HomeMy WebLinkAbout2011-10-06 Commissioner Minutes THURSDAY, OCTOBER 6, 2011 The Franklin County Commissioners met Thursday, October 6, 2011, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, and the Pledge of Allegiance proceeded with the business of the day. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. There was no public comment. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the minutes of September 27, 2011 and September 29, 2011 meetings. Chairman Keller announced the Board was requested to consider a resolution seeking consideration by the State to appeal the Prevailing Wage Law. Other Municipalities have passed similar resolutions. Commissioner Ziobrowski gave the history and why the Board is considering this resolution. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved Resolution #2011- 12, which is attached and made a part of these minutes, for the purpose of urging the Pennsylvania Legislature to free our taxpayers from the undue fiscal burden placed upon them by the Pennsylvania Prevailing Wage Act of 1961. The Board reviewed Commissioners’ Office matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the renewal contract between the County of Franklin and Borough of Chambersburg, Greene Township, Hamilton Township, Guilford Township and West Shore Ambulance to provide for Basic Life Support and Advanced Life Support services at a cost of $50.00 for each chargeable call for the period of January 1, 2012 through December 31, 2014. The Board reviewed Grants Management matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the renewal contract between the County of Franklin and Pennsylvania Commission on Crime and Delinquency (PCCD) to enhance record sharing among Adult Probation, the Public Defender’s Office, and the Jail. The total grant request is $199,359.00 with the 2010 CJAB Initiatives Grant Year Two covering 50% of the cost at $99,679.00 for the period of January 1, 2012 through December 31, 2012. The Board reviewed Property Management matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the new contract between the County of Franklin and ThyssenKrupp Elevator to replace a hydraulic piston seal on the Courthouse Annex elevator #2. This is a one-time cost of $1,312.00. The Board reviewed Transportation matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Allocation Letter from Pennsylvania Department of Public Welfare for the County’s Medical Assistance Transportation Program (MATP) for the County to receive the total amount of $717,793.00. Included is an Assurance of Compliance to Pennsylvania Department of Public Welfare for the MATP Grant Allocation Agreement for the period of July 1, 2011 through June 30, 1012. Continued on page 2 In accordance with PA Act 14 notifications, JLG notified the County of a Pennsylvania Department of Environmental Protection NDPES Permit renewal application for air quality at a tow truck manufacturing facility located at 15276 Molly Pitcher Highway, Greencastle, PA. In accordance with PA Act 14 notifications, PPL Services Corporation notified the County of a Pennsylvania Department of Environmental Protection General Permit to operate under the regulatory requirements of Municipal Waste General Permit Processing and Beneficial Use of Landfill Gas at IESI PA Blue Ridge Landfill, Greene Township, as a source of fuel to power four Caterpillar engines, which in turn will generate useable electricity. The Board met with the Human Resources Associate and the Controller for Salary Board and Personnel matters. The Board reviewed Personnel matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the revised Director, Environmental Services position description. The Board reviewed Personnel matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the revised Vehicle Operator position description. The Board reviewed Sheriff Office matters. This was the advertised date to receive bids for 8 portable radios and 7 mobile radios. No bids were received. According to County Code since no bids were received the County is able to try to sell these items. The meeting was adjourned at 10:26 a.m. with a motion by Robert L. Thomas; seconded by Robert G. Ziobrowski. FRANKLIN COUNTY COMMISSIONERS PREVAILING WAGE RESOLUTION#2011-12 A RESOLUTION OF THE FRANKLIN COUNTY BOARD OF COMMISSIONERS OF FRANKLIN COUNTY, PENNSYLVANIA URGING THE PENNSYLVANIA LEGISLATURE TO FREE OUR TAXPAYERS FROM THE UNDUE FISCAL BURDEN PLACED UPON THEM BY THE PENNSYLVANIA PREVAILING WAGE ACT OF 1961. WHEREAS,the Pennsylvania Prevailing Wage Act of 1961 requires that public construction, reconstruction, demolition, alteration and/or repair projects with an estimated cost greater than $25,000 pay laborers a wage set by the Secretary of Labor and Industry rather than local market rates; and WHEREAS,the prevailing wages set by the Secretary of Labor and Industry are generally 20-40% higher than local market labor rates; and WHEREAS,the cost and burden of these artificially inflated wages are borne by taxpayers in the form of higher taxes than would otherwise be necessary; and WHEREAS,the Pennsylvania Prevailing Wage Act institutionalizes overpayment by taxpayers for work that could be completed more economically with open competitive bidding; and WHEREAS, local contractors often choose not to bid on prevailing wage projects due to the administrative and financial overhead incurred; and WHEREAS, quality of work and timeliness of completion are determined by adequate oversight and good job-specifications, not by paying inflated wages; NOW THEREFORE, BE IT RESOLVED by the Franklin County Board of Commissioners of Franklin County, Pennsylvania that the Franklin County Commissioners urge the Pennsylvania Legislature to free our taxpayers from the burden of the Prevailing Wage Act by its entire repeal or passage of legislation adjusting the applicable minimum to reflect inflation and/or adjusting Prevailing Wage rates to better reflect local labor costs.
