THURSDAY, AUGUST 18, 2011
The Franklin County Commissioners met Thursday, August 18, 2011, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the
Pledge of Allegiance proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
The Board reviewed the minutes from the previous week and Commissioner

Thomas requested a change on the August 11 meeting minutes. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the
minutes of August 9, 2011 and August 11, 2011 meetings.
The Board reviewed Children & Youth matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Subsidized
Adoption Assistance Agreement on behalf of the Franklin County Children and Youth
Department to provide a subsidy to adoptive parents to be used for adoptive children
with special needs for payment in the amount of $35.00/day for the period of August 20,
2011 through August 19, 2016, in addition a one-time payment not to exceed $602.89 to
cover non-recurring adoption expenses. The different needs of the child determine the
cost per month. The County is reimbursed through the Federal Financial Participation
program.
The Board reviewed Human Resources matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Letter of
Engagement between the County of Franklin and Eckert Seamans to provide attorney
services for contract negotiations at a cost of $235.00 per hour which is a discount from
$330.00 per hour normally charged and a cost of $100.00 - $200.00 for paralegals work.
This Letter of Engagement is for the year 2011.
The Board reviewed Nursing Home matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Renewed Contract between the County of Franklin and Hospice
Preferred Choice d/b/a AseraCare Hospice to provide respite and inpatient services to
residents who are clients of AseraCare Hospice. Currently contracted with the
Harrisburg region, we are being reassigned to the York region at no added cost for the
period of July 1, 2011 through June 30, 2012. This agreement provides an alternative for
our residents needing hospice services and referral opportunities to us from AsceraCare
who have clients living in the community who require skilled nursing placement and
services. Terminally ill residents can receive services beyond those available from the
nursing home.

The Board reviewed Nursing Home matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Renewed Contract between the County of Franklin and Summit
Health to provide pacemaker interrogation services performed telephonically to check
the calibration/operation of an individual’s pacemaker which is performed quarterly
unless other physician orders are indicated paid for by the patient’s private insurance or
Medicare. This agreement is for the period of September 1, 2011 through August 31,
2012.
The Board reviewed Property Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Notice of Intent
to Award and Notice of Award to give notice to Porters Carpet and Furniture of the
County’s contract award for the Franklin County Human Services Building Carpet
Replacement Project for a bid amount of $32,109.00. This was bid and awarded by the
Board on Tuesday, August 9, 2011.
The Board reviewed Tax Services matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the Agreement between the
County of Franklin and Chambersburg Area School District to help prepare for trial
and/or in aid of negotiations, the taxing authorities may find it necessary to incur various
litigation expenses such as deposition costs, appraisals, and costs associated with
retaining expert witnesses. The costs for all services will be shared 22% by the County
and 78% by the School District.
In accordance with PA Acts 67, 68 and 127 notifications, Carl Bert & Associates
notified the County of a Pennsylvania Department of Environmental Protection NDPES
Permit application being applied by United Business Park for commercial/industrial
development proposed by the Cumberland Valley Regional Development Corporation on
property located in Southampton Township.
Teresa Beckner, Fiscal Director met with the Board to discuss the following
items: Review of 2011 expense and revenue budget performance through June; Human
Services June 30 end of year State reports; Budget packets were sent to the

departments August 5 with a return date of August 19 except for larger entities; And

expecting to deliver proposed budget to the Board on November 10.
Melissa Reisinger, Human Services Managed Care Director met with the Board
and provided an overview of the Behavioral HealthChoices Tuscarora Managed Care
Alliance. Ms. Reisinger explained that HealthChoices is Managed Care for
Pennsylvania’s Medical Assistance recipients and currently, there are two separate
components: Physical Health (OMAP, DOH) and Behavioral Health (OMHSAS, DOH,
OMAP). She informed the Board of the following activities of the HealthChoices
contract: In Plan Behavioral Health Services (Mental Health and Substance Abuse);
Provider Network Development; Care Management/Utilization Review;
Complaint/Grievance Activities; Quality Improvement; Claims Payment; Fraud, Waste
and Abuse Activities. Ms. Reisinger said the following about the funding: Provider Rate
increases 3 years consecutively; Consecutive 4 year decreases, based on actual claims
experience, on DPW’s “Per Member Per Month” rates; Maximized Retained Revenue
allowance each consecutive year of the contract; Retained revenue generated towards
reinvestment in our provider network or in securing reserves towards RANLI designation;
Since January 2009 there have been 52 open cases of fraud waste and abuse (FWA)
investigations, 2 closed, ten founded cases and recouped $26,335.35.
