acts 67, 68 and 127 notifications, William A. Brindle Associates, Inc. notified the County of a Pennsylvania Department of Environmental Protection NPDES Renewal Permit application being applied by Quincy Sewer Authority to cover discharges of treated-sewage effluent from plant located in Quincy Township. In accordance with PA Acts 67, 68 and 127 notifications, Red Barn notified the County of a Pennsylvania Department of Environmental Protection NPDES CAFO Renewal Permit application being applied by Longacre Farm, LLC for existing swine operation located in Dry Run. In accordance with PA Acts 67, 68 and 127 notifications, Allen Jaymes notified the County of a Pennsylvania Department of Environmental Protection NPDES Renewal Permit application being applied for Jaymes utility line crossing in Warren Township. In accordance with PA Acts 67, 68 and 127 notifications, Keller Engineers notified the County of a Pennsylvania Department of Environmental Protection Water Supply Permit application being applied by Pizza Star III for addition of a liquid chlorine feed to the water treatment system serving the restaurant located in Metal Township. Commissioner Thomas left the meeting room at 9:43 a.m. The meeting was adjourned at 9:45 a.m. with a motion by Robert G. Ziobrowski; seconded by David S. Keller. FRANKLIN COUNTY COMMISSIONERS
