TUESDAY, SEPTEMBER 17, 2013
The Franklin County Commissioners met Tuesday, September 17, 2013, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance proceeded with the business of the day.
Chairman Keller requested to change the description under Executive Session to
real estate matters to review nursing home proposals. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved to adopt the
amended agenda.
Jay Lightfoot provided public comment and asked if the Board knows what month
and year the home was desegregated. Chairman Keller said the Board will get back to
him.
Kim Wertz wanted to clarify what she said last week and that she is appreciative
of Chairman Keller with what he did with her housing problems. She speaks for all the
people that can’t be here like the elderly, indigent and people with physical or mental
disabilities.
The minutes of September 10, 2013 and September 12, 2013 meetings were
reviewed. These will be approved Thursday, September 19, 2013.
The Board reviewed Agreements, Contracts and Reports. Commissioner
Thomas asked if items #4 & 5 concerning bond refinancing were discussed publicly and
Chairman Keller assured him it was. Commissioner Thomas said this is the cost of
doing business, have to spend a little to save a lot but it’s a good opportunity to
refinance bonds. Commissioner Thomas commented that he’s glad to see the County is
continuing the Red Ribbon Week drug & alcohol prevention activities. Chairman Keller
said he is volunteering at the Coalition for the Prevention of Substance Use and Abuse
table during Apple Fest at the Farmers Market area, which is part of the Red Ribbon
Week activities.
The following items were approved today and the remainder items will be
approved Thursday, September 19, 2013.
The Board reviewed Fiscal matters. On a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas; unanimously approved for the Chairman of the Board to
execute the letter of engagement from The Public Financial Management, Inc. (PFM) to
invest the required escrow portion of the proceeds from the advance refunding bonds
from the series 2004 at a cost of $15,000 if open-market securities are used and
$2,500.00 if SLGS are used exclusively for the period of September 17, 2013 through
November 4, 2013.
The Board reviewed additional Fiscal matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved for the Chairman of
the Board to execute the letter of engagement from the Bond Resource Partners, LP to
conduct an independent confirmation of the calculations relating to the bonds and the
required escrow amount for completion of the bond sale, series 2004 at cost of
$2,500.00.

The Board conducted a bid opening for suboxone medication for Franklin County
Adult probation Offenders. One bid was received from Chambers Apothecary from
Chambersburg who bid the following: 2 Mg film for $8 per film; 4 Mg film for $9.70 per
film; 8 Mg film for $9.84 per film; and 12 Mg film for $19.00 per film. On a motion by
Robert G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved to forward
the bids received to the Day Reporting Director, the County Solicitor and the Purchasing
Director for their review. The Board will award or reject the bids on September 19, 2013
at 9:40 a.m.
The Board conducted a bid opening for a Fifteen Passenger Transport Van for
Franklin County Jail and Fifteen Passenger Van for the Franklin County Property
Management/Liquid Fuels Fund. The following bidders submitted bids: Vehicle #1:
Forrester Lincoln of Chambersburg bid a 2012 or 2013 model E350 for a bid amount of
$25,990.00 with a warranty of balance of factory or maximum of 36,000 miles, or 3
year/36,000 miles; Jennings of Chambersburg bid a model CG706-2013 express
passenger van for $26,500.00 plus license with a warranty of bumper to bumper through
3/16/16 or 36,009 miles, power train until 3/16/18 or 100,009 miles. And Cloth seats
change to vinyl for $1,650.00; Keystone Ford of Chambersburg bid a 2014 Ford E-350
Super Duty XL for $27,735.00 for a warranty of 36 months or 36,000 miles, powertrain
warranty of 60 months or 60,000 miles and roadside assistance for 60 months or 60,000
miles. Vehicle #2: Forrester Lincoln of Chambersburg bid a 2012 or 2013 E350 for
$25,990.00 with a warranty of balance of factory or maximum of 36,000 miles, or 3
year/36,000 miles; Jennings of Chambersburg bid a model CG33706 2013 for
$26,200.00 plus license with a warranty of bumper to bumper through 2/6/16 or 36,009
miles, power train until 2/6/18 or 100,009 miles. And cloth seats change to vinyl for
$1,650.00; Keystone Ford of Chambersburg bid a 2014 Ford E-350 for $27,235.00 with
a warranty of 36 months or 36,000 miles, powertrain warranty of 60 month or 60,000
miles and roadside assistance for 60 months or 60,000 miles. On a motion by Robert G.
Ziobrowski, seconded by Robert L. Thomas; unanimously approved to forward the bids
received to the Warden, the Property Management Director, the County Solicitor and the
Purchasing Agent for their review. The Board will award or reject the bids on September
26, 2013 at 9:40 a.m.
Chairman Keller announced that Jay Wenger, Consultant with Susquehanna
Group Advisors, is present to answer any questions from the Board or the public. There
were no questions.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to enter an executive session at 10:09 a.m. this date for the
purpose to review real estate matters to review the bids for Nursing Home proposal.
The Board reconvened into regular session at 11:23 a.m. Chairman Keller announced
that the Board received additional information during executive session regarding the
two final prospects who have expressed interest in purchasing the Nursing Home. The
Chairman’s impression is that no additional information is required from staff, vendors or
the consultant, and that the board is prepared to discuss this Thursday whether to move
forward with the sale of the nursing home and, if so, who the top vendor will be to
purchase the Nursing Home. Commissioner Thomas concurs that it’s time to make a
decision so couple days of reflection would be good. Commissioner Ziobrowski said he
is prepared to have discussion on Thursday. Mr. Wenger will be present at Thursday’s
meeting also.
