THURSDAY, MAY 5, 2011
The Franklin County Commissioners met Thursday, May 5, 2011, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the
Pledge of Allegiance proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of April 26, 2011 and April 28, 2011 meetings.
The Board reviewed Drug & Alcohol matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Agreement between the County of Franklin and Quest Diagnostics
to provide laboratory services for clients in the Drug and Alcohol system to
determine/confirm type of substance being abused and also verify the individual is using
medication assisted therapy properly at a cost depending on lab tests and results as
stated in Attachment 1. This agreement is effective April 21, 2011 and can be
terminated by either party with a 30 day written notice.
The Board reviewed Election matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Agreement between the County of Franklin and Living Faith
Chapel to provide facilities for use as a polling place on May 17, 2011 in the
Southampton-East precinct at a cost of $200.00.
The Board reviewed FSNRC matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Agreement between the County of Franklin and Franklin County
Career and Technology Center to use the nursing home as a clinical site for training of
licensed practical nurses. FSNRC provides a setting for students to learn about nursing
home care of individuals and develop their clinical skills. This Agreement is no cost to
the County and is for the period of July 1, 2011 through June 30, 2012.
The Board reviewed additional FSNRC matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the Agreement between the County of Franklin and Franklin Link
Network to provide public information, referral and assistance to older adults over 60 and
persons under 60 with physical disabilities at no cost to the County. This is an
opportunity to increase Falling Spring Nursing and Rehabilitation Center availability to
the public of the nursing home’s services. This agreement can be terminated by either
party with a 30 day written notice.

The Board reviewed additional FSNRC matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement
between the Falling Spring Nursing and Rehabilitation Center and Franklin County Area
Agency on Aging to provide emergency placement for nursing home eligible residents
who need to be relocated under the Protective Services program of the Area Agency on
Aging on a temporary or long term basis. The Area Agency on Aging will reimburse the
Nursing Home up to 20 units of care at the current costs of $198.00 per day for a total
maximum encumbrance of $3,960.00 for the period of July 1, 2010 through June 30,
2011 with an option to renew annually.
The Board reviewed Grants Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Grant
Application to Pennsylvania Commission on Crime and Delinquency (PCCD) requesting
a grant in the amount of $213,490.00 from the PCCD’s Drug and Alcohol Restrictive
Intermediate Punishment Program Funds. Franklin County Adult Probation and Drug
and Alcohol Department are collaborating to provide intensive case management
services to sentenced offenders. In addition to the intense supervision by the Adult
Probation Officer, Drug & Alcohol assesses eligible offenders and refers them to
necessary treatment and supporting service. This grant would be for the period of July
1, 2011 through June 30, 2012.
The Board reviewed Human Services matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Agreement
between the County of Franklin and Allan Collautt Associates to continue the conversion
of the Human Service’s data systems into the integrated data warehouse and convert
Area Agency on Aging’s data system titled SAMS into the integrated data warehouse at
a cost of $10,000.00 for the period of May 1, 2011 through June 30, 2011. The County
has received State approval to use Human Services Development Funds to cover all
costs associated with this contract.
The Board reviewed Visitors Bureau matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Contract between the
County of Franklin and Celebrate Gettysburg to provide a 1/3 page ad in the May/June,
July/August and November/December issues to promote what to see and do in Franklin
County as well as www.ExploreFranklinCountyPA.com at a cost of $1,800.00 for the
period of May 5, 2011 through December 31, 2011. Room tax revenues pay for this
expense no county tax dollars are used.
In accordance with PA Acts 67, 68 and 127 notifications, Franklin County
Conservation District notified the County of a Pennsylvania Department of
Environmental Protection General Information Form being applied by Larry Harshman
Farm located in Antrim Township.
In accordance with PA Acts 67, 68 and 127 notifications, Carl Bert & Associates
notified the County of a Pennsylvania Department of Environmental Protection NDPES
Permit application being applied by United Business Park for commercial/industrial
development proposed by the Cumberland Valley Regional Development Corporation on
property located in Southampton Township.
The Board met with the Human Resources Director, the Controller and DES
Director for Salary Board and Personnel matters.
The Board reviewed Personnel matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Hazardous Materials
Information Tech position description.

