HomeMy WebLinkAbout2010-10-07 Commissioner Minutes THURSDAY, OCTOBER 7, 2010 The Franklin County Commissioners met Thursday, October 7, 2010, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the Pledge of Allegiance proceeded with the business of the day. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. Allen Piper provided public comment and wanted to read something of interest to the Board and everyone in attendance concerning the courthouse project. Mr. Piper went through the history of the courthouse since 1753 and explained there is a lot of history in Franklin County dating back many generations. Mr. Piper was involved in the referendum in Tuscarora School District and he knows there are state laws that must be followed in order that the County may place a referendum on the ballot relative to the construction of the judicial facility. Mr. Piper questioned the Board if they are considering a referendum to allow the people to vote on it. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the minutes of September 28, 2010 and September 30, 2010 meetings. Phil Tarquino, Planning Director and Dr. John Benhart, Planning Commission, met with the Board to provide an overview of the contract with Environmental Planning and Design (EDP) to provide consulting services for the County’s Comprehensive Plan. Dr. Benhart explained the last comprehensive plan was adopted in 1999 and provided a blue print for the County. An RFP was sent out and there were eight requests. The Planning Commission formed a subcommittee and narrowed down the RFP’s and then had interviews. The Committee selected EPD. Staff finalized the agreement which included scope of work and cost of the contract. Mr. Tarquino checked EPD’s references which were all good and asked the Board to accept the recommendation to contract with EPD. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement between the County of Franklin and Environmental Planning and Design (EPD) to provide planning consulting services for the preparation of the Franklin County Comprehensive Plan at a cost of $99,328.00. Funds for the project will come from the Solid Waste Fund. The Board reviewed Commissioners Office matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Letter of Agreement between the County of Franklin and Thomas R. Donahue to appraise one residential property located in the Borough of Chambersburg at a cost of $325.00. The Board reviewed Court Administrator matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the 2010 Budget th Adjustment in the amount of $12,000.00 for extension of the 6 law clerk until the end of 2010. Continued on page 2 The Board reviewed Courts matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement between the County of Franklin and Kevin Taccino to provide legal counsel for juveniles involved in the delinquency process while current contracted attorney is on extended leave at a cost of $50.00 per hour for a total amount not to exceed $16,312.50 for the period of September 24, 2010 through December 31, 2010. The Board reviewed additional Courts matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement between the County of Franklin and Eric Weisbrod to provide legal counsel for juveniles involved in the delinquency process while current contracted attorney is on extended leave at a cost of $50.00 per hour for a total amount not to exceed $16,312.50 for the period of September 24, 2010 through December 31, 2010. The Board reviewed Fiscal matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the 2010 Budget Adjustment in the amount of $50,000.00 for Adult Probation, Juvenile Probation & Domestic Relations needed to fund the cost of legal representation. Funds are being transferred from contingency, no additional county funds are required. The Board reviewed Grants Management matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the Quarterly report to PA Department of Community and Economic Development of the American Recovery and Reinvestment Act funds being used for the Homeless Prevention and Rapid Rehousing Program for the period of July 2010 through September 2010. The Board reviewed Information Services matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Quote from Digital Sunrise to provide SAN hardware, two servers and consultant services at a cost of $61,922.20. This company is on the Co-Stars-3 state contract listing. The Board reviewed Nursing Home matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the Agreement between the County of Franklin and Aetna Health, Inc. for the Nursing Home to be an in-network provider for Aetna Health insurance participants at no cost to the County for the period of December 1, 2010 through December 31, 2013. The Board reviewed Planning matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the Quarterly report to PA Department of Community and Economic Development for the American Recovery and Reinvestment Act being used for the Community Development Block Grant-R program for the period of July 2010 through September 2010. In accordance with PA Acts 67 & 68 notifications, P. Joseph Lehman, Inc. notified the County of a Pennsylvania Department of Environmental Protection BWM- GP-11 General Permit Registration application being applied by Antrim Township Supervisors for rehabilitation of a historic covered bridge located in Antrim Township. Continued on page 3 John Hart, Chief Clerk/County Administrator was asked by the Board to present an agreement with Noelker and Hull Associates, Inc. to provide architect/design services for the judicial project. The agreement sets forth the conditions, design of facilities, construction and site selection, demolition and remodeling. The costs for this agreement have been factored into the estimated project costs as presented by CGL. If this agreement is not fully fulfilled Noelker and Hull will only get paid for work performed. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement between the County of Franklin and Noelker and Hull Associates, Inc. to provide architect and design services for the Franklin County Judicial Campus Project. Fees for this service have not been established and will be added by addendum at a later date. John Hart, Chief Clerk/County Administrator informed the Board of the following items: Executive session to discuss real estate matters. The Board met with the Human Resources Associate and the Controller for Salary Board matters. The Board met with Teresa Beckner, Fiscal Director to discuss the following items: Reviewed the 2010 budget performance through July and the 2011 budget preparation. The County Solicitor met with the Board and asked for an executive session to discuss the Crown American Financing Tax Appeal matter. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; to enter an executive session at 9:55 a.m. this date for the unanimously approved purpose to review Real Estate and Crown American Financing Tax Appeal matters. The Board reconvened into regular session at 10:30 a.m. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to authorize Mary Beth Shank to enter into an agreement with Crown American (PREIT) parcel #09-C-19-1, Chambersburg School District and Greene Township. The County will refund Crown American for County taxes paid in 2010 by giving a credit on taxes in 2011 and 2012. The meeting was adjourned at 10:38 a.m. with a motion by Robert L.
