THURSDAY, OCTOBER 11, 2012
The Franklin County Commissioners met Thursday, October 11, 2012, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
Ken Jones provided public comment that at Tuesday’s meeting Mr. Singer
requested 4.4% in additional funding not including capital projects but did include
increase for managerial staff. The Sheriff requested additional vehicles and staff and an
increase for his staff. Mr. Jones said Elected Officials are asking for increases but will
we see a decrease the people that serve the public so that we can all share in lean
times.
James Wyrick provided public comment and said he was at last night’s meeting
discussing the nonprofit for Mental Health services. Teresa Beckner mentioned this
would be a savings of $490,000 if the Commissioners decide to move forward with the
project. There is a savings of $312,000 to eliminate three administrative positions and
another savings of $122,000 which represents a total savings of 6% if go nonprofit. If
the County decides to not go nonprofit could these three positions be reduced or
eliminated for savings in the program. With reductions in funding, does the County have
ongoing periodic applications to look at expenditures. He said the meeting really pointed
out the human side of all this, there were people there that have family in the programs
and if reductions occur they have to decide if can continue to work. There were also
case worker concerns. There are a lot of people that rely heavily on government
assistance. He is praying for the Board in making these decisions in hard times.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of October 2, 2012 and October 4, 2012 meetings.
The Board reviewed Aging Office matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Waiver Request to PA Department of Aging (PDA) to expend a
minimum parameter of 51.6% of Aging Block Grant funds on In-Home Services cost
centers. In January 2012 PDA changed all Area Agency on Aging’s cooperative
agreements to meet Center for Medicare & Medicaid Services guidelines.
The Board reviewed Children & Youth matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Subsidized
Adoption Assistance Agreement on behalf of the Franklin County Children and Youth
Department to provide a subsidy to adoptive parents to be used for adoptive children
with special needs for payment in the amount of Contract 1: $249.00 a month for the
period of July 1, 2012 through December 1, 2015, in addition a one-time payment not to
exceed $0.00 to cover non-recurring adoption expenses. Contract 2: $37.88 a day for
the period of October 1, 2012 through September 24, 2013, in addition a one-time
payment per child not to exceed $-0- to cover non-recurring adoption expenses.
Contract 3: $31.38 a day for the period of October 1, 2012 through November 10, 2014,
in addition a one-time payment not to exceed $-0- to cover non-recurring adoption
expenses. The different needs of the child determine the cost per month. The County is
reimbursed through the Federal Financial Participation program.

The Board reviewed Commissioners’ Office matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute Change Order #3 from McCarty & Son to decrease the electrical
contract for the Franklin County Judicial Center renovations by $2,039.00 due to building
permit costs purchased on behalf of the MEP multiple contract documents.
The Board reviewed additional Commissioners’ Office matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute Change Order #4 from McCarty & Son to increase the
electrical contract for the Franklin County Judicial Center renovations by $212.70 to
include elevator pit lighting at the Hearing Annex.
The Board reviewed additional Commissioners’ Office matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the
Chairman of the Board to execute the renewal proposal between the County of Franklin
and The Zigmund Co., Ltd., for insurance consulting service which remain the same as
2011: $5,000.00 charged annually plus an hourly fee of $100.00 for consultation and
$50.00 for clerical support time; federal mileage rate per travel mile, and other expenses
incurred, if any, for the period of November 1, 2012 through October 31, 2013.
The Board reviewed Fiscal matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the agreement between the County of Franklin and Penn State
University to provide training on Logic Model for improving the county budgeting
process. Training is for up to 25 participants in two half-day sessions for a total cost of
$1,890.00 for the period of October 11, 2012 through December 31, 2012.
The Board reviewed Grants Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Project
Modification Request to PA Commission on Crime and Delinquency for the PCCD
Juvenile Defense Capacity Building Grant to extend the grant from September 2013 to
February 2014. This grant provides costs for legal defense counsel in juvenile probation
cases.
The Board reviewed Human Services Administration matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the
Proposal between the County of Franklin and NAC Divisions to install a duress system
for the Human Services Building for a one-time amount of $5,266.00, charged to the
separate departments at the Human Services Building.
The Board reviewed Property Management matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved the proposal from
M.S. Johnston and Company to replace an existing cooler and freezer doors in the
Nursing Home Dietary area at a cost of $7,235.00.
In accordance with PA Act 67, 68 and 127 notifications, Arro Engineering and
Environmental Consultants notified the County of a Pennsylvania Department of
Environmental Protection of an NPDES General Permit for Chambersburg Borough
Wastewater Treatment Plant Project with upgrades and expansions, with only 0.61 acre
affecting stormwater runoff.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to enter an executive session at 9:48 a.m. this date for the
purpose to review the Tax Assessment Appeal of Apex Mont Alto. The Board
reconvened into regular session at 10:05 a.m. Action will be required after the executive
session.

Mary Beth Shank, Solicitor asked approval to settle the Assessment Appeal with
Apex Mont Alto Docket #2010-5619. On a motion by Robert L. Thomas, seconded by
Robert G. Ziobrowski; unanimously approved to authorize Mary Beth Shank to enter into
an agreement with Apex Mont Alto and Waynesboro School District. This will be a five
year plan starting in 2011 for assessed fair market value of 2.5M for 2011 and 2012,
2.75M for 2013, 3M for 2014 and 3.5M for 2015. The County will refund Apex Mont Alto
in the amount of $7,979.63 for the year 2011 and $8,010.26 for the year 2012.
Chairman Keller complimented Commissioner Thomas on his comments during
the dedication at Letterkenny yesterday of new equipment in honor of Master Sargent
Ben Bitner who was killed in Afghanistan last year. Commissioner Thomas said his
comments came from the heart and even though he didn’t know Sargent Bitner well, he
stayed in close contact with his family. He said it was a real challenge and tough to
keep his composure knowing the loss that the family feels. Commissioner Thomas
stated we need to be very grateful for those serving over there.

seconded by Robert G. Ziobrowski.
