HomeMy WebLinkAbout2013-05-30 Commissioner Minutes THURSDAY, MAY 30, 2013 The Franklin County Commissioners met Thursday, May 30, 2013, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance proceeded with the business of the day. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. Michelle Jansen provided public comment concerning her comment last week about her group not seeking tax exempt status from the IRS. She is seeing as the most disturbing aspect of this, a lot of it is falling on unelected bureaucratic shoulders, the buck is being passed. Lois Lerner has been asked to resign and she has refused so this will be a long and drawn out process that could take two years. So many bureaucrats that affect people’s lives, they have a lot of power over us and can’t be held accountable. She sees the growing bureaucracy at Federal, State and local level and is fearful of what she sees. The unelected bureaucrats have been given lots of power and governments need to be more weary about whom they are giving power to. This is why she is getting more involved. Ken Jones provided public comment and reiterated what Ms. Jansen said. Government today refuses to even read bills that they are passing like the healthcare bill. He said that 99% of House and Senate have not even read it. It’s a surprise – have to pass it so can see what’s in it. The unelected bureaucrats are worse than elected ones because the people don't have a chance to throw them out. Citizens are concerned that have a runaway government out of control. He said they depend on the three Commissioners to at least alay their fears at local level. Mr. Jones asked about item #3, CS Davison proposal, the locations of bridges and it would be helpful to see what the needs are at these bridges and item #5, Coroner vehicle, he asked who the other quote was from. Allen Piper provided public comment and is interested in remarks made this morning. He concurs with Ms. Jansen and Ken Jones. There is a problem in Washington, State and local level. He also questions item #3, CS Davison proposal as location and costs were not identified. How is any cost justified pertaining to these bridges, who gives authority and who makes decisions? This is a major cost to tax payers. He would like information at the next meeting. He appreciates all three board members and Mr. Hart and he appreciates all that the County does. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the minutes of May 23, 2013 meeting. Commissioner Thomas wanted to clarify the bridge proposal that the contract is actually only $15,000.00 for engineering costs. The estimated fee of $100,000.00 is the estimated construction cost to repair the bridges and is for information only. The Board will not know the construction costs until the bidding process is complete. Continued on page 2 The Board reviewed Aging matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Addendum to a Contract between the County of Franklin and the Upper Strasburg Community Center to provide a supplemental grant to pave the parking lot and install protective four bollard posts around a pump. Contract term is May 15, 2013 through June 30, 2013 at a cost of $1,873.00. Funds are provided by the Aging Block Grant. This addendum would also extend the rental agreement with Upper Strasburg Community Center through June 30, 2018. The Board reviewed additional Aging matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the Food & Beverage License to the PA Department of Agriculture/Commonwealth of PA for the Tuscarora Senior Activity Centers at a cost of $82.00 for the period of June 4, 2013 through June 3, 2014. It’s a state regulation to have a food and beverage license that needs renewed annually. No increase from last year. The Board reviewed Commissioners matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the contract between the County of Franklin and C.S. Davidson to supplement engineering services for bridges 49, 98, 119, and 124 in conjunction with the 2013 Bridge Maintenance program. Contract term is May, 2013 through September 2013 at an engineering cost of $15,000.00. The Board reviewed Emergency Services matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the contract between the County of Franklin and Essential Management Services, LLC. to provide assistance with yearly review and updates for submittal of annual/triennial plans and funding requests to PEMA, for 9-1-1 Wireline/Wireless planning and funds management, ensuring proper compliance and full potential of program funds. Contract term is May 28, 2013 through May 28, 2016 at a cost of $27,300.00. These funds are Wireless eligible 65% and Wireline eligible 35% until June 2014. After June 2014 will be 100% Wireline. The Board reviewed Drug & Alcohol matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the Renewal contract between the County of Franklin and Healthy Communities Partnership to provide student assistant programs, prevention activities and elementary intervention groups services for