The Board reviewed information regarding Corrections Employee Week. On a
motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved
the to sign Franklin County Proclamation #2011-09 proclaiming the week of May 1 to 7,
2011 as Corrections Employee Week and that the attached proclamation be made a part
of these minutes.
Commissioner Keller opened the floor for further discussions on facilities
modifications and asked if there were any outstanding questions or concerns.
Commissioner Thomas commented that his only concern is he would like to see process
move forward as soon as possible. He said that challenges were identified Tuesday by
attorneys and the Sheriff commented that he needs a sally port now. This plan has the
ability to move people out of the courthouse to make space for the judge and will open
up courtroom #1. The Board needs to proceed immediately and get project moving
forward. The County has money identified so can move forward with this project and
solve issues that have been identified and relieve pressure on the courts. With this plan
security is there, would get a fifth courtroom, and settle ADA issues. Commissioner
Thomas further stated this was a well thought-out plan.
Commissioner Ziobrowski said that plan A was to build a new courthouse but
plan B is good and concurs with Commissioner Thomas statements, but will still have to
address some of the issues with keeping people separate. He said operational costs
would have been less then what the bond proceeds would have cost for new facilities.
Commissioner Ziobrowski further stated that tax payers will be less stressed by this plan
and supportive of it. Commissioner Thomas responded that doing nothing is not an
answer and not responsible.
Commissioner Keller understands that the Board is in agreement that an
advisory board and additional evening meetings is not warranted at this time?
Commissioner Thomas said this needs to happen and won’t delay it anymore.
Commissioner Keller said that costs of project is in line with what board stated and does
not include a tax increase. Staff and Noelker and Hull worked with courts and judges
which have resulted in a good plan that will get us several years down the road.
Commissioner Thomas said the challenge will be to continue to work together to help
these improvements last. This plan does not address all issues but will continue to work
hard to deal with them. Commissioner Thomas commented that have good managers,
have good ideas and good plans that answer the issues of ADA, security and immediate
needs of the courts. He further stated this is a good process and it works.
Commissioner Keller asked John Hart what next step would be. John Hart
responded that have a contract with Noelker and Hull that included Phase 1 and Phase
2 with phase 1 being completed now. He said phase 2 is instructing Noelker and Hull to
move forward to develop construction documents which include: architectural work,
MEP, drawings and specifications and develop into a bid packet and they will supervise
the bidding process. Mr. Hart stated that he may need to pull staff in to make sure doing
a good job.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to authorize staff to move forward to work with Noelker & Hull to
develop bid documents and amend motion to include an artist rendering to show what
old courthouse would look like with ramp added. It’s important not to lose the historical
value of the courthouse.

Commissioner Ziobrowski said these plans have been exposed to the public for
about a week and have heard nothing but positive from everyone. The only negative he
received, outside of editor from Public Opinion that wants to build a new courthouse, are
ones that have a political motive. He stated this is a good plan and have to move ahead
with regardless of politics.
The meeting was adjourned at 10:30 a.m. with a motion by Robert L. Thomas;
seconded by Robert G. Ziobrowski.

Corrections Employee Week May 1 -7, 2011
WHEREAS, today Franklin County faces new and difficult challenges in corrections such as
increasing numbers of violent inmates, increasing numbers of inmates with severe mental
illness problems, and heightened budget constraints; and
WHEREAS, the secure and safe operation and management of our facilities on a daily basis
rests in the hands of our trained, skilled and dedicated corrections professionals. They are
administrators, corrections officers, counselors, treatment specialists, educators, clerical
support staff, business administrators, clergy, medical professionals, and food service
specialists, upon whose skills, efficiency and professionalism the functions of the Franklin
County Jail depends; and
WHEREAS, these dedicated professionals are constantly improving efficiency and
effectiveness by implementing initiatives like Central Booking, Mental Health Diversion, Video
Conferencing, Court at the Jail, and Staffing Analysis.
THEREFORE, We the Franklin County Commissioners do hereby proclaim May 1 -7, 2011, as
CORRECTIONS EMPLOYEE WEEK in Franklin County. We encourage all of Franklin County
to recognize the vital role these dedicated professionals play in ensuring the effective
operation of our correctional system in the interest of public safety.