FY 2013-2014. Contract term is July 1, 2013 through June 30, 2014 at a cost of $41,275.00 with 100% funding provided by the DDAP Grant. The Board reviewed Grants Management matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the contract between the County of Franklin and County Commissioners Association of Pennsylvania (CCAP) for CCAP to license, install and provide technical support for the Unified Case Management System at the Jail, Adult Probation and the District Attorney’s Office to improve case management within these departments at a cost of $71,552.48 to be paid by PCCD’s CJAB Initiatives Year 2 grant. Continued on page 3 The Board reviewed Human Resources matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the contract between the County of Franklin and Capital Blue Cross to administer the Group Preferred Provider Benefit, Group Medicare Complementary Coverage, Prescription Drug Benefit and Group BlueCross Vision contracts to County employees and retirees for the period of January 1, 2013 through December 31, 2013. In accordance with PA Acts 67, 68 and 127 notifications, CET Engineering Services notified the County of a Pennsylvania Department of Environmental Protection NPDES Permit application being applied by Washington Township Municipal Authority to replace 5,400 linear feet of force main associated with construction activities. In accordance with PA Acts 67, 68 and 127 notifications, Gannett Flemming notified the County of a Pennsylvania Department of Environmental Protection NPDES, USACOE and DEP 105 Permit application being applied by Gannett Flemming to rehabilitate and improve Gunter Valley Dam located in Lurgan Township. In accordance with PA Acts14, 67, 68 and 127 notifications, Mike Keller notified the County of a Pennsylvania Department of Environmental Protection NPDES Permit application being applied to install two stream crossings located at 8213 Rowe Run Road in Southampton Township. The Board reviewed appointments to the Franklin County Library Board. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to appoint Gloria Guba and Mark Orndorf for a term of May 30, 2013 through December 31, 2014. The Board held a public presentation of the National Center for Missing and Exploited Children (NCMEC) certification to Department of Emergency Services. David Donohue, Emergency Services Director was present along with DES staff. Mr. Donohue explained that recently DES has worked with NCMEC to accredit the Communication Center to a national standard for NCMEC. He explained that many children are abducted by a friend or family in the United States and another issue is identifying children who have been abandoned. He said stranger abduction changes a whole community as was the case with the Adam Walsh abduction years ago, the community has still not recovered. He said Dispatch and Management have been trained and protocols are in place and Ben Rice has been the forefront of this. Mr. Rice presented the certificate to the Board of Commissioners. NCMEC works with the National Center Standards Institute who reviews policies, training and the new standard for dispatchers. Chairman Keller reported that every year 800,000 children go missing in the United States. This partnership shows Franklin County’s commitment to missing & exploited children. Chairman Keller asked how many children go missing in Franklin County? Mr. Donohue responded there were 300 cases in 2012 that were runaway, missing or exploited in Franklin County. Chairman Keller thanked staff and asked them to keep the Board informed. Commissioner Thomas said excellence is going to the next level. We can't stay stagnant and he appreciates what they have done. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to enter an executive session at 10:13 a.m. this date for the purpose to review the Tax Assessment Appeals of 503 Mason Dixon LLC v. Franklin County Board of Assessment (2011-5300) and Con-Way Transportation v. Franklin County Board of Assessment (2011-5299). The Board reconvened into regular session at 10:22 a.m. Continued on page 4 Mary Beth Shank, Solicitor asked approval to settle two Assessment Appeals. The first appeal with 503 Mason Dixon LLC v. Franklin County Board of Assessment (2011-5300). On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to authorize Mary Beth Shank to enter into an agreement with the following: 503 Mason Dixon LLC a settlement for 2012 with fair market value (FMV) of 3.5 million x 13.1 common level ratio (CLR) = $458,500 and 2013 with FMV of 3.6 million x 13.1 CLR = $471,600. The County will refund Mason Dixon in the amount of $1,583.73 for 2012 and $1,279.73 for 2013. The second appeal with Con-Way Transportation (#2011-5299) a settlement for 2012 with FMV of 5.0 million x 13.1 CLR = $655,000 and 2013 for a FMV of 5.2 million x 13.1 CLR = $681,200. The County will refund Con-Way Transportation in the amount of $3,000.60 for 2012 and $2,387.78 for 2013. The meeting was adjourned at 10:24 a.m. with a motion by Robert L.
